Jo, loved hearing your thoughts on this. As someone who has shopped across H stores around the world I will say the UK and most European systems are much more equitable than in other countries because they grant you the opportunity to add yourself to the list (or win the lottery if you’re in Paris) and get a bag without spending. Alternatively you can show loyalty to the brand through your years of loyalty (time) or relationship with an SA rather than just by the shear dollar amount you spend. I completely agree it’s sad to see people say horrible things about a brand I, too, love. However, I also understand some of their bitterness as I’ve spent a lottt of money in one of the stores abroad (not in UK or Europe) and not received a quota bag offer even after 2 years and lots of money spent. Will be interesting to see how this unfolds.

If the Plaintiffs can convince a judge to agree Hermes is violating antitrust law, specifically the Sherman Act, the Plaintiff's may very well have success with this suit. There does not have to be a written down policy. This is a civil case. In the US, all they have to prove is something is more likely then not. Preponderance of the evidence. Meaning the greater weight of the evidence. It refers to the quality and persuasiveness of the evidence, not to the number of witnesses or documents. Personally, I think they should just go back to the wait list.

I think it may have a lot to do with the SA as to whether they mention a pre-spend. It will be interesting to see how this turns out.

Yes definitely. Also interesting to know what people would prefer. If it is decided by management that Pre spend is required, would they rather their SA tell them or not?

The level of entitlement in the US is ridiculous and it’s spread to the UK to some extent. No one is ‘entitled’ to anything and if you are silly enough to enter into this ‘game’ with Hermes, knowing how precarious and unpredictable it is; then more fool you. The lawsuit will fail, Hermes have no compulsion to sell anything to anyone. The very reason people want these bags is because of the difficulty getting them- there are other brands that make equally beautiful bags in wonderful leathers that get overlooked, because they don’t have the Hermes name. Proving that it’s the name and difficulty acquiring that is causing the desire to own. Hermes are never going to mass-produce, so there will never be as many as those desiring to own one.

Americans can be the absolute worst for commiting to a child's kneejerk reaction and shutting out any additional information that invalidates it: I want to fly and therefore shut out any understanding of aerodynamics or acknowledge my lack of wings. There are 10 - 30 customers ready to pay for any bag, so eliminating the game, should we raise the prices so the most pedestrian epsom bag is 200k, or do we have a Hunger Games outside the store?

I’m in the US and don’t own anything from Hermes (out of my budget). Based on other videos I’ve heard that online purchases and purchases out of your country don’t show up on your purchase history. If there is pre spend games going on then all purchases should count towards your history. Just a comment.

I’m glad that I don’t like Hermes handbags enough to want one. But it is a shame for the sales associate to milk tens of thousands out of customers who wish to show their loyalty and not give them the handbag. That’s crazy

I wish I didn’t! It is definitely hard for those that spend so much in the hope of a bag not to get one. I’m lucky in that I don’t have such requirements in the uk and genuinely buy non bag items because I like them not because of any perceived game.
