An 11-year trial involving the authorship of the music of the song "Esena Mono" in Greece has concluded.
The EPA reports that the Greek Supreme Court has recognized violations of copyright over the music of the song "Bayats" by Eldar Mansurov, an artist of the Republic of Azerbaijan through "Esena Mono."
The composer Eldar Mansurov composed the music of the song "Life" in 1988, and he is the only one with all personal and economic copyright.
The motion-picture industry was thus in its infancy in 1989 and was thus in its infancy in Azerbaijan. In 1990, Brilliant Dadeshova's performance was widely distributed by the company Melodia.
In 2008, Eldar Mansurov reported on the song "Esena Mono," which allegedly belonged to a Greek composer and repeated the music of "Bayats."
Eldar Mansurov filed a lawsuit against Greek composer Dimitris Contopoulos, who was described as a plagiarism and that he violated his copyright, and Sony Music Entertainment Hellas AE, which broadcast the work, and demanded that they immediately stop the illegal distribution of Esena Mono and otherwise illegal use of the Bayatyans.
In response to the claim, Mr. Contopoulos said that the information was not true and that the music of Esena Mono was original and composed by him.
In 2011, after legal preparations, Eldar Mansurov filed a copyright infringement claim against Dimitris Contopoulos and Sony Music Entertainment Hellas AE, who were in charge of defending their rights.
The case for that claim has dragged on for 11 years. During that time, the case was heard in every 3 court cases in Greece. In 2018, the first court upheld Eldar Mansurov's claim that his copyright had been violated and that he had been compensated for the material and moral damage done to him by both defendants.
The answers have filed an appeal with the Athens Court of Appeals, but in 2020 the court of appeal also upheld the decision of the first court of appeal, which recognized Eldar Mansurov's rights violations. Thereafter, Sony Music Entertainment Hellas AE recognized and executed the appeals court's decision, and Dimitris Contopoulos, the defendant, filed a cassation complaint with the Greek Supreme Court. Finally, the Greek Supreme Court has also upheld the decision of the first court of appeal in 2022, which orally declared during a judicial review and submitted it in writing to the parties in 2023, and has completely rejected the complaint of the responsible Contopoulos.
The Greek Supreme Court ruled that "Esena Mono" consists of the reuse of "Life" in adaptation, the composition of the original composition of "Life" as a whole, and the slight modification of the melodic content of "Life"; Esena Mono's music has a similarity to the music of "Bayats" by more than 50 percent.
It has been reported that the Esena Mono has violated Mr. Mansurov's exclusive and unrecognisable personal copyright on the music of "Bayats," as well as the spread of "Esena Mono" without Mr. Mansurov's consent, depriving him of the opportunity to exercise his economic rights to his mental property.
For this reason, the Greek Supreme Court has ruled out mr. Contopoulos from acting as a composer of any other piece of music called "Esena Mono" or any other piece of "Bayats" music, or its modification.
