Hello! And of course! I already miss the Philippines wholeheartedly. It exceeded my expectations on everything - quality of food, natural beauty, service and hospitality... everything. It truly is a beautiful place with incredibly kind people and a friendly, resourceful culture. I can't wait to go back. It was the best and most memorable trip I've ever taken. I'll do my best to provide some insight, although I don't have the full details of the case. Did he invite you as your boyfriend, or as your friend? I know they can be cautious sometimes about the risk for people that overstay because they have a partner here - it's a strong reason for people to not want to return home. If he did invite you as your boyfriend, and IRCC is aware of your relationship, I would continue this narrative. If you became, boyfriend/girlfriend over this trip, I still believe it's worth being truthful and disclosing the development of your relationship, and providing an explanation from your perspective and also from your boyfriend is a good idea. If they have doubts about "who" your boyfriend is, of course a notarized letter can make that stronger, as his identity is effectively verified. I always believe an explanation from the applicant is warranted. I never submit an application without a letter from the applicant or my representatives letter. It's a great opportunity to really explain the facts of your case, and make a strong argument to the officer. They are people on the other end making that decision, don't forget that. He can continue to be your sponsor/invitee, and yes, I feel it's always a good move to include a letter from the person you are staying with/who is supporting you. This helps them to know your not at risk of going homeless, or working illegally, etc. In the current context, its very expensive to live in Canada. I know that even more after having visited PH! So it will be very important to show IRCC that you are able to support yourself or you are being supported, and you genuinely are looking to extend because you want to spend more time here or for whatever bona fide reason (studying less than 6 months courses, or being a digital nomad, or just being a good partner). Also, that you are staying with him, it's likely you have secured housing (in this crazy market), so it's good to emphasize this. IRCC is concerned if newcomers or visitor visas overstay, or start using the foodbanks, or working for cash under the table. So, just be sure to show that your complying with the conditions, that you have financial and housing support, and nothing conflicts with your original visa application (no misrepresented facts), and you should be successful.

I have a valid visitor visa until 2028, and I also applied for an open work permit for Spousal Sponsorship Applicants, which may take at least another 2 months to be processed according to processing time. I don't want to go out of status, and I'm unsure if I should've applied for a visitor record before applying for the open work permit, and if there are any implications if I apply for the visitor record now. Check out the guidance on “maintained status during processing.” Since you submitted an application before losing your status, you maintain your status until a decision is made on your OWP. You should have it or should get it pretty soon, I had someone take only 45 days to get! Your visitor visa does not confer status by the way, it only enables you entry to Canada.

Thank you for this incredibly insightful video. I have a few quick questions if you want to answer, of course. I'm applying for a visitor record as I married a Canadian citizen in February (QC) but our marriage certificate hasn't been issued yet. My visa expires beginning of May, therefore I am forced to extend my stay beginning of April. I only have a form from when we got married that we filled out on the spot and a screenshot of the online announcement of the marriage on the QC Directeur de l'etat civil website, and I don't know if that would be enough to show that we're legally married. Is it ok to apply for a visitor record beyond the last 30 days of the visa, in hopes of my marriage certificate being released and delivered to me? Also, is it a good idea for me to wait for the certificate, potentially run out of status, apply for restoration, and then apply for a visitor record? We want to apply for an inland spousal sponsorship, but haven't done so yet since we don't have the certificate. Also... I first entered Canada in 2019 for tourism 100%, stayed less than 2 weeks, and returned to my home country, is that the original entry to Canada? ..Or should I put the one where I came here to first visit my then bf, now husband, for a short visit, back in 2022?... I would put the tourism one as that was the first ever time I set foot in Canada. Is that correct? In law you have until the final day your status expires. The website mentions 30 days, but you can apply the day of (before midnight UTC time) so I’d apply for visitor extension prior to expiry, 1 day before, sometime in May. It’s a pain to go out of status and costs more with restoration, so please just apply, and be honest. You are recently married and show proof of whatever you can, including the certificate and that you intend to apply for spousal sponsorship. If you have correspondence from government or registry that you are waiting for issuance of certificate, you could show that too. Once you submit a spousal sponsorship application, you’ll be able to simultaneously submit an open work permit application.

If you are on valid status right now (visitor, worker, student), and you submit your Open Work Permit before expiry of your current status, you will maintain your status while in Canada, so it is not necessary to apply for a visitor record in addition.www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/visitors/implied-status-extending-stay.html

What are the best documents to show means of financial support? I am applying for my mother who is already here, and want to extend her stay. Do I get her bank statements from back home, and add my paystubs, as I will be supporting her during the stay?

Those are all supporting but it's highly variable. Is the currency back home stable? If not you may want to support additionally with your paystubs to show your working, and a letter of support that your mom is living with you can can continue to, and you are able to financially support without her working.

on the form number 7 ( current country or territory of residence) what do you put if your restoring status as a visitor. do you put the date of oyur first entry or the date the applicant went out of status?

Hello, hoping you can help with an issue my fiancee is having applying for her visitor record. Following your same steps through the GCKey and clicking on tab apply to come to Canada the only option under “determine your eligibility and apply online” is the International Experience Canada… there is no option to click anywhere else. You can submit your passport to any VAC in the world once you receive PP request. Just had a Brazilian submit a passport while vacationing in Europe.

I have been OK to use digital signatures that represent a hand draw signature (not typed) as have most of my colleagues. You have to print it to PDF which is next to impossible on Mac, but is easy with windows, Microsoft print to PDF. Then, it’s an image file, that you can use with Adobe for digital signature or similar software. They say on the form to sign it, maybe by hand? But also, many of the application guides accept digital signature, or even no signature now…because they consider the entire signing of the application as the online signature. But it depends on the processing officer and there still seems to be broken consensus on what’s the best thing to do. If you want to eliminate all risk of rejection for lacking signature, print, sign in blue ink, and upload. Unless they specifically say to not sign it…

I was asked to fly back to the Philippines after 5.5 weeks stay as a visitor in Canada and was issued a visitor record even if I have an ETA (which allows me to stay as visitor up to 6 months as there's no date stamp on my passport when I arrived the country ), this was after we crossed the border from the US to Canada for some shopping and entertainment. I'm not sure if this is some kind of racism or the officer was just having a bad day that his judgment was really draconian! Anyway, the following day I've submitted an extension to stay with the IRCC online application but later I realized that the processing timeline may take 10-14 weeks. Could you please let me know what would be my status in Canada while the application is in progress. Thank you.

It's possible to extend a visitor record without visiting a single person or institution in Canada, so I find this required field very concerning. When I come across a field that is required, but doesn't make sense as in your case, I would either 1) Indicate yourself 2) Indicate N/A. In both cases, I would provide a paragraph or two in an LOE regarding IMM 5708 "Persons or Institutions I will visit" and explain you are here on your own, living in sharing accommodation, and extending your stay in Canada for your reasons stated.

Will that be a problem in future, if we dont apply for visitor record and leave the country within 90 days of refusal of the work permit. Do we need to provide any explaination about the refusal if we apply another application. Please let me know. Thanks

On future applications you will have to declare that you remained in Canada without authorization on your background questions. Many people go out of status in Canada, if you leave within 90 days, it shows compliance. It's easy to go out of status with one mistake/timing/incomplete work permit app. I haven't seen them be too hard on applicants who have left within the 90 days, and return later to Canada successfully. You just will need to explain yourself, and if you are out of status, do not get caught studying or working.

Also if biometrics are requested, after we sent the application and pay for extension and biometrics, I assume will receive a letter to do this, because I dont see any letter to make the appoinment, just requested to pay the biometrics fee.

In law you are able to apply for an extension up until the exact day your status expires (prior to midnight UTC time) and until a decision is made on your application, maintain your status aka "implied status"

Hi there again! Thanks for your help. I have submitted my visitor record aplication today and was super detailed about everything. The only thing that I might have messed up was that in an explanatory note (that I had to include to add stuff that didn't fit into the boxes of the forms or add more detail about my work experience), I incorrectly wrote that my husband and I would be applying for spousal sponsorship in the Family Class in Canada (which is totally wrong). In the next sentence, I call it an inland sponsorship application, and that's exactly what it is going to be... Do you think the immigration officer might consider this a stupid mistake as a result of me not knowing the classes properly or might they consider it an attempt at misrepresentation? 🤦🏻‍♀️ Thank you in advance if you can reply to this comment, you've been extremely helpful!

It's tough to advise, and there are some factors that may influence some things. When you came into Canada, what is your current status, and what was your status up to 12 months ago. Do you have the AOR? Has your sponsor been approved? Your visitor visa is what enables you to enter Canada. You can apply to renew that visa from within Canada. However, it's not the same as a visitor record (which allows you to remain in Canada as a visitor). If you submitted an open work permit application from within Canada, and were eligible to do so (AOR received, or work status expiring less than 2 weeks from submission etc), you may be on valid maintained visitor status at this point until a decision is made on the OWP (if you were on valid status at the time of application). I don't have all the facts, and it's tough to make an informed decision. But if you applied Jan 29th, expect a decision sometime around the end of April to Mid May. I would not apply for a visitor record if you've made a complete and bonafide application for an OWP while eligible to do so and just waiting on it to process.

Although it says that in the website, it is not true and the regulations and act supercede it. You can apply before midnight UTC time on the date of status expiry.

Find your member of parliament and push them to get your eCOPR. You shouldn't have to apply for a Visitor Record. They have constituency managers that deal with this stuff all the time. www.ourcommons.ca/members/en/search

Yes you can. You have to prove that you have a purpose to stay, the funds, and maintain a willingness to leave. If you find LMIA or LMIA exempt job offer and apply within the 90 days of having lost your work status (and currently in valid visitor status), you can apply via webform for interim work authorization, so you don’t have to wait 4 months for WP, or you can just go flagpole.

Thank you for explaining. Regarding the Visitor record, I have a question. Can I state the purpose of my stay as waiting in Canada until a decision is made while I am in the Express Entry pool, even though I have not received an Invitation to Apply (ITA)?

Do you see scores dropping to 520 come June ? I know you can’t predict but if you had to have a calculated guess as things are going ? I have 486 now and by June or may I should have 1 year experience giving me my 40 points to get to 526

I do, especially now after 525 as a minimum. It's really hard to achieve 500+ and there are only so many people that can achieve that score in a general draw. I believe it's likely to remain above 500 for the rest of the year, but 526 is a competitive score.

From - To should be the expected length you are requesting your visitor record for. I am unsure what you mean regarding a leave of absence. If you have valid status I don't see an issue in applying for a visitor record prior to your current status expiry.

Although it says on the website must apply 30 days before, legally, and in the legislation, you have up until midnight UTC time on the date of expiry. Most people do this to max their time in status. Be careful it's UTC time! Also, expect a decision in about 67 days right now for visitor record, it's faster than work permit ext from within Canada.

Hi Steven, I am applying for visitor record for my 2 year old son, he is a US citizen and is in Canada now. At POE, there was no stamping or visa on his passport. So can I leave the UCI blank? And the form does not validate without filling in employment details and does nor accept 'not applicable' for the employment date. What should I specify there?

It depends on what the letter says specifically, and you received on entry? I’m unclear as to what it looks like. You can book online to speak with me and I could have a look at the letter, address your reasons for visiting, and understand your reasons for wanting to extend, if possible, depending on the letter.

You can apply for a visitor record extension. If the visitor record extension is refused, and they indicate you are eligible to restore your visitor status, then you will want to do that in 90 days or less. If you are not advised that you can restore status, they will indicate the date you went out of status, or indicate it as that day, and request you leave the country immediately. I advise when they tell you to leave, to leave, unless you have the ability to restore (it's been 90 days or less since you lost status).

@@MsRamdeep of course, they have his entry. They rarely stamp anymore. Just keep in mind, if anyone keeps doing this over and over, leaving Canada for short trips to the USA and then coming back as a visitor, they might start to ask him questions like how are you supporting yourself, what’s your purpose for visiting Canada so long. They want to make sure people are not working illegally nor becoming defacto residents, or failing to maintain a willingness to return to their home country, or could create a burden on the healthcare system if they don’t have valid insurance. It’s not a problem now, and certainly not for this trip, but of course if someone does this for 10 years and becomes a defacto resident of Canada, it’s problematic, and they can deny entry. A visa gives CBSA confidence someone can enter Canada, but it’s never a guarantee, he’s still subject to inspection and questioning etc. It doesn’t give them a right to enter like PR or CC, so as long as the reasons and purpose are honest and genuine, he has nothing to worry about.

I don’t know if there is a limit, I’d search the operations manuals for visitor record extension but I’d imagine it gets more challenging every time. The evidence for extension would likely change but should also maintain congruency with your previous record extension. They will likely be wondering how you are surviving without working in Canada for so long, and might be concerned of your intent to return, with each extension it would get more challenging.

Yes, because a visitor record is not the same thing as a visa. It’s the visa that enables entry to Canada, it’s the record or status that allows one to stay. If she entered a month ago, did they stamp the date she needs to leave by? Otherwise, if there was no stamp, or record issued at the POE, it’s typically okay to stay for 6 months.

So just to clarify, I still need to apply for a visitor record right. And she also now has a new passport so the visa was issued on her old passport.

@@sharebags6082 I have to be cautious on case specific advice, but my understanding is that if your mother was admitted to Canada as a visitor, she has valid status for 6 months from entry (unless otherwise specified through entry stamp, visitor record on entry, or if CBSA told her otherwise). The TRV (VISA IN PASSPORT), does not grant status as a visitor, so it doesn't matter if it is expired. It depends. I have my review services listed on my website. I prefer reviewing small simple applications as this one rather than full representation. Otherwise, I could engage in representation, but representation starts at at least $750, there's alot of administration involved.

What if i applied for visitor record and i have asked for medical check within 30 days and i have fly back tickets after 6 days and i am not getting any appointment for that should i leave country without medical and let the visitors record application expire or should i maintain it on any cost?

I don’t know the full details of your application, so it’s hard to say. It’s possible to get issued the visitor record without the medical, I’ve seen that happen to a client of mine, but she still got medical within 30 days. Why do you have fly back tickets in 6 days if you were applying to extend visitor record would be my first question? You can get medical exam anywhere, but you may want to let it expire or lapse or send webform advising of your departure, if you plan to leave anyways. If you want to stay, obviously cancel the tickets, get a medical etc. Just document and be sure to have a good explanation.

@@sjpimmigration basically i came here on 22 dec 2023 on v1 visa i got for ten years multiple entry. The immigration officer ask me about my stay on airport i tell him i will be here for one month only so he stemped for one month but after few days i decided to stay a little more and i booked reasonable tickets on 7th march thats why i immediately applied for visitors record and application is still in process today i receve email and ircc directed me to go for medical with in 30 days but by date of fly back has come and i dont want to stay any more.. If i don't take medicle and leave the country. Wil it effect my status? Or will it be problematic in future?

Can someone give me a link to apply for visitor record please I cant find it in my IRCC account. Or do I create a new account. I tried in my IRCC account but in visitor visa, there is no extension option, so I continued but cannot get through the where do you currently live for more than 6 mos. I put my address here in Canada and Im only 5mos here.

You may have an application in draft that you need to delete. I've seen applicants have this issue before. You can only do 1 type of application at a time.

It should include the family information form IMM 5713 when you add a family member. Of course, minors cannot sign their name, and the parent signs on behalf of the child.

Hello. I would like to apply for a visitor record for my son. He just arrived in Canada last October 2023 and just turned 5 y.o. this January 2024. Do I need to make a new gckey for his application or can I use my gckey, the one that I used when I applied for my PGWP? If I'm using my gckey for my son's visitor record application, all questions are for him, right?

Good question. If it’s just for him and you’re not concurrently doing an application, in the eligibility it should ask you if you are a minor. I would answer as if I was him. You will have to indicate your name in the signature area, and his data on the forms, as he’s too young to sign. I’m not 100% on the mechanics of it. When representing a minor on a separate application, the minors information goes in the IMM 5476 form, and one of the parents signs it in behalf of the child.

Hi, I am applying for a visitor record after a study permit? How much funds should I show in my account and what acceptable reason should i write in my cover letter? My actual reason is waiting for my school to re-enroll me or to find LMIA.

Funds is unique to each situation, but whatever is enough to support your living, and convince the officer you have either family support through an invitation letter, or funds from them, or a place to live that's not competing with the market, or are living somewhere with a lease agreement in place and need more time to settle your affairs in Canada. I would show enough money to convince them you can remain for 6 months, to wrap things up if needed, and that depends on where you are living. Emphasize you are trying to remain on valid status, and to be compliant, and don't want to go out of status. You can reference the LICO, for what they consider minimum funds for a year of living. They want to be sure you don't have to resort to working illegally etc. It's complex. If you've been waiting on re-enrolment, and have valid reasons, that could be mentioned, as that would be another valid reason to wait around and not have to leave in a hurry. Unless you have an employer already committed to wanting to do an LMIA, it's not a good purpose in my opinion to extend a visitor record on the basis of looking for employment. They shouldn't be too tough especially if it's your first conversion to visitor, and you can show that you can support yourself for the time requested. I'd say for a single applicant, it does depend on where you live, but under 10k it's getting risky, cause officer is calculating return flight, cost of living etc. Of course, it doesn't have to be 10k, if you are living with family, and have family support.
