Grand Final - 2019 UNSW Private Law Moot

The UNSW Private Law Moot, sponsored by Allen & Overy, is a prestigious intervarsity mooting competition, bringing together some of the best mooters from Australia and around the world to compete at the University of New South Wales in Sydney.
The 2019 problem question was authored by Professor Simone Degeling, of UNSW Law, and was on the topic of equity and trusts. The winner of the 2019 competition was the University of Technology, Sydney.

    Ah that was an uphill argument for the Appellant. They had to argue that, even in the modern day, de facto couples are different from legally married couples (which is no longer recognised in most areas including in the Family Court), and further that same-sex relationships should be treated differently from heterosexual relationship (which is not, or rather no longer, morally sustainable).

    I disagree. So if I put a deposit and 3 months later we sell. Do you get half my deposit? Who would agree to that? Might as well just hand over the cash.
