They can temporarily confiscate them if they are being used to disrupt a class, but cannot be held to the end of the school year. Personal property must be given back. The school policy is not above Law.

Once somebody stole my lock and I am afraid to leave my phone in the lockers, so I left it in my computer bag which I carry to every class. I was in science class. My phone was on mute and airplane mode and all alarms were turned off. I went to get something and when I came back, I got in very big trouble. He was holding my phone infront of everyone and opened it. People sitting near me said that they saw the teacher look through my computer bag and found it when I wasn't looking. My phone did not make any sound. He opened my phone and showed it to people in my class (including pics and conversations.) I was really mad. Also he is a creep. At school camp when we had to change in public from wet clothes to dry clothes (because the changing places, bathrooms are full, were not allowed to go to our cabins and we are leaving very soon and the teachers said we wont leave if we dont change) I was putting on my shirt and he kept staring into my soul. I told him to stop but he didn't listen so I walked away and put on my shirt quickly. I honestly hate that teacher.

? A teacher can't go through the phone ever regardless of emergency. Also a search warrant would be executed by a legal official such as a police officer or attorney not a teacher

I was on my phone on the way to my bus and the school Counselor busted Me and told me to put phone away. so I did 1week later Friday I pulled my phone out on the bus they caught me on the camera but it was Friday they said they need my for the whole year. So after the weekend I did not bring my phone when I got back they asked for my phone and I said I didn't bring it🙃

you can still bring it to school if you have it backpack but if they catch you having it in your backpack they cannot search your backpack endless you have a warrant or an emergency situation like a school bomb threat, and if they have a reasonable cause as in if they think you are doing something illegal like selling drugs or have illegal things on your phone. I recommend checking your state laws since each state laws are different sometimes so next time this happens I hope this helps. :)

So earlier this year I had slime out in class while working on my chrome book (I have a hard time focusing and it was only a little bit of slime and I was still focused) and the teacher was walking around and I was holding the price under the table while reads some thing on my chrome book and the teacher walks by and says “ *my name* put the slime away!” Really loudly then turns to the class and says loudly “ guys if you have any slime I will take it!! You don’t wanna be in middle school carrying toys cause they will throw it away (I was in 5th grade) I’ll take it and your parents will have to come and get it!” And the whole class was staring at me cause she was really mad and I got kinda upset. I have bad anxiety so it wasn’t very good.. and also (this story is funny) so I was in class and I was playing with putty (it had a metal container) I had the container in my pocket and we have this like bar table behind the couch with high stools about 3 feet tall and the teacher put a book or something on the board for us to listen to and the class was silent and listening to the story and then the container fell out of my pocket, hit the wooden floor then rolled across the room and I had to get up and get it and it was very loud-

once- til the end of the day but there was like 2 mins left 😂

We had a bag inspection before but 4 of my classmates got caught and their phone was confiscated and parents will get it lucky it was only 1st offense if it’s there 2nd offense they will get it in the next 3 months the phone will be send in the Principals office

In India if this happens, students will get back their phone only when they pass out from the school i.e. after 10 or 12. In our school, they confiscate it for a whole year - forget a mere week. And in my previous school, parents had to come and write a letter on spot, asking for forgiveness on behalf of the child and had to mention it that they will never repeat it again. Only then they will be allowed to get it back.

Well mine never got confiscated because I don't bring mine to school

Technically you don’t have to give your phone if they take out of my hand then that consider stealing and battery so just don’t give them your phone.

They also cant go through your stuff without probable cause or threat of life for eg if you need epipen on inhaler. Probable cause also isnt that the teacher saw you looking inside your bag so it could be your phone it either has to be heard like it went off or she needs to see you hide it back in your bag

Teachers are the students legal guardians during the times which the students are in their care. (Regular school day or Weekend school trip for example) they're legally as responsible as your parents. If mommy and/or daddy can take your phone, so can teacher :)
