Capitalism = only profits matter…. Businesses as an entity by default does not care for individuals unless it will hurt their reputation and hence hurt profits. Like you said, the case just makes public even more aware of brand - make people even more curious about Hermes handbags. Hermes will only care if it starts to affect the brand negatively with their devoted customers - those who walk in and buy out all different colours and patterns available for an item they like in one go…and this group is probably not going to think negatively of the brand at all…they will only care if the quality decline or if the things they wear are seen everywhere on the streets and recognisably the same products

Thankyou for your excellent reply. In the 60 India was suffering very badly from malnutrition and needed a strong strategy to overcome this problem and keep going in front of a large population ? They invited a injection for their vast herds of cattle and bulls ? The injection did what they were supposed to do witch was make the cattle extremely fat and lean . Unfortunately for them the vultures who were sharing their land with them started to eat the carcasse of the dead cows and cattle ? After this the vultures started dying rapidly. The Parsi community were shaking in their boots because they needed the vultures to get them to their afterlife. Basically the food chain was effected so badly that the Muslims who were , the only people touching hides saw the deterioration first hand. The Muslim started to make the government change its mind about the injections. Moral of the story is big brands that relay on good leather, can bring your house tumbling down. I wasn’t speaking literally on the content of the cases. I was only making reference to the fact that an individual went up against a big corporation and won when it seemed impossible. Nothing more than that 😊

Jerusha, the vital point here is that Hermes is selling in an unlawful way. I am hopeful that this is the start of a change to make things fair for everyone so that anybody can walk in and buy what they love, no strings attached.

Whether or not they are selling in an unlawful way is for the court to decide, and if Hermes loses, they will surely appeal. Anti-trust laws are there to protect consumers by increasing competition. Tying laws are not necessarily anti-prespend. There is no law that specifically dictates that a business must sell an item on demand if that item is in limited supply, nor is there a law that dictates how a business must decide who gets high demand items in limited supply.

I don’t trust any brand that cuts up and burns any product they can’t sell before they will consider selling the product at a price people will pay.

Everyone fails to understand that is not about the Birkin …it’s about the Sherman Act. And that “Birkin” is being used as a generic term for all quota bags, as described in the lawsuit. Anyone who either did or didn’t get a bag can join the class action because it’s about linked selling. But who cares…it changes nothing! 😊😊😊 peace🥰

Its intent was to stop businesses from choking free trade by linking sales. An example would be Company A controls a high percentage of the hog market, but its beef is more expensive than competitors. It therefore tries to increase its beef share of the market by linking the sale of its hog to beef sales. This would cause its competitor to sell less beef and also lead to higher prices for the consumers.

@@NA._you aren’t treated like a queen in the case of specific bags. It isn’t because they don’t have stock, it is because they would prefer to sell it to someone else. Hermes could skirt legal issues by just giving high profile bags away to people once they accumulated enough points, which can continently be earned by spending. Make it a reward item. I also don’t buy the idea that these bags are any harder to produce than other production bags. It is false scarcity to drive up prices- do that if you want, but don’t ever expect my business.

You underestimate USA. Let’s see. 😇 We still care about clear business in our country. If it will not be changed this time, it will be changed later.

Anyone should be able to walk in and purchase what they like and not be discriminated against because they aren’t “wealthy”. If it’s an inventory issue then why isn’t a customer able to order the bag and wait for it to be ready. I’m only surprised it took so long for them to get sued.

You can do that in Europe. There is a wishlist there.I've gotten a bag from purchasing minimal, but just had to wait several months. I feel many people aren't genuine customers and know the profit margins on these bags are high so they want to purchase and resell, and I get where Hermes is being protective of its product. I think the European system is much better. If you really want one, you will have to wait.

And Birkins are heavy and have to be hand carried or on crook of arm. Just the thought makes my arms scream NOOO. Plus why covet a bag that's such a pain to open and close so you end up leaving it open. I know some people truly love them, but most are just trying to purchase status.

Hey Babe, I agree...retailers in general don't care much about their customer, however, they choose to operate within the USA, and as such it is long past time that they be called on the carpet on their practices. It is NOT okay for SA's to basically come up with whatever they choose to say is the amount that has to be spent to be "offered" a quota bag. I agree with you on most things but this one I have to disagree. You ran your own retail company, as such you paid taxes I am sure to the Australian gov't, you would have signed loads of contracts stating that you would operate under whatever the AUS Gov't says one must do to run a business in that Country. These rules are in place for a reason, without them we are basically a lawless society, businesses can operate in ways that are extremely detrimental to our society. Hermes knows the game they are playing and they have been allowed to play it, world wide, for a very long time. Why is that? Well the brief answer ism wealth and political pull. These huge conglomerates spend millions a year hiring lobbyist who then do their "bidding". they donate to political groups etc, this is nothing knew and for sure this is done by all the bigger companies from Wal-Mart to LVMH. When we turn the eye away from corporations that are blatantly breaking multiple laws in the USA and I suspect in most countries, this is a slippery slope, then other companies say, well then perhaps we do not really have to operate within the confines of the law, either. How does this effect us? Well it effect all of us in many ways. When a company feels they can operate outside of the rules and regulations within a country that are set out to protect employees and consumers, these are the very people who will indeed be hurt when a company begins to skirt those regulations. I suspect that the plaintiffs likely secretly video taped being told what they had to spend to get offered a quota bag which is legal in California, and would definitely be admissible in a court case. Of course Hermes is going to deny that this is indeed their "practice" but what the long term effects of this are...Sales associates are going to see from this law suit that their company...Hermes will hang them out to try in a heartbeat if they are caught even hinting that someone must spend a certain amount before being offered a quota bag. We all know that this is common practice, all over the world, not just in the USA. So, employees are going to think twice about being at the pointy end of the stick, so to speak, for a company that is most assuredly telling their employees this is how things work, but when they get caught, and now that this has happened I can tell you every single Hermes employee is going to be extremely nervous now suggesting how much has to be spent prior to being offered a quota bag, and if they refuse to stop spreading this message...then effectively, the entire practice comes to a halt. So, IMO, there is high potential for this court case to finally force Hermes to adopt a much better, clearer way in which they wish to sell their quota bags. They can still pick and choose whom they want to offer a bag too...that in itself is not breaking the law, its making the promise that "if you spend $50k you will get a Birkin" then not honoring this, that breaks multiple laws in the USA and most Countries. This is the Anti trust law, and they are most assuredly breaking it. Its a really bad practice and in 2024 I am sure they can come up with a better, law abiding way to keep their quota bags still highly restricted and yet, still operate within the laws which they signed up to follow.

What is your opinion on their other bags, and who they sell to? I was in Hermes last week in Las Vegas, and after vocalizing his opinion that we must be just looking, told us they had NO bags in stock. None. Wouldn’t even let me try a display bag. The bags were behind glass. Is it possible for an Hermes store to have no stock? 🤷🏼‍♀️

I live and shop in Vegas and I have been a customer for quite sometime. I have bags and they say they don’t have bags which is usually true. They need to keep about 4 neutrals in back for vipp clients in case they come in and drop $$$$. You are not allowed to take displays out of case. I ask all the time. The displays are rotated to other boutiques so not for sale. Hope that helps.

Again I agree on the transparency thing however I don't think they're ever going to suggest or be clear in their actions because they don't have to verbally say that they are pushing other products before they can get your bag. I spoke about this with another KZreadr and we were saying that the common practice at the moment is suggesting a Wishlist strategy. Where it used to be a waitlist strategy.

Hi Jerusha, great video, right on point they don't give a crap about us. I do however wish that Hermes would go back to the older days where you got on a waitlist that could be 2 or 3 years. I can't understand why the associates don't get commission on the Birkin or Kelly handbags, that just seems wrong. I won't spend my money on things that I do not want, that is just nonsense. I will move on to another designer and if I really want that Birkin or Kelly so bad, I will just neeed to save more money to buy it on the pre loved market. Those are the rules and nothing we can say or do about it currently. I do find this lawsuit interesting and maybe it won't go anywhere, but I give these women credit for publically outing the gross horrible sales tatics used to purchasing a much sought after handbag. Maybe things will change, only time will tell. Anyway, I do love your videos and hope you have a great day .

Absolutely babe I was just talking the other day the waitlist system is really really good obviously you are far more content that you would end up with your main goal if that is just to get one of these handbags still very similar to a leather appointment in Paris. The only thing I would say about that is think about the massive increase in the last 2 to 3 years over there now common knowledge of this handbag, the general public as opposed to the fashion enthusiasts now know what these handbags are and what they stand for.

The only real difference especially for me someone with a voice to the public opinion especially inside a bracket of luxury houses, is just to realise that at bottom line still matters so much so therefore they have to continuously portray a form of unrealistic views and realistic achievements to make the want even stronger.

The thing is no matter which way any of these things go majority will always win. These type of customs have applied for centuries and what the differences is that we now have a platform to talk about it with the Internet and share.

I was wondering what the end result of this lawsuit would be! What is their goal? As you said they are not going to be offered a bag and it just draws attention to these people essentially throwing a temper tantrum because they didn’t get what they wanted.

Great video Jerusha! It’s so true that this lawsuit probably won’t end the way they want it to. I think Hermes gets away since it’s not actually link selling that they do- if only it were that obvious!! I think there is enough obfuscation, mystery, and inconsistency in the process- it would be impossible to prove the organization guilty of any lawbreaking.

True they could also get an inconvenience settlement where they actually get a return fine for wasting time and legal aid. They will most probably be permanently banned from the house but it will be interesting to see how it plays out if we even see.

I am not even in the game of Hermes and never will be but my thing is everybody that follows luxury social media has talked about Hermes for years so why now is it such an issue…. It’s not going to change anything, people will still buy the brand even more so now- same with Chanel, price increases galore and yet they still have lines of people to buy… consumers drive this madeness and expect things to change. Just don’t support the brand
