They're scared of having their citizens tried by laws other than their own, by a treaty they aren't party to, and by an entity they don't recognize as having any authority. It's the same in the USA. If the ICC arrested US military or elected officials for crimes against humanity, or anything else, the US military would go and take them back using whatever force is necessary. A limp wristed, ineffectual entity like the ICC really doesn't want to get into a conflict with the Israeli or United States military, so don't count on them ever actually doing anything about it. If this continues Israel will draft its own version of the American Service-Members' Protection Act, promising military action against the ICC if they start arresting Israelis.

Actually, more than half the world's population are citizens of nations that do not recognize the ICC. That means the ICC holds a minority view. International norms cannot be norms if they are held by a minority, and the only way to force a nation to abide by a treaty it didn't sign is through war. The US military outguns the ICC by just a tad, since the ICC has no military of its own.

How would your country respond if the CCP stated they would start arresting your citizens if they violate Communist Chinese laws? It's the same thing. Israel never agreed to be overseen by the ICC. They have no treaties recognizing the ICC. If you want to force a country to follow a treaty it didn't sign, the only way to do so is through war. I don't think the ICC has the balls.

@@Jouantiese IKR, They have no means to physically enforce their ruling, especially against the Israeli military. Israel isn't a party to the Rome Statute and doesn't accept the ICCs jurisdiction. If they start arresting Israeli officials or military it would be an act of war, and they don't have any means to defend themselves. Don't be surprised if Israel comes out with their own version of the American Service-Members' Protection Act.

International rules only apply to nations that have ratified those rules. That's a basic component of international law. The only way to force a nation to follow a treaty it didn't ratify is through war, and the ICC doesn't have a military.

The ICC isn't firm and steadfast. They have no military of their own. They rely on the militaries of their member states. That means no nation will try to arrest a head of state unless they are willing to go to war with that state. No nation will arrest Netanyahu unless they are willing to go to war with Israel. How do you think the USA would respond if the ICC arrested POTUS? Israel will do the exact same thing.

No ONE is, but nations are unless they ratify those laws as treaties. Since the crimes Netanyahu is accused of where part of his duties as the Israeli head of state, no other nation or organization can try him for them, with two exceptions 1. If Israel ratified a treaty allowing it. 2. If Israel is defeated in a war and forced to allow it. WWIII will happen before any of those two things do.

Isreal and US should know we are under laws(ICC).

Israel and the US never signed the Rome Statute and have never recognized the authority of the ICC. You can't force a nation to follow treaties it didn't sign unless you are prepared to go to war to do so. Last I checked, both the USA and Israel had much more powerful militaries than the ICC.
