Judge declares mistrial in Karen Read murder trial
The Norfolk County District Attorney's Office says it plans to retry the case.
Following days of deliberations and multiple notes from the deadlocked jury, Judge Beverly Cannone has declared a mistrial in the high-profile and often contentious Karen Read murder trial.
The jury was tasked with determining whether Read, 44, drunkenly and intentionally backed her SUV into her boyfriend, Boston Police Officer John O’Keefe, on a snowy night in Canton two years ago. Lawyers for the Mansfield woman had alleged she was framed in a coverup.
A unanimous jury is needed for any conviction or acquittal, and jurors ultimately failed to reach a consensus, despite Cannone’s last-ditch effort Monday morning to break the deadlock using the so-called “dynamite charge.”
“Despite our rigorous efforts, we continue to find ourselves at an impasse. Our perspectives on the evidence are starkly divided,” the jury foreperson wrote in a note to Cannone around 2:30 p.m.

While some jurors believed prosecutors met their burden of proof beyond a reasonable doubt, others felt the evidence fell short, according to the note.
“The deep division is not due to a lack of effort or diligence, but rather a sincere adherence to our individual principles and moral convictions,” the foreperson wrote. “To continue to deliberate would be futile and only serve to force us to compromise these deeply held beliefs.”
Following Cannone’s declaration of a mistrial, O’Keefe’s mother sat with her head hung, quietly wiping away tears. As the courtroom emptied out, Read bounded over to hug her parents and brother.
In a brief statement, the Norfolk County District Attorney’s Office said it intends to retry the case against Read. Cannone set a status hearing for 2 p.m. on July 22 to determine next steps.
“First, we thank the O’Keefe family for their commitment and dedication to this long process,” the DA’s office said. “They maintained sight of the true core of this case - to find justice for John O’Keefe.”
Jurors faced an uphill battle in their quest for consensus, given the controversial evidence at stake in Read’s case and the intense coverage of the trial across social media, national news outlets, and the blogosphere.
The first indication of trouble came in a note Friday, when jurors reported they were unable to reach a unanimous verdict despite an “exhaustive review” and “diligent consideration” of the evidence.
“This jury heard I believe about 29 days or so of testimony, 657 different exhibits marked as evidence, 74 different witnesses who testified before them,” Lally said Monday morning. He noted the length of deliberations thus far didn’t even equate to one hour of discussion for each day of testimony.
“I think this has been an extraordinary jury,” she said. “I’ve never seen a note like this reporting to be at an impasse.”
With a possible life sentence on the line if Read were convicted of second-degree murder, the stakes were high. Read was also charged with manslaughter while operating a motor vehicle under the influence and leaving the scene of a fatal accident. The OUI manslaughter charge carries a sentence of five to 20 years in prison, and Read faced up to 10 years behind bars if found guilty of leaving the scene of a fatal accident.
“Folks, this is what it looks like when you bring false charges against an innocent person,” defense attorney Alan Jackson said, per video from NBC10 Boston. “The commonwealth did their worst. They brought the weight of the state based on spurious charges, based on compromised investigation and investigators, and compromised witnesses. This is what it looks like.”
“And guess what? They failed. They failed miserably, and they’ll continue to fail,” Jackson continued. “No matter how long it takes, no matter how long they keep trying, we will not stop fighting. We have no quit.”
He also addressed the throngs of “Free Karen Read” supporters who have crowded around the courthouse day after day, proclaiming Read’s innocence.
“Your support was invaluable,” Yannetti said. “We are touched and we ask for your continued support.”
Canton resident Rita Lombardi, a prominent figure in the “Free Karen Read” movement, told WCVB the mistrial was not necessarily surprising.
“We expected it. We were hopeful for ‘not guilty,’” Lombardi said, according to WCVB video. “‘Guilty’ was not even an option in this case.”
She added: “It’s not the verdict that we wanted, but we accept it.”

    I would not necessarily say "dramatic" example. Rather, after watching the entire trial (ugg!!), this is another example of police being lazy and corrupt. Did Karen Read do it? With their level of laziness and corruption, I guess we will never know, beyond a reasonable doubt who killed John O'Keefe.

    I can't believe your right but I checked. The government can retry as many times as they please--except for cases of prosecutorial misconduct. There does exist a provision to prevent this, but it requires a judge to invoke and Rule 29 is almost NEVER used.

    They should not be allowed to put her through this again. This trial went on for like a month. How much money did her family have to spend on this? A million Dollars? More? It absolutely was not below 250k. Now they will have to do it again?! When you put on a month long trial (29 days over the course of 2 months), that should be it. The prosecutor should not have the power to bankrupt people. 68 witnesses for the prosecution!!!

    The trial went on for two months. She spent at least $500,000 on this trial, and that is not including expert witnesses. I think she had the cash for it. Moreover, I think she could easily raise the money for a second trial. There were A LOT of folks outside the courthouse "picketing" for her release. Keep in mind that George Allen Kelly raised $500,000 through donations for his defense team.

    Anyone that thinks she's guilty is either a moron, or didn't watch the trial at all, or both. You do not get dog bites all down your arm, and only black eyes, busted nose and a fat lip, without a single bruise anywhere else on your body by getting hit by a car. You guys clearly didn't listen to the moron that tried to explain to us, that the entire impact of the car, hit okeefe on the shoulder at 25mph, but not a direct hit, causing him to spin , and fly in the air 35ft, and land perfectly with his phone tucked nice and neat under his body. You guys saying she hit him with a car, can't have any brain cells whatsoever.

    Same is true for nurses too! My brother has had bad experiences with 2 different ones & the last one tried to have him have her as cosigner on his home without marriage! Our mother stepped in & said not over her ever as she had provided the $15,000 down payment for him to buy the house.

    Rick, I’d recommend watching the last day of testimony on the two scientific accident reconstructionist say no way did her car cause the injuries. They were NOT defense paid witnesses.

    Two FBI witnesses not hired/payed(confirmed during trial) by defense or state who are investigating the police proved it is physically impossible for a car traveling at that speed(based on prosecution theory) to do those injuries to the victim. You can think she did it all you want but I would really recommend actually watching the trial because the prosecution did not meet their burden beyond a reasonable doubt. A retrial is going to have a similar result the original evidence collected is shoddy which is where the idea of frame job came from. Prosecution will have a tough case on the second go around as well.

    Rick you really need to have watched the trial. I think then you may change your mind. The Commonwealth did not prove it beyond a shadow of a doubt that she hit him. The experts hired by the feds said he was not hit by a car. The unfortunate thing is that we will never know what did happen that night because of the botched investigation and rush to convict. I feel sorry for the family.

    For those who believe Read is guilty, why? Granted I've almost only watched cross examinations and coverage from folks like DUI Guy, but this looks very much like a frame job to me. For example: 1) Prosecutors lying about and falsifying video evidence of her car in their custody. They mirrored the image and then claimed "see, the cops didn't go near the broken tail light" which makes no sense since the cops should be approaching that area to investigate. 2) Video evidence of her tail light fully intact hours after it was allegedly shattered on his head. 3) Ms McCabe clearly searching how long it takes someone to die in the cold and deleting searches and calls. 4) McCabe calling his phone numerous, numerous times then lying and saying she didn't. That magically she and 1 other were "butt dialing" his phone repeatedly, only his phone, and magically hanging up every time before leaving a voicemail. 5) McCabes and a handful of others literally having a text group to conspire to get their stories straight. 6) Everyone I saw, mainly the McCabes and an officer, having selective amnesia and demanding to see and read the text messages/logs/evidence before talking about anything. All of that is about half of what I recall seeing. I've never felt the need to get my story straight with anyone when the plan is to tell the truth. Only necessary when lying. Edit: And can't forget, the judge being "aunty" and clearly biased in favor of the prosecution and its witnesses. She should be removed as a judge and banned from ever being one again for not recusing.

    The obvious Dog bites to the victims arm makes me think that there was a fight inside the house and the Dog got involved. And as a 27 year veteran police officer, I learned years ago to NEVER party with other Police Officers. As they're all a bunch of Type A personalities and there's ALWAYS fights. And they get together to keep the fights from Administration finding out, because it's policy to report if an Officer gets into a fight off duty. And I was a K-9 Handler, so I've seen countless Dog bites and I have no doubt that the victim was bitten multiple times by a large Dog.

    Yes, a state accident "reconstructionist" with an associate's degree in criminal justice and a mere 120 hours in training. The expert witnesses who have the proper credentials and experience to provide a trustworthy opinion based on the evidence stated that the state accident "reconstructionist" spun a tail of complete fiction, which could be straight from a Hollywood movie. Unfortunately, that's where folks get their educations from these days.

    You must have missed the video of her taillight being still intact the next morning, the video of her backing into John's car the next morning, the cop who seized her car testifying that it was only cracked with a small piece missing and the FBI accident reconstruction experts testifying that the State's claims were impossible. Maybe you missed the victim's family signifying support for Karen Reed by sitting with her family. The ex cop may have had something to do with the hung jury.. I'm just struggling to understand how you can still claim she's guilty. What questions the Defense couldn't answer? Every claim of the prosecution was proven to be impossible, fabricated and/or ludicrous. It was the pile of defense evidence that the prosecution had no answer for. Its like you've gone to upside down and backwards world for this case.

    Made for TV Movie script. I was in 100% agreement with you on this case. Until , Trooper Paul explained the impact and reconstruction. Thought I was listening to a flat-earther. Just doesn't make sense on fundamental laws of physics. Last 2 witnesses from Defense [ Engineers paid by FBI ] Confirmed my belief. If body was at curb vs 30 feet of flight from a side swipe , then I might think differently, look closer. My thought thinking she is guilty, they FU-ed the crime scene even more than they did with all the other errors. Terrible Police procedure doesn't mean she is innocent. Think She is a nasty girl, was using Higgins to get a better grip on him. Nasty, nagging woman not a crime, but you want to stay away from it. ASIDE: Interesting that FBI had to go to private sector to get review. Watched a show other day where Trump did the same thing with CIA intelligence. This pissed them off and he showed he could get better intell without using Government machine. More to this, but not the place for more detail.

    The prosecution was drowning because the only evidence they put forth, proved Proctor and Higgins were the murderers. Nobody with a brain cell would get up on the stand and give the prosecution something like Karen to focus on. No way. She was 100 percent correct to let Lally drown, and expose all the corrupt cops covering for fat Albert and Higgibs who we all know kicked okeefes ass.

    So would you vote guilty? I agree she probably did it but not beyond all reasonable doubt. I also don't see how a 7,000 pound SUV going 25 MPH hits a guy, hard enough to shatter the taillight but he doesn't have any bruising or significant damage, except to the head.

    The evidence and the physics do not even support that John O'Keefe's death was caused by an accident. If it was an accident, OK. The prosecution had access to experts to try to determine if it was an accident and did not want to seek the truth. The prosecution only wanted a trial for a reason that only God knows.

    I just can't buy the premise that she was solely responsible for what happened. My gut says she hit him, but his wounds just don't seem to match her backing into him. I think there's far more to this story and we'll probably never know what that is.

    ​@@PlagueFleasso real question, what evidence makes you believe she did it? I mean remove the whole cover up stuff. There has to he enough here that tells you that you genuinely think that they presented enough evidence that no other possibility could exist. I watched the trial and the defense definitively proved the tailight fragments were planted. They have multiple pieces of footage that show that. It wasn't damaged to the extent that it was seen to be once it was taken into evidence. Oh, don't forget the testimony of the Police Officer that went with them to tow her car who ALSO said the tailight wasn't broken to that extent. At BEST she might have done it and they decided to "shore up" the case against her with more fragments at the scene. That's basically their case dead right there, and it brings into question any "microscopic" pieces found on his clothes (1/16 of an inch isn't microscopic, BTW). The medical examiners the state provided both testified that while it's possible she could've hit him, it's not likely given the lack of damage to his lower body, or any fractures in his arm. The defenses medical examiner agreed along with the Feds accident reconstructionist. The three medical examiners also agreed that the marks on his arm are likely to be dog bites or scratches. The States theory is both that the tailight exploded into his arm when he was hit and launched 30 feet, and also he got dragged under the car and caught on the undercarriage, oh and also maybe it was the cup he was holding. They have touch DNA on her car from John, some random hair, and glass that they never tried to match to the cup. I honestly understand not believing Police would do stuff like this. It's a big ask to believe a bunch of cops and family got together to kill a guy. I don't think it's a lot to think MAYBE he got killed during a fight. The people involved to cover it up, so when Proctor shows up they tell him "that Reed chick is kind of a bitch and was fighting with him." Dead cop, right? Not a ton of evidence.. What else could have happened to him? So Proctor goes out of his way to "shore up" the case. I don't find it hard to believe that some people looked the other way because they genuinely believe Karen killed John. I don't believe the whole state was involved, but it doesn't NEED to be. It just needs to be a few people that convince the right people that Karen did it, and they take the steps needed to get a (sloppy) conviction on who they thought was a cop killer. That's why all the destroyed phones. People connected to Police changing statements here and there to finger the woman they believed killed one of their own.

    Naw man you're dead ass wrong here. You don't need to spend 30 days watching the trial. Find a recap from a KZread lawyer that JUST covers the days the Defense took the stand. They only needed 3 experts to murder this bs case. The BEST case scenario here is that she actually did it and Proctor went out of his way to make a case in anyway he could against who he thought was a cop killer. Every expert witness in this case, including the states, don't agree with what was presented here. Other than the one Police guy, who no one agrees with, and literally said they told him their theory and to recreate it. The only thing that hurt this case is the idea that it was a grand conspiracy by police and those connected to them. My personal theory is someone there killed him and they convinced Proctor that Karen did it, and he "shored up" the case. The rest just did what they thought was right and changed a statement here or there to convict who they thought killed one of their own.

    Rick, PLEASE watch the trial. When the State rested, the State did not meet the burden of beyond a reasonable doubt. The defense's witnesses proved Karen Read was actually innocent. If you do actually watch the trial, I would really be interested in your point of view on the police corruption that took place 👍

    Most if not all of the defenses witness testimony(experts) came, because the feds gave it to the defense(phone records ect)... They wouldn't normally do that, some are saying they were already in town for some reason, idk....

    Rick you really need to watch the denfense experts. Their opinion is to a scientific certainly okeefe wasnt hit by a car. Two fbi phd experts say this along with three defense phd experts. The only expert phd the prosecutor put up was the medical examiner who refused to list cause of death as homocide based on lack of evidence. The medical examiner also determined that okeefe's injuries are more consistent with a physical altercation than a car striking a pedestrian. So the prosecutor absolutely didn't prove the car hit okeefe. Also rick is wrong about blood being found on the car. One hair of okeefe was found along with dna on the outside of the taillight.

    With the actual shit-show investigation that the cops and detectives completely botched... we will probably never know what actually happened. I agree with you that it is not realistic that 12 people all agreed to some conspiracy and threw John O'Keefe in the front yard BUT after watching most of this trial closely... I also don't believe Karen ran him over. The amount of lying witnesses for the prosecution was insane... and the defenses expert medical examiner and crash reconstruction experts were the smartest people you will find and they all agree that the SUV didn't hit John. There is no damage to his body except his head and arm with no bruising to his arm. HOW is that possible if he got hit by a SUV... that is where I am stuck... Love the channel don't block me Rick lol.

    No. It means she has still NOT been adjudicated "guilty" or "not guilty." If the State does not re-try the case within an amount of time per the jurisdiction, the defense can move for all charged to be dropped with prejudice, which means that she can never be tried for this again. If the State does not re-try the case within its allotted time, the judge should grant the defense's motion.

    I think it was just her and the other cop , that killed the guy, she slept with his friend and played him into helping her off her husband, the plan was to go and start new life with cop that helped her, and iam sure him getting fired was part of the plan too.because they cant be together so soon, in front of everyone they know. If he just up and quit his job, that would be to suspicious. So he got himself fired. Iam sure she will get to collect life insurance, and the 2 of them get to move and start a new life together with a nice chunk of $$$. Even if they retry her, she will win, because they will say she was unstable at the time murder happened she made sure to have verything in place, so she can claim she didnt know or unstable at the time. I guess it might all come down to why the cop got fired, hopefully we get to find out that info. Thanks for your vids rick and i watch your sat live shows too, you the man rick keep doing your thing

    Thanks for analyzing this trial. Did you investigate a case (especially m*rd*r, r*pe) and proved that the accused did it, but jurors voted not guilty? I feel terrible for his niece and nephew and hope they're not living with foster parents.

    I watched every second of this trial and she didn't hit him. The ARCCA experts said 100% the injuries did not line up with being hit by a car. We did just find out the jury voted 12-0 not guilty on counts 1 and 3 . Did you watch the entire trial ?
