FOR DIESEL 10: Don't forget the many counts of 'Speeding' throughout the movie. I doubt it would be rail legal for him to go flying past Gordon and Thomas in the beginning as well as the incident approaching James, and the final chase scene. Granted it probably would've been okay if he were doing an actual job and was following the regulations and speed conditions, but he wasn't. He wasn't there for work and wasn't pulling any cargo or passengers or following the time tables. He could've easily caused a lot more problems off screen by being on the mainline during normal operating hours and likely ended up stalling or severely delaying normal traffic by taking up places on the track. Also trespassing. He wasn't supposed to be on the island at all and didn't come back to work, he came back specifically to kill someone and cause mass genocide. Not only that but his actions to rid the island of steam engines would've also caused mass panic among the people of the island who relied on the engines for their goods and services. If Diesel 10 had succeeded Topham would've had to purchase or get lent several diesel engines all at once in order to get his island back up and running again and it would've disrupted the entire Sodor economy. Diesel 10 would've been solely responsible for the Island of Sodor's own Great Depression as well as the destruction of all steam engines on the island.

Diesel 10 would probably receive multiple charges of harassment. For the ship thing, Sailor John could be charged with grand larceny, trespassing (because he would’ve had to gain access to the ship), unlawful use of a railway vehicle (don’t what charge that would actually be), and false imprisonment (because he didn’t allow Skiff to quit when Skiff was no longer willing to be an accomplice.)

I don't know if skiff's rails are an illegal modification since there is a track just leading into the water so clearly there is some form of registered amphibious railcraft on the island of sodor

Hurricane wasn't always as much as bad as Frankie was when I first watched "Journey Beyond Sodor". He did sacrifice his life when Thomas almost got burned alive twice resulting his wheels being melted. But he does get repaired in the end. Shouldn't Baz and Bernie be charged for their crimes to? They made Sonny work for them, break a remote for a giant fake Baymax, stole Ruth's technology blueprint plans, hijack Kenji which they wrecked Gordon when he tried derailing Kenji, and leave Sonny with no driver as a distraction.

One more thing for sailor John is at one point he and skiff intercept Thomas taking a goods train to demand where the treasure is. Due to skiff being 50/50 for land mobility John would have not only stalked Thomas but probably stole/broke into somewhere that would have Thomas’s schedule to know where he’d be, there was a siding in this so John easily could have put skiff and himself there to wait for Thomas To summarize Stalking again Potential breaking and entering Potential Looking at classified documents (I don’t know the official term sue me )

I was going to charge D10 with Speeding as he goes through the station pretty fast but a Warship 43 only has a max speed of 80mph whereas the national limit for UK railways is 125mph. Granted, it COULD be different on Sodor but, so far, no book on Sudrian Law has been released so, going on what legislation I have, I'll let him off with a caution. In addition, D10 having Pinchy also counts as Possession of an Offensive Weapon. Frankie and Hurricane are a legal headache as there's the question of whether or not the Management of the Mainland Steel Company could also be charged. I mean, two visiting engines and their crews "working" on site and not a single Manager approaches with a request to see a Work Permit? Now, that could be Management too busy or disorganised to properly address the situation or a case of Frankie and Hurricanes' Crews lying and intimidating the NWR Crews to go along with the cover so being unaware of the situation but, still, it does sound sus...

There is one crime you forgot for Sailor John. Under the Explosive Substances Act 1883, It is illegal to possess any explosives in England. Sailor John would get a life sentence for possession of explosive in the UK, because Sodor is located between the Isle of Man and Barrow-in-Furness in Cumbria, UK.

I doubt Sailor John's got permission to be on the railway at all, so for his entire time on railway property, he's trespassing.

(US$1,293.56 under current exchange rates) Also as previously mentioned by another commenter, he violated the Explosive Substances Act of 1883. It makes it illegal to use (or conspire or intend to use) any explosive substance to cause an explosion likely to endanger life or cause serious injury to property, whether or not any explosion actually takes place. A person guilty of an offence under this law is liable to life imprisonment. Under the act, it is also an offence, subject to imprisonment for life, to possess explosives under suspicious circumstances. He can be charged with under on the UK's "Terrorism Acts"; but it would fall flat as there's no evidence.

When you do a part 2 of this, you should charge the following villains; 1. Spencer (Hero of the Rails) 2. Vinnie (The Great Race) 3. Baz and Bernie (A New Arrival/World of Tomorrow) 4. Farona and Frederico (Race for the Sodor Cup) (If you don’t like All Engines Go!, you could leave them out)

I am considering putting Vinnie and Baz and Bernie in part 2, but as for the others: Spencer committed pretty much no crimes in HOTR other than a few counts of Stalking. Him plotting to scrap Hiro doesn’t count as murder since he himself wouldn’t be doing the scrapping, it would be cutters at the Scrapyard. Besides, The Fat Controller clearly was not going to let Hiro be scrapped judging by his reaction to the news of him still being on Sodor. And yeah, I have no interest in checking out All Engines Go, so I wouldn’t want to include Farona and Frederico either.

It’s certainly a tricky case since though Spencer planned to get Hiro scrapped, he himself would not be doing the scrapping, it would be the cutters at the scrapyard. So I’m not sure what crime to charge him with in that scenario. I think it goes beyond conspiracy to an extent but again I’m unsure.

I think Gordon saying that Diesel 10 is back could mean Diesel 10 is escaping custody (or trespassing) since it implies that Diesel 10 was on the island at some point before the movie causing trouble.

While we don't know the true anatomy of the faces of the sentient creatures on Sodor, you clearly see Skiff can hold water in his mouth during that clip, and John is running the risk of letting Skiff consume too much water by sailing in those kinds of waters, resulting in possible suffocation.

Heck if you really want to get into it purposefully destroying steam engines while running could literally cause explosions since the boiler requires high pressure and stuff.

Would it be considered a scrap sentence then a death sentence sense these are steam/ diesel engines

when deizel 10 wrecks that metal rod construction it would not be vandalisim it would pe proprietry destruction as it might have been someone elses. and with the sneezing powder it would be criminal mischief.
