Huge Mistakes Leads to Seller Not Moving and an Eviction on this House

I bought this house flip in January from a wholesaler. The house was supposed to be vacant when I bought it but I made a mistake and did not check to make sure before buying it. When I went to check on the house after buying it we found the seller who sold the house to the wholesaler still living in the home.
The way some wholesale deals work is the owner sells to the wholesaler and the same day or very soon after the wholesaler buys it, the wholesaler sells it to another investor who would be me. Technically I bought from the wholesaler and he did not make sure the owner was out either.

The wholesaler said he would get the guy out but never did so we had to go through the eviction process. I plan to send a bill to the wholesaler for my costs and we will see if he pays it or not since it was his responsibility to deliver a vacant house.
In Colorado, it takes 4 to 8 weeks to complete an eviction. We had our attorney start the process and when they posted notices the occupant called the attorney and said he would be out in a few weeks if we gave him more time. He would never respond to me when I tried to contact him.
The attorney strongly suggested we give him more time, and we gave him two weeks but he made absolutely no effort to move. We proceeded with the eviction and this was it. We have one hour to move all of his stuff outside. We are supposed to bring at least ten guys to do it and the sheriff sends a deputy or two to make sure there are no problems and oversee it all.
We thought he was still living in the home still but there was no sign of him. He may have left with just a few things or not been home when we did the eviction. The deputies were really worried that he had killed himself and they would find him in the house somewhere. Luckily that was not the case!
After 24 hours we can get rid of all his stuff. We are allowed to put it in a dumpster our front that way we are not moving it twice. We went back to the house a day later and it did not look like he had taken anything so he might have left with a few things.

    Probably way too late but that round wood stove in the shop is actually worth some big bucks once restored. Last one we had in the shop I worked at sold for close to $3,000!

    Beneath that disgusting grungy layer, I can see a very cute house that has just been waiting for someone like you and your contractors to rescue it. The layout is actually very charming. Can't wait to see it rehabbed. Maybe the guy is in hospital or jail? Weird that he never showed himself.

    In Australia you have to securely and carefully store contents of evicted house for 30 days, at your cost! Ex tenants can pick the items up at any stage, and only have to pay for the storage costs to get their items, not any of the other money owing to you - ie you can't hold items for ransom for other costs owed. If they leave anything, then disposal costs are yours, not theirs!! They are assigned a 'Case Worker' by the department of Justice, who rides your ass to allow them access to get their stuff. Also, all personal paperwork must be securely and carefully held for a minimum of 90 days and if possible returned to ex-tenant at owners cost!! I learnt all of this the hard way.

    It's a cute house, the person must of been there a long time. I do think he left. I notice when you started the video, that the pictures where removed before clean up. Which tells me he took what was most important to him. Family portraits, the people he loved. If elderly, confused person was living there, He just could not understand what was going on. I am hoping that his family came and got him. They have something set up, and he is living comfortably. I hope this house, get the love it needs. It has curb appeal. Intresting buildings in the back. He looks like he was a mechanic at one point, working on those lifters, next to the value cover. You are might be right, he may come home, and find that he can't get in. But I am hoping for the latter, that Love ones have him safe and sound. I can't wait to see up dates on this home, I really like it. I also like to see what Nikki thinks. Maybe Nikki could do a video on how she decides to stage a home. I think it might be fun.

    I could smell that place just by seeing those stained walls and ceilings.Undoubtedly the house has good bones, but I'd hate to clean it up since it was let go for so long.

    Look forward to seeing what you do, it has the potential to be a really nice house. It's a floor furnace, we have one in the house that we're remodeling. Best to just remove and replace them, a lot of insurance companies don't seem to like those things. Although, you can still buy and install them, I'm assuming for much smaller homes. Anyhow, thanks for sharing!

    My mom likes to flip homes and I told her about this experience. She has had some weird things happen, but mostly when she was a landlord. She once got a phone call at work from guys installing her fence that the next door neighbor was outside with his gun, drunk on his riding lawnmower threatening to shoot them and her.... this is in Canada... his gun isn't supposed to be for anything other than hunting... animals... not people. Anyway cops came took his guns .

    A cool house! Love to see it afterwards! My Mom and Dad both smoked! We didn’t know any difference until we moved out and then came back to visit! You could smell that smoke! Ugh !!!

    Cardfan me either... it seems so heartless. We’re currently looking to buy a home, found one we loved, in an area that was amazing, and the price was just right.... but because it was a foreclosure, we just couldn’t morally do it.

    He said at the beginning of the video that he was told that no one was living there. He didn't DO THAT to someone. He is the legal owner and you are making assumptions. I am a realtor and have seen houses left with everything because the owner moved with family, or to a new city and didn't want the hassle of cleaning and packing the house. Yes, there is a possibility that this person might have some issues, but there is a possibility that there arent any.

You never know the story that goes behind a foreclosure, yes sometimes it is because they are broke and couldn't continue paying, but there are many times that that isn't the case. So what is supposed to happen to the houses that are in foreclosure? Just left abandoned forever? Imagine the economy of entire countries if we based our financial decisions on morals.

    Adriana Garza it’s the “what if” part, that doesn’t sit right with me; sorry, that’s just how I feel. I’d rather buy a house from someone who is willingly selling their house. The economy will be just fine, because there are plenty of sleazy, money hungry, morally corrupt people in the world, who don’t care how the house came to be theirs, as long as they got a good deal. It’s my money, I choose to spend it as I please.

    Nice bones with this house but would tear down those outbuildings except for original garage. That furnace is notorious for gas leaks so be careful there. Looking forward to the rehab on this property.

    The former owner was a heavy smoker. Check the walls. Reminds me of my Dad’s apartment. My sisters and I took care of him there as he died from lung cancer. Very good of him to return the money he found in another house to the old owner, by the way.

    I lived in an old house with that single furnace outlet and it was really efficient. The house stayed toasty except for the front bedroom because my son kept the doors closed all the time.

    Those rooms in the basement are cool. After major paint, sheet rock (idk what they use nowadays), flooring, I’d design my dream storage room with tons of shelves. For extra dinnerware, appliances, food stock up, toiletries etc. what a dream. And a hobby room & media room if you like to make SM videos. Plus a clothing storage room. Idk if I’d want my guests down there, was there a bathroom with shower? And as far as a room not having a closet, there are tons of portable closets out there that are better than some regular ones.The one you showed needs to have the wall cut out & install sliding doors the length of the closet to be able to access everything. Oops, I’ve gone on too long. Good luck with the flip.

    Do you buy these houses sight unseen? Do you not go through an escrow process in Colorado where you have a final walk-though before closing escrow? In California, you'd be able to hold up the closing until the owner was completely out.

    It makes no sense why eviction should be done within an hour (give or take) considering that the person carrying out the eviction owns the property / person being evicted lost their ownership rights.

    @@investfourmore But why would you need the deputy to be there all the time during eviction? Surely they just need to secure the property and kick the occupier out if required. It's not like the evicted person can't come back after the deputy is gone and create a scene or cause damage.

    YOUR LUCKY! In CA, we have to hold ALL their stuff for 30 days in a safe, dry place. Bad tenants can come back within 30 days to get their stuff. NOT paid to store it either. OM, nice antique old doors, chairs,etc

    A legal eviction takes months and months, many hearings and court orders. This tenant had ample time to prepare, without paying the rent, he should have had time to get a new place. Y’all calm the hell down.

    That's so sad that this person had a mortgage & couldn't keep up with the payments & as a result had to be evicted. How sad is that? Now the bank will sell it for dirt cheap. Banks should work with people who have mortgages & have fallen on bad times. This video was the saddest by far. I hope the person has help & is doing well.

    Prayers for the person who got evicted. Hope everything works out for them. It's the only reason I don't rent and just do vacation rentals for my properties. I don't have the heart to evict anyone, it would literally mess with my head day and night. I've been through it before I owned everything I do now, so I guess that's what messes with me.

    @@Amariellah Found a job, saved my money and bought a junker. Fixed it, made a few bucks and went from there. I only own my main home in Jersey Shore and 3 vacation rentals in the Poconos. Just bought 140 acres in NM so when I retire.

    You can tell he was a big smoker by all the nasty residue on the walls and especially on the roof in the living room. He probably sat in his favorite chair and puffed away.

    I hate the acoustic tiles on the ceilings, so many houses from that time have them. Do you normally keep them when flipping or drywall?

    My first thought when you entered, and there were two places where pictures had hung, that the inhabitant(s) smoked. My folks both did and in the house when I was young. However, after my mom had to scrub the walls to repaint, they both either smoked outside or went out to the detached garage. My mom quit when she had a hip replacement and had to go cold turkey in the hospital. The old demon nicotine had my dad until he died, even when he was on oxygen, he would go outside or to the garage to smoke.

    My mom was a 40 a day smoker until she got lung cancer, but even then she smoked ecigarettes while on oxygen for two months until she died.

    Wow that's cool for the tenant that they have the opportunity to come and take their stuff from the dumpster. In california, at least where I live in Imperial County, you have 90 days once the eviction process starts and whatever you haven't removed from the property by day 91 and the sheriff removes you, you legally forfeit all of your possessions and the owner has the right to keep anything that was left behind.

    I owned a home that was built in the 1930s that had an oil-burning furnace in the living room (no ducting), the option was to have the furnace in the crawlspace (in this case the basement) with a big vent in the floor above. Only rich people could afford that additional tiny little brown porcelain stove in the basement

    When you use the dumpster, do you place things in them and try not to damage anything since the occupant has 24 hours or do you just throw it in?

    What an incredibly sad situation. This is a property of someone’s worldly goods collected over a lifetime. Some bad luck or poor decisions caused them to have to abandon their home and belongings. No one should feel good about this.

    Some of the furniture,wall hangings and so on could be given to a thrift store or sold. It wasn't all junk. Did you ever see/hear from the former occupant?
