Amazing?! In this morning`s teaser clip Nancy instructed him she wanted a softer approach. This guy here is a mediator who reports to the court, his influence stops if the parties are not able to come to an agreement themselves - which it is his job to help them reach. Should that objective fail, or he form himself the impression the parenting suitability of either - or both - of the parents to be questionable, he is duty bound to let the case continue to a full court hearing - with the additional costs that inflicts on the parties, time and resources it demands of the court and insecurity and waiting about the future it represents to Charlie and Oscar. James went against the instruction he got from his client here. Had it been a criminal case, he could have gotten away with it, cause criminal law he knows better than the client, and therefore going against instruction could be necessary to represent the client`s best interest. But in this type of case, to behave brutish and attempting to provoke the other party during mediation is so unbelievably unprofessional, it beggars belief! It was in front of a mediator! He cant grant custody to either party! His job is to get them to come to some form of agreement, so the kids will have a safe, supportive and stabile family situation. Because of James provocation and smeer tactics, this - had it been real life - would most likely not even been attempted mediated - but instead passed on to the court. All James has achieved is to delay the process, make it more costly for both Nancy and Darren. Not to mention invasive, especially for Charlie who looks old enough to have a say about which parent he would prefer to stay with. And since the court is unlikely to separate the two boys, Charlie will not only be responsible choosing for himself, but also Oscar. Had James behaved more civil, and let the mediator do his job, there is a good chance the mediator would have succeeded in getting them to agree. This because both Darren and Nancy have other things to waste their money and time on, than a legal battle. And because they generally are very much in agreement when it comes to raising the boys, the fact they live in the same area - so shared custody would be the most natural option - and Nancy`s main support is Darren`s father. All of it points to shared custody being in Charlie and Oscar`s best interest, and their best interest is the court`s main concern. They are not there to give brownie points or slap the fingers of the one of the parties who has been the best or worse spouse. The court`s sole interest is to protect the best interests of the children. So for James to screw it all up like this, just beggars belief. Not the least because his client, Nancy, has MS, and should her condition deteriorate before the court hearing, the judge might feel Darren to be the only candidate to grant custody to.

You are so wrong. James did a horrible job here! This was a MEDIATION - not a court hearing. The mediator`s job is to attempt to get the parties to agree, so the case will not have to be brought to court. The latter option is both more costly on Nancy and Darren, takes longer time, is more invasive on the kids and also take up more of the court`s resources and time. But by provoking Darren with his smeer tactics James may have left the mediator with no other choice but leave it to the court. Since he is duty bound to act in the kids` best interest. And with James suggesting Darren to be unfit and possibly even to represent a threat to either Nancy or the kids, the mediator cannot be sure if Darren would abide by the agreement, or would use violence or threats against either Nancy or the kids to get his own way. Consequently he would have sent the case to court. So by not following Nancy`s instructions of a soft approach, but instead attacking Darren full force, James has worsened Nancy`s case both cost wise, and in regard to uncertainty about the outcome. Cause Nancy having MS, should her condition deteriorate seriously before the court hearing, the judge might not think it an option granting her even shared custody - she could come to lose all influence over the kids and their future. And be dependent of either Darren or Mandy being present when she saw the kids, so they wouldn`t be alone if she should suffer and attack.

Darren is the one who wanted this battle so now he has it

i know this comment was from 6 months ago but i don't think brooke is technically adopted but is being fostered. darren really didn't have her for that long to fight for her and never wanted her in the first place but they do have a good relationship right now.

Not to mention the fact that Charlie has no blood relation to Darren where as he biologically is Nancy's nephew it makes absolutely no sense for Darren till want or expect full custody of Charlie

Georgia Robey Nancy asked for a divorce. Darren did his lame Pride and Prejudice act and Nancy still told him she didn’t want him. I would consider that the dumping. Darren didn’t choose between the two because Nancy took herself out of the equation. Darren’s only choice was Mandy and he was backed into a corner because he has to try to prove to everyone that he didn’t destroy his family for a fling

I keep forgetting that Oscar is not Darren's only biological child. Darren has twins with his ex-wife Hannah Ashworth's mother Suzanne. And technically Darren cannot get sole custody of Charlie as he is not Darren's biological child. Charlie is actually Nancy's nephew. When Nancy's sister Becca died, Nancy was given custody of Charlie. I forget what happened to his father though.

Um maybe things are different in the U.K. but as far as I understand it Darren has no legal custody of Charlie so how can he sue for sole custody? Oscar I understand that's his biological son but Charlie legally isn't anything to Darren. Nancy is Charlie's biological Aunt but has raised him since he was little so no problem. But Darren has only ever been Charlie's uncle through his marriage of Nancy. Yes I know this is a soap opera and I shouldn't take it too seriously but can someone explain this to me?

Unless Darren adopted Charlie, then he has no rights to him whats so ever. He certainly has no right to demand sole custody of him. Now, if he did, that is an entirely different story -I'll admit, I drifted away from Hollyoaks for sometime. As for James, all he did was state facts so honestly, I've no problem with him here. He didn't lie, didn't exaggerate the truth and, really, Darren should focus on getting some sort of contact with his twins before he starts demanding sole custody of the boys. Though now that all of Darrens dirt has been dragged to the surface, its only fair Nancy's dirt is too. She's no saint and shouldn't be painted like one. At this point, I still maintain Jack should be given custody before either of these too. But I am glad to see some of Nancy's anger at Darren breaking away and see her focus on the boys.
