    To make sure I understand, even if I’m purchasing my first investment property I should have a Land Trust? The property is purchased under an LLC then I have my llc in a Land Trust. Thank You!

    Great videos! I just discovered you and have been seen all your videos! Do you recommend to open an additional LLC as operating company to run all the others LLC business? If it yes. Who shall owe the operating, the holding LLC or personal and do I need a real estate property manager license?

    Great tips about setting up a land trust. Question - what if the bank demands that you to put the mortgage in your own name? Doesn't the title have to match the mortgage?

    This will depend upon your lender. Lenders typically want to see the property close in the name of the borrower. We recommend discussing your plans with your lender to determine if they will allow the LLC to close on the property as they may require that the LLC be the borrower in this scenario.

    Toby… Fascinating content as usual! I got a question regarding this though. If title is taken in the name of 123 Main trust and such a trust only exists on record in your filing cabinet as generated by computer software, what is to prevent SOMEBODY ELSE from purporting to be 123 Main trust and hijacking your property? I'm guessing it would be all the other verbiage that comes later that would not be a matter of public record? All the trustee verbiage regarding ABC LLC or Toby Mathis who are in fact verifiable entities?

    You have to file the LLC with your state and pay again each year. Cost $150 FL, $1,000 New Jersey

    Great information, thanks! Wondering if there is an elevated risk of title fraud (ie, someone else posing as trustee and selling the property) when property is held in trust, since the trust documents and any updates aren't recorded?

    Hi Toby, you and Clint are Top Notch in Property Protection. One question: IF the owner of the property is FOREIGN (for example, he lives in CHILE) and forms a WY COUPLE LLC with his spouse and one more partner ( JON DOE, JANE DOE and Brian DOE ) in the 50, 49 and 1% ( Default Tax by the IRS as a Partnership) and JON Dies, In this case just remove the deceased partner and Transfer the 50% to JANE in the Operating Agreement and that is ok because the US Government is not aware of the Existence of JOE and this is not subject to making a will in this case, okay?

    Some investors still have c corps, can you do one video on what is easiest way and must do things to maintain c corp? Also can a Wyoming LLC own shares of the c corp? Thanks!

While yes, technically the WY LLC can own shares in a corporation, that will not usually be the best strategy as you want to separate out active and passive income streams and their associated liabilities.

    Very informative. How about a living revocable trust? Like too set up LLC for rentals that are held by the revocable trust. I was advised to set up LLC withe the revocable trust as a member and then transfer the property to the LLC . Does this make sense? I want liability protection and prevent probate. Thanks in advance

    This is exactly what we generally recommend! Each structure, no matter how large or small, should flow down to a living trust so that you can control how your assets are divided among your family, in the event of your incapacitation, and to completely avoid probate. The LLC(s) will provide asset protection, and the living trust will provide peace of mind for the family and avoid probate for all the other assets.

    Fascinating! If you bought the property in the trust with the beneficiary as the LLC for asset protection, which "entity" would you set up your bank, insurance, credit cards, and loans, with? Should you create those in an LLC's or in the Trust's name?

    You should have no problem getting bank card with llc but you need an EIN number from my limited experience.

    Dear Mr. Mathis, I am new subscriber to your YT videos. I wish I had discovered your YT way earlier. I already own a number of properties under 2 different first names with same last name, not a trust or LLC. I realized it is too late to hide my id even after funding the land trust under a Wyoming LLC (9:23) because of local county deed registrations and city tax assessor records. Questions: 1) What's the best remedy to those existing properties? 2) Is it better NOT to put future new purchases under the Land Trust and that LLC holding the transference of existing properties? Your professional opinion is highly appreciated. Thank you.

    I would think the sole owner LLC would own the rental property and then it goes on your 1040 for the Schedule E (rental income/expenses). But I don’t think for your personal home.

    Property was left to me, (death/State of Arizona). What process would I take to transfer the property out of my legal name into a trust remaining the sole owner of that property. I hope I made sense.🤔

    We usually recommend a warranty deed be used to transfer property from your name to your LLC. Anderson does provide this service in most states, so feel free to reach out and we would be happy to assist!

    Just like LLCs, we do recommend that they be used at a 1 to 1 ratio - one land trust for one piece of property.

    @@TobyMathis so one LP Holding company(WY) that owns all of the LLC in the state where each house is located? Then each Trust LLC owns 1 property for the other LLC? Should employee payroll come from the LP Holding company or the LLC? Great content. Glad I found your channel.

    This will ultimately depend on your lender. Many lenders can wary of an LLC that was formed recently and how no track record from a creditworthiness standpoint. We recommend meeting with lenders to discuss your goals and what they would need to see to approve such a loan. Developing a good relationship can be a huge help in real estate investing.

    It can, but depending on your goal with having a non-profit as the beneficiary of your trust there might be better ways to achieve your goal.
