    How do i find out the content of a will , i believe i was in the will but as i live abroard i wasnt contacted . There's one family member in uk but he dos'nt give me any info ? what do i do who do i see .

    Hi. My father disinherited me. My three siblings inherited the estate. My father was emotionally and violently abusive to me as a child. The violence included been whipped, tied up, burned, punched, knocked out with bottle, and beaten many times. I survived and had an estranged relationship with him. Many years later the relationship became amicable and he visited me and I him. I was shocked to discover he then disinherited me and I felt abused all over again. I am not working as I am unwell, with mental health challenges which I link directly to abuse by my father. I claim Universal Credit and Personal Independent Payments for disability. Sorry to go on, but I want to understand if I have a strong claim as I am in late 50s and worried. The will was rushed and witnessed only by a nurse and believe siblings may have influenced late fathers will. I can’t prove that, but dies my father owe under the act. Thank you…

    If , as you say, the Act does not provide for an adult sibling how do you explain Ilott (Respondent) v The Blue Cross and others (Appellants) [2017] UKSC 17. You have referred to this in your video but not explained in what way it is an exception to your rule of the exclusion of an adult sibling.

    Well, it is a nutshell vlog and this adult sibling issue is difficult. (But I am not sure if you mean a brother or sister of a deceased who is left out of a will, or a child.The case you refer to is a child of the deceased. If a brother or sister then, yes, if they are not in a will very unlikely to be able to claim, although in intestacy where there is no will they may get something under the rules.) Generally, it is an uphill struggle and Ilott did not come off as well as she had hoped, in spite of the fact she had a very genuine, morally-strong case. I am planning a vlog on wills on our bi-weekly legal surgeries. Do raise the question again then.

    @@RedwoodLegal Why are you referring to brother and sister ? The case clearly refers to an adult child in the inheritance issue and this is the precedent established in the case . That provision is made , to an adult child of the deceased, who has been excluded in the Will. This contradicts your narrative . The fact that the case reflects money as "maintenance" rather than a legacy does not deplete the case that an adult child is provided for , which somewhat contradicts the nuances that you have invoked.

    Hi, What if you cohabit with someone for 4 years who is married (and has been for 25 years) to someone else and they have two adult children with their spouse, and that person you cohabit with person dies intestate? Would the cohabitee be able to make a claim even though there was no children between them, the cohabitee didn’t pay any household bills or contribute, they have they’re own savings, bank accounts and income, and the property wasn’t in their name, and the cohabitee moved out on their own accord after the persons death. What would the cohabitee be able to claim? Thanks.

    I cannot answer this without knowing more - these cases are complex and should not be done on your own, in my view. The law is not straightforward. I am sorry not to be able to answer your question, but in so many cases it is simply dangerous for me to give general advice to such a specific question. All I can say is that it is possible - the Inheritance Act 1975 does allow claims against an estate and we have had cases before where you had a cohabitation partner at time of death.     Hello, do I have any right to inheritance my father passed away 2019 and my by parents were divorced and he remarried and has spouse and two other children, I live in Canada now my father never did keep contact with me what can I do

    They could be a "child of the family" which means they could make a claim under section 2 of the Inheritance Act 1975 - it is a fact-specific question but if they were treated as such by the parent then they may well have a case for reasonable financial provision after death. In one case even though they never lived with the parent they were still able to make a claim because the parent "treated them" as a child of the family in the various things they did in life.
