Garbage Matters - A Documentary on Solid Waste Management Issues in Delhi
This new documentary by Vidhi highlights the mounting problem of disposal of municipal waste in Delhi, the implementation of Solid Waste Management Rules 2016, and various judicial interventions.
The Supreme Court of India and the National Green Tribunal have intervened on several occasions to address the issue of mismanagement of Solid Waste in Delhi. The issue of Solid Waste Management (“SWM”) in Delhi was taken up by the Supreme Court in BL Wadehra v. Union of India (AIR 1996 SC 2969) and Almitra Patel v. Union of India {(1998) 2 SCC 416 B} which have had a profound, and long-standing implications on policies and laws related to the management of waste in the city of New Delhi.
In 1998, in Almitra Patel case, the Asim Burman Committee was formed, which eventually culminated in the formulation of the Municipal Solid Waste (Management and Handling) Rules 2000 (“MSW Rules”). Under the MSW Rules, the municipal bodies were given the responsibility of collection, storage, segregation, transportation, processing and disposal of municipal solid wastes. They also introduced the possibility of engagement of private agencies for the above purposes in the waste-value chain.
In September, 2014, Almitra Patel v. Union of India (O.A. No. 199 of 2014) was transferred to the National Green Tribunal (“NGT”). In 2016, Solid Waste Management Rules 2016 (“SWM Rules”) were introduced by the Ministry of Environment, Forest and Climate Change which replaced the MSW Rules, 2000. These new rules were able to incorporate various new concepts that were overlooked in the previous rules. The NGT via its order in dated 22nd December 2016, issued extensive directions with respect to the implementation of these rules.
In this 20-minute-long documentary film, we have sought to explore the extent to which the rules have been implemented in pursuance of the courts’ orders and the systemic issues that lay at the heart of non-implementation of court orders. Through the documentary, we explore the manner in which, and the extent to which courts can be effective in enforcing the rule of law through monitoring of stakeholders in courts.

This is very serious issue govt has to deal with... But govt. Is not taking it seriously... It can become a serious problem with every coming day... Seperating waste is need of hour... Govt 🙏plz take this issue seriously ...and bring some revolutionary laws regarding this

Watch documentary on Indore. How the cracked the code. It’s government and citizens partnership. Neither of them can do it alone. As Indorian, I am proud of my city becoming 1st for 6th time as cleanest city in India. It’s not just ranking but reality on ground that you can see and recognise. Amazing to see how collective willingness can change human mindset and resolve complex administrative problems.

Love india and indore doing great work.💓 Here in Hungary we have environment officers that patrol streets and stop people with fine from drop litter/trash ,i was fined €500 by officer!!! !

Indore generates 1,900 tonnes of urban waste every day whereas Delhi generates 11332 TPD; six times higher. The segregation of waste is done into six categories at a collection point is a remarkable effort by the people of Indore. How could they transform this culture over a period of time? How many years did it take to make Indore one of the cleanest cities in India?
It was a really great documentary you created. I heard every word the people said and it's all a big problem at the ground level which needs to be solved with the help and the understanding of all the three parties: 1. Ourselves 2. Ragpickers/Informal Garbage Managing Parties 3. MCD itself. Keep growing!

Examples like that of Indore could provide lot of insight I believe. (1) it’s high time, public that is also a substantial waste generator got involved in it besides businesses. Yes public does not manufacture products that end up in waste but as buyers and consumers - they have to know as well there is no magic behind the scenes and that eventually it’s impacting the quality of air, water and land. Simple example recently given was due to toxicity the kidney failure cases now stand at 1 in 5000 which use to be 1 in 1 lakh about a 10-20 years back. (2) Not sure who is paying the tipping fee but hopefully it’s the generators of the waste- businesses and then the consumers. Quality of waste is a metrics relevant more to reusability business and less to the waste management efforts - so I think it’s fair to ask fee by volume rather than quality for waste management ground forces. Post segregation- anything with potential to reentry to market falls back into the waste generator category - B if you will where waste generator category-A are original manufactures of the product itself. (3) There is no substantial progress in the state of affairs of waste management because we have paid little to no focus on the most effective way of waste management and that is to produce less waste in the first place. A walk in almost any store will tell a keen observer how much of useless items that are detrimental to planet and human health fill up the store shelves. It’s top down failure - to begin with courts have failed to pass laws on requiring market clean up and regulating production volumes and quality production in terms of its environmental impacts for example. it’s like we ignore the largest holes in the boat 🛶 as we try hard to close on smaller holes and wonder why we are still sinking. I understand taking up this fight with big corporations who most of the times don’t even manage their own waste is difficult- that is where involving public and spreading awareness and their participation in clean up will be very effective to curb demand generated by mindless consumerism. Would recommend discussion on Degrowth, some documentaries are available on KZread. (4) Agree with the statements towards the end where courts and also companies focus towards documenting for paper filings rather than any meaningful change.
Lack of awareness is a big problem. We must include this in our school syallabus. It can be change some extent
So many rules under solid waste management rules,2016 but nothing is implemented on ground. This is the harsh reality we are facing today. Thank you for this documentary.

I totally agree with the fine. In Germany we have to pay 500 euros if we mix our basic 3 garbage systems. It should be implemented if it's really implemented fairly. Hopefully not like" being fined for not wearing masks in your own car in corona times. Which DOESN'T make any sense at all. 🤦
