@@zoemarie777Hi Zoe, thanks for supporting on Etsy. It will say on the ticket in the trail by written declaration section the latest date it can be postmarked prior to your court date. Mine was 5 days, but i always do a couple days before to be safe. You will know when they receive it because they will deposit your bail check for the time being.

The real issue is unregulated insurance companies using a traffic violation as a pretext. This could be your very first ticket after 15 years of driving, zero car accidents and the ticket alone could increase your rates by 30%. It's the insurance racket that's the problem. But I do feel for people who got the insurance increase over 5-10mph difference. When my friends ride motorcycles they are hitting triple digit speeds all over town. There's a sense that you could have died but you got a ticket instead. But small tickets that Jack up prices are ridiculous. Especially if you have a new car and your loan requires full coverage and you can't escape the price hike. Most bikers just drop the insurance down to liability if it becomes an issue.

So moral of the story is DO NOT send your Trial of Declaration until 1 Week PRIOR to your court Deadline. That way you ensure that they have very little time to respond to you within 30 days, and then you are therefore Dismissed 😎👍 Congratulations you WIN!!!

No, the moral of the story is to NOT speed. If you don't, you won't have to go through a bunch of @#$# just to make you think you did something. Remember, when you renew your license, you affirm you will obey the traffic laws. Time to bring honor back to this nation instead of finding ways around nonsense and if you're caught just pay like a real man and move on.

I got all of you beat. I took a sawzall and cut down the speed limit sign and took a pic of it with the next days date as proof. Told the judge I have never driven though his town before. I got yelled at. But got out of it 😛

Thank You!! I’m in California (Riverside County) I got stopped for doing 66 in a 45. Did the declaration as you suggested, I submitted my bail 9 days prior to the due/court date. Got a letter 35 days later, the officer never responded. I got a dismissal letter, along with my bail ($377). Good Luck Guys. PS. I was unsure if I should send my traffic school amount as well so I sent two separate checks just in case. The court sent back my traffic school check, and stated that’s only after found guilty, so not necessary.

@@ChanceOfStatic ​ sorry for the late response.. probably too late. I said Due to the lack of evidence, I request the ticketing officer prove I was speeding. Something along the lines of the officer providing proof that his mph laser was properly calibrated before stopping me. And added a personal detail within my stop, that I was approaching a hairpin turn, I was certainly not going the speed the officer claimed I was going. (I did NOT mention what speed I thought I had been driving either, because it’s not my burden, I simply said I wasn’t driving at the clocked speed). Sorry I don’t remember verbatim, but try to be polite when addressing the Court, or say Your Honor in the letter, and be direct. That was it, maybe 4-5 sentences long. I would NOT say I was speeding because I had an emergency or something like that because it’s still admitting guilt.

Lawyers love going to court to fight speeding tickets as it's VERY lucrative for them to do so. They'll represent multiple people and charge each for travel time to and from as well as time spent in court to include waiting as if it's their only client that day. If the lawyer is fighting 13 tickets for 13 people, their pay is based on this calculus: 13 x 1.5 hours travel, 1 hour wait, and 1 hour minimum to fight the ticket. So $300/hour x 13 x 3.5 = $13,650 plus any filing fees they'd certainly add their "markup". Not bad for a short time in court. I saw a lawyer make a ton of cash one time in court as she "moved to dismiss" eight or nine times in a row as the officer(s) who wrote the tickets wasn't in court and all were dismissed. The judge took her first as well so she didn't have to wait too long. All her clients got the good news that she got their tickets dismissed and were blissfully ignorant as a result.

For the traffic school option was a point still added to your license

@BIGDADDYTOUSCH how u do that a cop gave me a ticket for speeding and weaving in/out traffic he also said I was passing on shoulder but I never was on the shoulder as for the other 2 he was unable to say what he clocked me at he even stated that he doesn't have rolling radar in his car but I guess there's some other law to acct for this I'm going to look into it before I decide what to do

@@radzx10daddy24 I don’t remember the technical term, but I asked for the thing that shows you the evidence they are gunna use at trial. Well they didn’t have any evidence or witnesses so I went to trial without an attorney after checking that and the judge dropped it right away. No video or radar for ticket in my case

I’m confused as to the process can you help? I got the ticket in the mail with date 12/16 as court date. Do I now send it in with bail amount and request a trial by written declaration and then wait until they mail the package to me? Thank you for your video! How about if I got a red light violation I got a ticket but they have a video of me! In the video you can see me not making a complete stop for a right turn, but the street was completely empty and I was driving all day (Postmates) it was late at night like in the AM and I was trying to get home. Highway patrol officer forgot to have me sign a mandatory appearance ticket. He got flustered and just threw/have it to me after I asked him if he has ever sped? Question is can I get it thrown out??

I would contact the court immediately and ask about the correct date

So if you send the trial of declaration so close to your court date how do you know they got it and you aren't going to have a warrant out for your arrest while you wait to hear back from them

Hi... I have a question... I lived in Texas with my mom 2 years, N in the summer of 2019 I went from Rio Grande City Texas to Corpus Christi N I was stopped 2 times on my way home N got home with 2 tickets... That's cool. Sidenote....an officer cannot write you a ticket and be a party to the action(testify against you in court). They do it all the time to mess over people tho. No officer testimony, no case and the prosecutor does not have first hand knowledge of what happened so motion the judge to dismiss. Always use question form. Dont make statements. Can the officer write me a ticket and be a party to the action, judge? Does the prosecutor have first hand knowledge?

Right now I have two traffic tickets. I got one on October 3rd, 2021 and my court date is on November 2nd, 2021 for running a red light. I confessed to running the red light but I don’t believe there were any cameras around and I had got t boned while doing so. I have another ticket where I was doing 46 mph on a 30 mph street. I know that I need to get rid of my first one so that I can deal with the second one with ease. How can I tackle the first ticket strategically even though I said I ran the red light when I got into an accident? Can I tell them that I was in shock and misplaced my words? When you do a trial by declaration, in California, you have a deadline to submit your response. The officer similarly is given a deadline. What one week before court date???

@@quirkyquester I asked for a reduction and the officer made a deal with me to drop the second offense. I had two speeding and careless driving, he dropped the careless driving one and then they reduced tho first one to like 300

I just got my court appearance letter several months later. Turns out I do have to appear for the first court hearing. They won’t let me do trial by written declaration (yet?) I’ll update this thread later

Those cameras are illegal it’s a different business and as kind as you don’t open the letter by mail just send it back it gets dismissed.

Does this work for cell phone tickets?

@@ggmejia1623 yes, that’s one of the things I did, I actually got pulled over last year on December, since it was my first ever ticket the process was so confusing tomé so i delayed it without knowing that it would help me I guess, but at the end of the day I believe that the information I wrote on the TBWD were the things that got my ticket dismissed, since the officer made a huge mistake by saying that at the time he pulled me over there was heavy rain, which was completely false.
