सर, अगर Aऔर B के बिच specific performance of contract को लेकर suit चल रहा है, ऐसे मे C ने भी खुद को पार्टी बना लेकर कोर्ट में कहता है कि B ऊसका भाई है और B ने अपने हिस्से के साथ A की भी कुछ जगह बेचने का agreement A से किया है, तो जगह को लेकर B और C के बिच विवाद है तो कया यह सुट intrepleader suit हो जायेगा ?

Order 35 rule 3 sirf itni si baat kehta h ki agar plaintiff k interpleader suit institute krne se phle kisi defendant ne plaintiff k against he suit file kr diya h ki mujhe property do ya sum of money do..as the case may be...to vo court jisme interpleader suit institute hua h vo pahle wli court ko inform kr degi or plaintiff k against jo suit tha usko stay krwa degi...🙏🙏🙏

basim salmani section ke andar rule bataya gaya hai jaise to order ke andar uska procedure hai, dono hi cpc ka part hai, dono hi important hai, book se padhiye.
