Justice Antonin Scalia: "I can't be a consensus builder"

Justice Antonin Scalia was one of the most important conservatives in Supreme Court history. His view of the law sometimes put him outside the mainstream. In 2012, Charlie Rose spoke to Scalia on his PBS program about the justice's judicial approach and legacy.

    It should have nothing to do with Rose’s political beliefs. It’s just bad interviewing. I never was a Scalia fan. But I am very interested in what he was trying to say.

    @@brianreardon7700 why does lately matter? Rose hasn't interviewed anyone lately considering he got very publicly fired for sexual misconduct. But if it helps ease your mind, I've interviewed more people than he has because I was a cop for quite a few years. =^_^= If you have any other stupid questions, do feel free to pose them.

    W the actual F!? What is wrong with this guy? Why is he interrupting EACH AND EVERY word that comes out of the mouth of Scalia? I'm not American. Isn't this guys supposed to be a famous journalist or something? That's the worst kind of interview one can ever conduct, especially interviewing someone such as Scalia.

    It's more or less the same type of badgering of witnesses you hear in Congressional hearings, in which the questioner is nowhere near as interested in hearing what the witness has to say than in what the _questioner_ has to say. IOW, preening for the cameras. I've rarely heard a TV journalist who wasn't in love with the sound of their own voice.

    How many times does the interviewer interrupt the Justice? Charlie Rose was not hired by PBS or by CBS for his journalistic skills. He was hired for his agreement to slant the news in a certain direction.

    Charlie Rose, let him finish, and you've really been exposing yourself as someone who doesn't really know much. I like interviewers to be able to do well on jeopardy in many categories. I know your over the hill, made your money, and half a life of your own, but do a little research. Claiming Hillary lying as a pretty big charge to Marco Rubio; open a newspaper. Don't look upon us west of the Hudson with contempt.

    Justice Scalia was, without a doubt, the last living line of defense for our Constitution and our "rights". He cannot be replaced with anyone of equal caliber, IMHO.

    His legacy is that many jurists coming out of our most prestigious law schools now respect originalism as a judicial philosophy; they're just not as _consistent_ with applying it as Scalia was. What cracks me up is the lead-in to this interview -- "outside the mainstream." Maybe after decades of Warren-inspired evolutionists on the bench it does seem "out of the mainstream;" but originalism WAS the mainstream for practically the entire history of the Supreme Court, until the Warren Court -- or possibly before that, when FDR threatened to pack the court and by doing so managed to extract evolutionist concessions out of SCOTUS for his New Deal programs. That got the ball rolling, but it was the Warren Court which put evolutionism on steroids. All Scalia did really was start to tip the scales back to where judicial review was prior to this sudden lurch toward liberal "living Constitution" devotion. In that way he did a great service by giving average lay people an understanding of what SCOTUS's responsibility truly is -- as justices calling balls and strikes and not as an activist pseudo-legislature.

    Charlie Rose's ego got more and more inflated as years went by. He started to lose it and just make the interviews more and more about his theatrics and about himself rather than about his interviewees. In talking to people of the stature of justice Scalia, he should not have given the impression that he is talking to an equal. He should have been humble and modest and let his subject talk.

    Linda T Yes... I do know that, well federal ones anyway... Politicians are typically elected in our country. But I will concede your point... Too many judges today, will rule based on their own personal policy beliefs or preferences rather than interpret based on the text of the law and its original intent (despite what they believe politically). These judges are like politicians and what's worse, they weren't elected and have a lifetime appointment. That is why Scalia was such a giant... He put the text of the law above his own personal political beliefs. That is why we need more judges like him, and like Alito, and like Thomas.
