    My girlfriend was brought here when her father applied for an asylum when she was 6 years old, now that her father is already a US citizen she is no longer eligible for status as a child of an asylee, she is in her mid 20's now and worries its too late because she passed the one year bar. Her father didn't help her out when she was a child so she never got any of this done and is worried about deportation. Is she in trouble?

    Your welcome, and thank you for asking the question! You cannot file asylum in the US while living in another country. However, many other countries have similar processes. I hope this helps! If you are a refugee, and have fled your own country to another because of violence and persecution, I recommend looking up UNHCR.org (The United Nations High Commissioner of Refugees). I have represented people going through the UNHCR process. It is NOT fun! But if you are in another country and wish to seek refugee status in that country, you can do it! And if you wish to seek asylum in the US, first come to the US, and then contact our office at 510-574-7377. Good luck! - Otis

    Good afternoon sir, wanted to ask you , I got deported in 2007, migrated legally in 2007 I was 4 years old, my father naturalized when i was 12 years old, and he also divorced my mother. if this case is real then I am an American citizen. A child who has satisfied the statutory conditions of former section 321(a) of the Immigration and Nationality Act, 8 U.S.C. § 1432(a) (1988), before the age of 18 years has acquired United States citizenship, regardless of whether the naturalized. wanted to also know I got married in 1989 and divorced in 2003. To an American Citizen, I am also have 2 children's with my x wife. thank you.

    Hi Md Ar, our office can only help with United States Asylum cases. You would have to search for a Canadian Immigration lawyer. However, in the U.S., to apply for asylum you have to be entering into or or already be in the U.S.

    Unfortunately you may only apply for asylum if you are arriving in or already physically present in the United States. To apply for asylum in the United States, you may ask for asylum at a port-of-entry (airport, seaport, or border crossing).
