International IP Law: Crash Course Intellectual Property #6

This week, Stan Muller teaches you how intellectual property law functions internationally. Like, between countries. Well, guess what. There's kind of no such thing as international law. But we can talk about treaties. There is a bevy of international treaties that regulate how countries deal with each others' IP. The upside is that this cooperation tends to foster international trade. The downside is that these treaties tend to stifle creativity by making it harder to shorten copyright terms. You win some, you lose some.

    "Both national and international systems are struggling to find the right balance of exclusive rights and exclusive access to knowledge..." No they're not. National and international systems are struggling to find the right balance between extending protections to "forever" in order to satisfy the lobbying of rightsholders while making sure their citizens never have a say in the matter. In the US, the "fast track" trade authorization details are kept secret from the public precisely because the public would oppose them - which is the worst justification for secrecy ever contemplated.

    delusionnnnn I think the whole mentality need to change. It should not be about Intellectual property or what rights you are entitled to. It should be about how we can sprees new ideas and culture in the most efficient, and wide ranging way we can. And yes I think we may need a copyright system to do so as to find some way to compensate people for there creative work. But the mentality needs to change. Back to basics. (Note that I think that Trademarks exist for a wholly different reason. Though it is loosely connect. That I feel is more about customer protection. So as a customer you can be sure that what you pay for is really what it claims.)

    Cythil One side-effect of copyright law having released almost no modern content to the public domain in my lifetime is that many (if not most) people - including rightsholders - seem to think that copyright is a moral right instead of a government-granted monopoly. As written in the Copyright Act of 1790, this is a trade-off: the government extends you this monopoly in exchange for the understanding that, after it expires, your works are to be granted to the public domain with unfettered access. By extending the copyright length to "forever", this exchange becomes one-sided, and copyright effectively becomes cultural theft.

    Yeah I think that people need to realise is a state granted monopoly. But I guess if we talk about it in those terms people might not find it as appealing. :P I see it as a necessary evil. And I am one that have supported a lot of projects as well as have a huge legal library of media. As well as creating creative works my self. So I am not one of those crybabies that try to justify there pirating as something noble. But I think it important we know why we have copyright (So we might change it to fit out modern times and have it serve us, not enslave us.)

    Cythil I support a five year copyright without extension. That would have made me a radical in 1790, and it probably makes me a communist in the eyes of most rightsholders today. But most money is made off most IP in the first five years, anyway; if 14 years and a 14 year extension was good enough when information travelled at the speed of sail and horseback, 5 years is probably sufficient when news, culture, information, and fads travel at the speed of light around the world. Even if 5 years is just a starting point, it might be a useful starting point. Maybe there's value in talking about media in different terms. It probably makes sense to talk about five years in terms of film, but maybe something more like ten is reasonable for written works - certainly not author's life plus 70 years. Life + 70 years turns this into a moral rights argument when it shouldn't need to be, and is as absurd as me suggesting I should be entitled to some portion of my father's factory earnings or my grandfather's farm earnings as royalties.

    I still have questions. Does the Domain of a web site decide what country or laws applies? What If an island nation Fakeistan had set up a video sharing site stealing IP in the Terabytes and distributing. Since the nation hasn't signed up to any conventions, treaties or rules can anyone prosecute that nation and/or its residents?

    I really like this, but I would have thought that in this epside you at least mention that we in the EU do have an multinational system. We have "community trademarks" that basically work as if the EU was just one country, and it can also be linked to a national trade mark. Isn't that international enough?

    Reason for deference in opinion on IP between developing nations and developed nation are far more complex fact that most of developing country were subjugated to colonisation and now developed nation are using IP rights to lock developing nation out of development build on their back or many a times these laws are used by companies to extort money from developing nation by lobbying developed nation to pass new international laws. like in case of use of CFC

    The thing is, since the US is such an important trading partner, couldn't America get away with lowering the copyright term limits? I mean, no-one would actually consider levying an embargo against the US as it would torpedo their own economy.

    f the U.S. were to do something like that, it would basically mean the collapse of the international economy. BECAUSE the United States economy, as you said, plays a colossal role in the international market, any infraction such as lowering the term limits would almost certainly get the attention of the world trade organization, perhaps ceasing all exports to America. True, no one would dare risk a single-handed embargo on the United States, but that doesn't mean it won't go unnoticed by the public, and world authority.

    Yes but a slim minority language of the city of Bern. There are slightly more Italian speakers and a significant German majority. The city is officially named in both German and French, so maybe there was a greater Francophone population percentage, when the convention was established?

    CrashCourse Consider a band X writes a song Y. Obviously Y is a copyright of band X and band X is their trademark. What happens when this band no longer uses their name for decades that their trademark expires. How does this affect their copyright on song Y? And can another band adopt the name band X while singing the song Y on a public stage for profits?

    Hey, guys! Got a question here. I'm a Mexican freelance designer, living in Mexico, working through a platform from a U.S.-based company (Upwork) for international clients who may upload their content to, say, KZread. Does this mean my work should comply with Mexican Law (due to the fact that I am a Mexican), U.S. Law (since the final product is being delivered through or on a U.S. company) or the laws of my clients' country, whichever that is?

    Carlos Campos I would say it would depend on the source of the material. You used KZread as an example so since KZread's Genesis started in the United States and its IP protections are enforced within the US legal system. I would say that anything that has Uploaded to KZread would default to US laws.

    The question is how to give the owner a fair price for the use of their property. The problem is poor countries are just that poor. If any item you want to buy has a fair market price above your means, there is no way to gain access to it. The only exception is if those with the information are willing to accept a loss. Regardless of your moral persuasion, it is hard to let go of something you know has value. It is good to note that the more wide spread the information, the less it is worth. So, to give it to them is to lose at the sale and future sales of that property. I gave you this information for free, and that is what it is worth. Was I nice, or should I have made it a property and sold it to you?

    I appreciate this series, but honestly you dumped too much information too fast. It is hard to keep track of everything you said when you jump from one topic to the next in a single breath. I think you could've made more videos or made the current videos longer. The way it is doesn't work properly because there is a LOT of name-dropping and lists of characteristics and conditions that you barely have time to understand before a new concept is introduced.

    I like it this way. These Crash Course videos are better for a quick overview and basic gist of how things work, and to get you excited about the topic matter. If you want to understand in more detail, you now know exactly what to research yourself.

    Dude, you don't explain the key issue. If your author's rights are violated abroad, what do you do? Go to the court of that country or you can settle it from your place?

    Too long; didn't watch edition. If a company wants to cash in on something you made, even if completely original, they'll just claim you stole it from them and they'll get the rights to all of your work free of charge.
