The Honorable Michelle Leavitt, Eighth Judicial District Court, Department 12, presiding over oral arguments on appeal. Deputy District Attorney Alexander Chen appeared on behalf of the State. Defense Attorney Christopher Oram appeared on behalf of Mr. DeCastro. Case No. C-24-381730-A. The Court reverses all convictions, orders Mr. DeCastro's immediate release.

He just heard the Judge REVERSE the DECISION, Which MEANS that CHILE should NEVER HAVE BEEN CONVICTED, That it was WRONG that CHILE WAS IMPRISONED in the FIRST PLACE. I can’t wait for the officer’s depositions for DeCastro’s lawsuit. This is going to be a pain in his butt for a few years, unless he gets lucky and the town settles quickly.
The prosecutor looks like he's upset he got stuck with this case and feels like a chump.

The _Willson v. First Judicial_ opinion was published three weeks prior to the commencement of Jose "Chille" Maria DeCastro's trial in the Las Vegas Township Justice Court. It appears that DeCastro's trial attorney failed to move for dismissal of the charge for obstructing a public officer based on Willson's conclusion that NRS 197.190 applies only to physical conduct or fighting words that are specifically intended to hinder, delay, or obstruct a public officer, and the State did not alleged any "physical conduct or fighting words that are specifically intended to hinder, delay, or obstruct..." In other words, the conduct alleged in the charging instrument, even if true, would not constitute an offense. The Justice of the Peace should have known about Willson and brought it to the attention of the State and Defense. The State should have known about Willson as well and moved to dismiss.

@@tyrusdavis1861 How was DeCastro's trail attorney garbage? He missed that the law of obstruction was clarified, by the Court of Appeals of Nevada in _Willson v. First Judicial District,_ just weeks before DeCastro's trial commenced, However, the DA and trial judge missed it as well. So did the self proclaimed autodidactic constitutional scholar. It was unfortunate and embarrassing. However, it probably doesn't rise to the level of garbage lawyering. It is remarkable that since the obstruction statute was enacted in 1911, it had not been interpreted in a published decision by the Nevada appellate courts until _Willson_ dropped on Feb 8, 2024.

The original judge knew exactly what she was doing and that this case had no merit and therefore would be overturned. She didn't care because he had to sit in jail while the appeal worked out. That's the only way she could get jail time for him. She a disgrace!
Oram nailed it. Mr. Mee, or whatever, was pathetic in comparison.

It's entirely possible Mr. Oram might have lost during the original trial. It was a bench trial after all. Different judges have different outlooks and some judges are more open-minded than others. However, I do think Mr. Oram did a great job on the appeal.

@sethhaveron1371 The lawyer Chille has now is excellent. The lawyer he had at his trial was inept. This appellate court ruled that Chille's first attorney was, in fact, inept. Winning an appeal is hard to do. The parameters are much more limited than the original trial, and nepotism on the bench plays a big factor.
Appeals take time so the other judge probably didn’t care if it was appealed, because in the meantime, you’re still in jail unless you are Jussie Smollett.

Seems to me there was another guy who was convicted of 30 something felonies who is still walking around free. Well, maybe minus a functional ear.
I made pro Chilli comments and basically stated what was argued successfully today to free him. Multiple people made negative comments about my ignorance to law and Chilli deserved to be behind bars. Even predicted he would win massive lawsuit with more condescending comments of my ignorance. Not form trolls, but by attorneys and police officers. Anyone big enough to say sorry for their ignorance?

He is unlikeable, however, he was innocent and shouldnt have been in jail for daring to question government agents. The judge was out of line and the cop was mistaken, the original judge and cop... they will be liable in civil court as they should be.... wish it happened to a better poster boy, but it didnt, and maybe its actually ideal that it happen to someone as unlikable as chille because thats what freedom is. Its not freedom if it only applys to people that you like and agree with.

I didn’t realize it at the time: the judge that sent Chile to jail is married to a cop. Now it all makes sense. She has bias towards anyone sticking up for their rights against police.
How many of the antifrauditor community are going to make videos about this result. They made dozens of videos based on that one lawyers opinion that this appeal was doomed. I don’t like chili really. He’s a big old loudmouth crybaby imo and listening to him cry about being in jail has been kind of funny but at the end of the day I agree that a police officer shouldn’t be able to escalate a situation and then make an argument of urgency. If the officer had just ignored him once he ascertained that chili was just filming he wouldn’t have had to illegally arrested him to save face.

Sure he did. In the George Floyd incident, there was no arrest... As if the defense was entering the George Floyd case into evidence as case law. This judge made the right decision, in my opinion. The Castro maybe one of the more annoying auditors that I've seen, but that is not illegal.

Thus, they rightly used the case as an example of people being much closer to a police officer in a more volatile situation than was Chille's. A brilliant citation, if I do say so. The judge was nodding along with that as well.

How soon is Castro going to file his complaint of the constitutional violation to the DOJ so they can prosecute the officer for "Deprivation of Rights Under Color of Law"? Castro already has proof of the violation by the officer so the federal prosecutor would have an easy case and the officer would be convicted of at least a misdemeanor. His qualified immunity would be removed and then the Title 42 u.s.c.1983 lawsuit would also be easy to win.

@@ev8318 Nevada law sets a baseline of $50k per year of unlawful incarceration, so around $25k might be the ground floor. Of course, he has to win the case first, which will cost a pretty penny in lawyers' fees, and Chille may decide it's easier, safer, and more lucrative to keep hustling donations while filing dozens of useless (legally useless, but they make great cheap KZread content) pro se motions.

Honestly, I feel the circumstance and nature of DeCastro imprisonment and treatment for something so clearly a constitutional protected activity shows the deep incompetence and insidious nature of this court. If I did what this court did to a man the shame would be immense for decades. It’s not like a jury did it, but a blatant obvious ignorance of the law. 40 days! Not fucking acceptable!!!!!
I applaud this judge for allowing this to be videotaped for the public to watch.
I loathe De Castro but he didn't break the law and he shouldn't have been found guilty. Not liking someone should have no bearing on their treatment in court. The judge seemed to have forgotten that Justice is supposed to be blind to everything but the evidence.

The story told. A cop stopped a car for petty reasons, then an obnoxious man stood & recorded the cop. The obnoxious man then upest the cops ego, the cop then arrests him. I agree. It's not about the filming, in itself... It's about the gaslighting, the fear mongering, the belittling and harassment that they do WHILE filming. Filming police officers, I understand they are accustomed to dealing with characters of all sorts - but I believe nobody deserves to be harassed when they are performing the duties of their JOB. This was mistake letting him out. From here on it only gets worse. He's not only going to get more abrasive but he's going to say, "well I wasn't told NOT to 3rd party call or livestream from jail - so it must be ok. I wasn't prosecuted for threatening a judge and encouraging strangers to petition her, so it must be lawful". Nothing addressing his conduct whatsoever. This is so disheartening...

There needs to be a huge payout to the civil lawsuit for malicious prosecution. The goal was to punish DeCastro for recording & free speech and intimidate others from recording Law Enforcement. The City needs to financially feel the repercussions and officers lose qualified immunity to stop Law Enforcement from doing this again.

If that person who tried to touch Castro was in that other judge’s room he would have been thrown in jail. Lol. Glad he’s released he drives me nuts at times but that judge had it out and ABUSED her power CLEARLY! Why don’t we have a process to eliminate judges who are out of control and don’t understand the laws?
Happy you got a great lawyer to get your case dismissed and now you can sue the cop that did that to you. This D attorney is much sharper than hot Chili’s previous counsel. AND shows how much of an asset a well prepared attorney is 😮😮 to a case. Even a relatively MINOR charge. My guess is very few others would have received jail time for same charge. Except if the defendant had disrespected the individuals this judge likely works with on a daily basis.

This judge seemed to be much more ready to accept and protect the constitutionality and freedoms we have in this country. Oram was great but at the end of the day i dont think this judge was ever buying the fact that he willfully obstructed. She even asked the state, "So if its not words and its not actions, whats the obstruction?" All they could stand on is mannerisms that might lead an officer to believe the bystander is hostile in nature, and is a very weak argument. Officers regularly continue in their duties while being observed and even heckled and need to be able to do so, its part of the job.

DA said officer allowed defendant to record until he approached the driver. He did not approach, he spoke to her. But he never went within ten to fifteen feet of the car.

The officer didn't ask him to back away from the driver. The main issue was 'officer safety' ie back away from the police officer. They made a big song and dance act about 21 feet being a safe distance FROM THE POLICE. At no stage did anyone alleged the driver was under physical threat from the recording!

@29:20 the DA acknowledged the defendant backed up but the issue was he was 'saying and doing things ' saying is protected speech and doing something like recording is also legally and constitutionally protected so what he said or did can't be construed as criminals unless it was ' fighting words' for example.

The whole 21 foot rule ( seven paces which isn't far and was NOT the tree at the far side of the car park where the officer wanted him to move) is in my opinion just an excuse to make sure the officers words are not being recorded because police know that when people start speaking they can probably have their words used against them

@@bartconnolly6104 Except the officers words were being recorded. The traffic stop was on body cam before DeCastro inserted himself. The officer wasn't doing anything improper, and if he had the body cam would have been recording it. Any speculation as to the officer's intentions are unjustified.

But (important but)conducting a 1st Amendment-protected activity does not mean that everything you do **while** conducting that activity automatically gets the same protection. "I was gathering content for a story about what happens when you threaten to beat up strangers in public" is not a valid defense to the crime of harassment, for example.

44:31 prosecutor literally made defenses point that nobody was arrested why did they waste the time and money over someone as trivial as “Chille”. I hope this somehow helps the greater cause which is police not honoring their oath! The constitution is the cornerstone of our country’s complete existence and freedoms. Id much rather have someone a little less “chille” credited with change but hey this is a pretty good victory for the constitution
