    Justice Theron is reading what it's written down in the constitution and it gives anyone a right to a fair trial. As a judge or a lawyer in adjudication of case or fighting for the defense you must follow the law as it is written down and in interpretation of the law you must do it within the realm of the law not personal emotions or what you are told to do by a third party who has a vendetta against the accused. Independent analysation of the law must be within the am it of the law not anyone's mind or heart ♥ the best way of the constitutional court when a case was brought before them was to redirect the case to a lower court

    The concourt really tied itself in a knot for having allowed Zuma contempt hearings knowing fully well it was exercising the final instance. Ideally the case would have been referred to lower courts so as to satisfy the appeal principle. Short of undermining their own ruling, IEC should have its way. In any case here was a man who had sworn to preserve and protect the constitution yet deliberately declined to appear before the Zondo commission - a creature of the very same constitution. He now ironically pleads for the same rights!

    The highest court, the con court, repeatedly asked zuma to respond to its contempt ruling. He repeatedly refused. That was his right to appeal and he just played his normal delaying game.

    @Mangamahle8 the jokes on you. The constitution states quite clearly that the cc can LEGALLY withold the right of appeal for its own judgements since it is the highest court. Further context is that jz thinks he is above the law and has been applying his stalingrad tactic to abuse the system for more than a decade. Further he thinks he can dictate who prosecutes him and who tries him. Finally the cc stood up and said enough is enough and sent him to jail for contempt after he refused opportunity to argue why not.

    No the issue is not about Mr Zuma going back home, it is about him being a member on the N. A. In which section 47 of the Electoral Act. If you look at it carefully, should the court agree with Electoral Court on remission, than we are opening the doors for more corruption.

    Zuma is teaching law scholars a thing or two in their own field of expertise through his resilience to challenge these silly courts' judgements which are now making the Ngcukayithobis of this world look like amatures trying to defend the indefensible. The thought they would walk over Zuma throwing "rule of law' and "constitution" terms around yet they are the ones committing acts of crime. One radio presenter Joshua Mlaba once said, "maye kuyabiza ukulaya umuntu". Dig a grave for someone and it turns out to be your own size! And by the way, this very Ngcukayithobi was at some stage consulted for guidance by Zondo during the commission. Mh, chickens coming home to roost!

    Very sharp Advocate Original sentence imposed hy the court is not same as the execution of the sentence effectes by the President. In the eyes of the law, the imposed sentence is 15 months. As such, the Electoral court can not simply say that it's 3 months because the former President served only 3 months

    What people do not realise is that Theron J was criticising the Majority and Advocate for the Khampempe judgement. Remember, she disagreed with the Majority on sentencing Zuma in the ConCourt as it would not allow him the opportunity to appeal his sentence.

    Judge Theron is not captured, Zuma was kidnapped from his home at gun point and sent to jail without any trial no right of appeal, his rights were trampled on very unfair. It's a shame that this man suffered under apartheid rule and his black colleagues are doing the same. This was done on purpose in order to put a criminal record of Zuma so that he can never go to parliament to fight for the liberation of a black child from this puppet regime.

    The reality escapes Ngcukaitobi. Original sentence vs sentence served. Anybody that have a power to change your decision is the final authority to be recognised. Even though judges sentence people but people can override the judges through the fact that people employ the judges through the will of the top political elect. Zuma served all 15 months but the court said no he didn't but he must be sent to jail to continue from 3 months. Fear of uprising and the information of intelligence was clear that the revolution was going to begin at the very moment Zuma returned to Jail. Big businesses that control Cyril adviced Cyril to remit the sentence. The boss of the temporal government remitted sins.

    Zuma included Theron on judges to recuse themselves because they wanted their argument to be simple by saying even those who judged in their favor were asked to recuse themselves it was a strategy to mention Theron on the list of recusal.

    It is unfortunate that when the judge is arguing a legal principle you quickly write that judge Theron is defending Zuma, which I find it very misleading Even if you put X judge Theron was still going to argue her legal principle. I find it very skewered that you strongly support the logic that in a constitutional democracy people can be jailed without a trial, constitutional court is used a court of first instance and people can be found guilty without a constitutional to right to appeal. In South Africa lawyers would argue that there's nothing wrong to undermine the very Constitution as long as you arrest someone you desperately want to jail. Section 47 was enacted on the basis that South Africa is a constitutional right and it would be interpreted in line with our constitution
