Question for CR1 Does my husband's sponsor have to also filed an i-864 separately?(he is tax exempt and doesn't work but recieves income. Will he be able to just show proof of income and a letter why he is tax exempt?) What do I do if I forgot to file taxes in 2020. I have an 1099NEC (meets the poverty guidelines). For 2019 I also have a 1099MISC which I didn't file because I didn't know I had one.(the other income I filed for and with the 1099MISC I meet the poverty guidelines) however for 2021 I didn't meet the poverty guidelines when filing. Hello Kseniya! I submitted one i-864 from for each of my parents. Being Self-employed.... my taxes didn't show a lot of money (for some reason they ignored my K1 (profit from business)). So... they said they I don't meet the minimum income ... and I could send and joint sponsor form. My question is how do I do it? I want to use my wife's income as a household member. Should o send one I-864 (and at Part1 mark 1.d and at Part6 ... question 8 should I include myself (initial petitioner as a household member whose income will be used?) and one I-864A for each of the parents? My question is related to Joint sponsor filling the I-864 (Part5 Sponsor's Household Size). My joint sponsor has sponsored her 13 years old child in 2018 and this child is still a dependent to her and has a green card. Now, in (part 5 question 4) it stated such: "If you have dependent children, enter the number here. In Part 5 Question 6, it says "If you have sponsored any other persons on Form I-864 or Form I-864EZ who are now lawful permanent residents, enter the number here." Therefore, I want to know if we must enter 1 for both questions 4 and 6 since my joint sponsor has one dependent child whom she sponsored two years ago by filling form I-864. However, if we enter 1 twice that will add up to 2 which means we double counted this child twice. Please help me out.

My husband is an active duty. From what I understood from your videos, we have to file l-864 for the principal sponsor and l-864A for my husband who’s the one making the income. Hi Kseniya, I’ve been watching your vids on KZread and I just really have one question. During NVC, we received an RFE and were required to get a joint sponsor. We are going to use my husband’s(petitioner) son-in-law as a joint sponsor. Now the son in law lives with 4 kids and his wife (my husband’s daughter). The son in law is the only one working and is pulling in income for the whole household. Since he is married, does the wife still need fill out a i-864a even though she is unemployed and has no income?

That’s alright, the reason why they ask it is because active military petitioners are required to only make 100% of the poverty guidelines instead of 125%. Joint sponsors must make 125% regardless. So it’s ok that they didn’t answer

So I am doing adjustment of status for my husband I brought here with the k-1 visa in October. We married December 4. I’m filling out the paperwork now for the affidavit for his adjustment but I don’t have paystubs for last three-5 months I just started working again after being with him for one year. If my joint sponsor has also filed self employment on his 1040 but makes enough money from w2 income do they have to also put the self employment information on the i864 or can he just use his w2 earned income since it’s enough to be a joint sponsor without the self employment

I got an RFE for my joint sponsor which says "we could not determine that the joint sponsor is qualified" we think because in the most recent tax year of 2021, his IRS Transcripts shows collected $35,000 of "Total Social Security Benefits", none of it were taxable.... but on the "Total Income" line on IRS Form 1040 shows only $5,000. His total annual income was $40,000, which is more than enough to support a household size of 3. Does USCIS not count Social Security Income as qualifiable evidence of 125% of the federal poverty guideline compared to Taxable Employment Income because according to the RFE, only the "Total Income" line is used to determine a qualifying sponsor? My joint sponsor is retired, but makes more than enough income with Social Security Benefits to qualify. So we think the only other way to get approval is showing documentation of the value of his real estate property which is $600,000 and use this as evidence.

Got another stupid question. I have a co sponsor but he doesn’t live with me. He is one of my relatives. (Cousin) He want to co sponsor with me. I understand he has to live with me? File taxes with me? I didn’t think it matters even if we were not related. Up until this past February I was making 80 to $93,000 per year. I had a heart attack and took a couple years off from work to heal. I retired because I am over 65. I do have assets. My social security doesn’t equal the amount I need. I do also have a self employed business of Lawncare but lacked in work there also because I have spent the biggest part of the year with my wife in the Philippines

Spouse of joint sponsor is not required to combine his/her income. However if the joint sponsor income is not sufficient, then it's a good idea to include.

I have the same question too. Joint sponsor has way more income than it need. And joint sponsor’s spouse doesn’t work at all. Does the spouse have to file I 864a?

If my parent is living with me in the same house but his address on tax return and ID is at a different house , he will use form I 864A ?

Do you have a video on how to fill out and file a form DS-260? I filed an I-130 petition for my wife, we both currently live in Vietnam so I have been told we will need to file form ds-260 instead of the I-485.

Yes you are correct you have to fill out DS-260, however I don’t have a video on it yet.

In part 2, how can Mary smith have an American address if she is in Germany? Or I’m only using the principal name in the care of name but for address we type in the sponsor’s?

Don't use your US address. Use the beneficiary's home address in the country where he/she currently resides.

No, you need to write the address exactly as it is now. NVC communicates by email anyway

Hello @Ksenya, does the income from the joint sponsor adds up to income of the petitioner/sponsor? For example; If I, the petitioner, has $30000 of income in our tax and it is shown at I-864, and the joint sponsor has $25000 income, and is shown at their tax document/I-864 as well, does the USCIS adds it up? like $55,000 in total?

Hello, no, the joint sponsor’s income alone should be above the guidelines recommended based on their own household size + immigrant. It does not combine

I assume your husband is a household member so that means he would submit a I-954A as your cosponsor.

What if the joint sponsor is not a member of your household?

So I don't it kind of ridiculous I make well over the approved income level to sponsor my wife but for some reason they keep saying I don't so I'm having my dad be the joint I'm worried they'll keep saying the income level isn't enough and he makes double what I make is this normal

No. You have to file a separate I-864 for the joint sponsor since they don’t live in your household.

Does a sponsor or joint sponsor also have to fill out i864A ?
