IRS Audit Tips and Advice when you receive an IRS Audit Letter

An IRS audit is a serious situation. In this video, we cover what you need to do, what you need to know, and how you need to treat these IRS audits.
We give IRS audit tips for people who are experiencing an IRS mail audit or an in person IRS audit.

This video will help you better understand an IRS audit and give you audit tips so better your chances of walking out with a no-change decision or a favorable decision.

    How to prepare for a tax audit - (1) The day you receive the audit notice - STOP changing clothes - DO NOT shower or bath. (2) Collect all receipts and documents - wad them into neat tight balls of paper - file them neatly in a kitty litter box with the litter in the box. (3) The night before the audit - eat - baked beans, lima beans, broccoli, Brussel sprouts, asparagus, Limberger cheese, sardines, 90% Dark Chocolate, and drink beer. (4) Once you arrive at the IRS office - take a laxative (don't excuse yourself during the audit, just soil yourself during the audit). (5) If you have one - bring your emotional handicap assistant dog and give the dog a laxative. (6) Once inside the office build be as accidentally clumsy as possible and accidentally knock over plants and shelves, etc. (7) Once seated in the auditor's office - relax and stretch your legs and if possible accidentally kick the plug to their computer from the wall receptacle. (8) Be sure and politely use your free speech and ask friendly questions like for example, "Before your mother died from licking food stamps, did she know you had become a tax whore?" That should do it - most likely - you'll never be audited ever again.

    ​@@clearvaluetax9382 My Business is TIMBER Logging on my timbertract, also selling premium lots, on portions of tract, and Gravel Road sales. Investigating IRS interviewer has suspended my recent deductions saying no revenue in last 3-5 years, however, revenue was generated in timber harvest 2007. Timber tree growth does not harvest until fulling mature, but I still have to maintain (expensive equipment) reforestation, maintenance,,,,etc. All expenses are real and well documented. Hard to get past the interviewer 915 letter but fighting as best we can. Love your excellent tax tips and strategies.

    I was audited back in 86 by a G12 in person at their office. They even went after my bank management. They said I owed $113,000! They wound up getting $2,000. They get a commission on the amount they generate in audits. They gave up on me when they figured it was not worth it. I simply put stuff in other peoples name and continued on. I do not believe in the Federal Income Tax. I am one of those people who do not think our founding fathers ever intended for the government to take money from hard working people and give it to those who don't! Plus increase the amount if you work harder and smarter. I do not feel guilty at all if I out smarted them. And by the way all the money I spent I spent at shops, stores, cars. I supported people who work. Not a government who thinks it is a social program.

    I am an independent contractor in Oregon and I am being audited for state income. There are a lot of different reasons in their letter, but the biggest cause for concern is that my payroll company did not file my laborers 1099s and now Oregon state is trying to put those monies on me.     Please if you're looking back can you enlighten me on if we're receiving any information for Audits during the lockdown? I did my taxes on March 11th and have been seeing the same processing information ever since then. Today is 4/25/2020. I claimed the EITC and that's all. What could they possibly ask of me if they do decide to send a letter. Seeing that it has been over a month already, I still am unable to get my stimulus because of this.

    After doing my taxes at the end of the month of January 3 weeks later I get a letter that I'm getting audited and to contact them if it takes longer then 60 days to get answer from them but the letter said not to do nothing until after 60 days but then they closed the audit offices?? I'm still waiting I've been checking my irs app and it's been saying still processing with topic 152 I understand that topic is related to direct deposit? What do yu recommend

    My H&H tax person told me I didn’t have to pay taxes due to my income. I have four types of income: pension, SS for my self and my wife, and VA disability. My pension is about $15,000 and I was paying state taxes until this year when a law was passed. Should I contact H& R to make sure?

    I just went through this for 2018 tax return. Best advice i can give is repsond on time. Photo copy everything you send back to them. And patience is a must. They are very slow. We didn't get our direct deposit once we settled until December 23rd 2019. Almost whole year. Patience patience and even more patience.

    Hi Austin, they would hold it. Please file and please don't miss out on potential refunds, you have 3 years to claim a refund or else you forfeit it forever. 2016's return was due April 2017. So you have until April 2020 to claim a potential refund on there or you lose it.

    Yeah, that's ridiculous. I've seen this before with a client of mine. They want to see that you actually paid your tuition. You'll need to provide them the payment receipts of how you paid (credit card bill or bank statement).

    I have a question. I was audited for 2015 and 2016. I sent an information for both years. They said I won my order for 2016 and they sent me my tax return. 2 weeks later they said I lost my audit for 2015. How can I send in the same exact information and win one year and lose the other?     I recently got a letter from the state of california saying that I have 30 days. I guess they want to verify my identity. I say they want me to send a copy of my ID, my w2, my ssi card plus I did claim my sister as a dependent and they also want her ssi card and her birth certificate.     My accountant is an EA. He offered a small fee as “insurance” in case you get audited, and if you do, he won’t charge anything to represent you and help with the audit. Worth paying $100 for this or is it worthless?

    @@marcphillips3948 Just a guess, but if your audit risk is a couple of percent, then divide that fee by your audit risk percentage to get the estimated fee you would expect that your tax planner would charge you in an audit. For example if you think your audit risk is 2% then divide $100 by 2% and the expected fee for your tax person to represent you would be $5,000. If you think that it would cost you more than $5,000 for your planner to do your audit, then maybe it's a reasonable deal. But if you never get audited in 20 years you have given your tax planner an additional $2,000 for free.

    @@marcphillips3948 Do the math. Let's say there is a 1% chance you get audited and need his help representing you. The upfront fee is $100. If you calculate the expected value of that representation, you take $100 divided by 1% = $10,000. It is an awful deal because if you do get audited then it will probably cost you a lot less than ten grand to get represented. So the "insurance" is not worth it. If you get audited, just hire someone for the going rate.

    What about the method of bookkeeping... IRS publication specifically states that both, a log or ledger can be submitted to prove net income, but also states that there’s no specific requirement. So upon submitting a log of income, (which 2 local CPA’s said they would have used and filed the same way), the agent says they aren’t accepting it. How can they pick and choose what to accept?

    ClearValue Tax Well according to the IRS publications (and 2 local CPA’s) a log of income from items sold throughout the year is sufficient to prove income, however upon submitting that log, the agent states it’s not sufficient to prove income and wants bank statements showing deposits instead, but these were cash sales so there aren’t deposits to show.

    And further, in the audit packet, it states acceptable forms to submit would include a log or ledger, so I don’t understand how they can say it isn’t sufficient if it’s listed as an acceptable method.

    ClearValue Tax Yes, it’s very frustrating- currently experiencing this. Any suggestions on how to approach it? I don’t want to make matters worse but I can’t help but feel like this agent is “out to get me” no matter how much proof I submit. Even third party proof of income (like eBay sales statements and proof of referral commissions direct from back office portals are being picked and prodded and asked for more detailed info)... and to my knowledge there is no law that requires a person to utilize a bank account for record keeping, so super frustrating- I almost want to just say “let’s go to court”.

    @@nofood1 It actually wasn't an audit. Just a revision I think? Still had to pay though. I own my business and missed reporting a 1099 on accident... they caught it and adjusted my taxes owed. So all together I had to pay around $7,300. Lesson learned, don't forget to report something! They will find it eventually.

    I got audit for my taxes of 2021. Prove of my dependents. But weren't with me throughout the year. So didn't have any prove for it. Never got my tax return and owed $700. But I never responded to the mail. I would have liked to do so but haven't. I'm just waiting for this year's taxes so I can show prove of my dependents since I did have them this year beginning January of 2022. I hope it can be solved.

    It was the end of Feb when I received the audit by mail. They had asked for proof of me having my children live with me for more than 6 months. So I sent that all in and a ton other info about my children showing I'm legal guardian. I sent all this in well before the due date and my question is, How long does it take them to review what I sent? It's already march 20th and I haven't heard back yet. It's almost been a full month.     We were audited last year- sent all that stuff back by September 2019 & still here in April 2020 (over a year since we filed) with no resolution- just letters saying they're still working on it.
