    No, qualified immunity was put in place to protect cops from shit like acab, what you should do is actually incentivize them to do their job by suspending them without pay, and have a town vote on if he should lose his job or not. None of this internal affairs bs that protects them, cause qualified immunity commonly gets misconstrued as such

  • @dewayneearley7298

    @dewayneearley7298

    @WhiteUnicorn82 you need to do some research. It is damn near impossible to breach qualified immunity. You have to prove that the officer didn't know he was outside the law. As long as he believed he was, then he was. You have to convince the judge. And then ask yourself why 8s it when they are found to have broken the law it rakes years of IA investigation, yet if they think you have broken the law you go into cuffs right then and there. And can you bargin your badge to escape charges or prison?

If he'd been doing a wheelie away on a sports bike I'd like it. The reason I don't like it is everyone pulls their phones out once any cop asks a question nowadays & normally either cry like a kid or give the office abuse. That's what happened to doctors and now the US pays double what other developed countries do (as % of GDP) for healthcare for much worse outcome. Cops are humans who sometimes make mistakes. If the fine for an illegal arrest is 250k then cops salaries will need to go through the roof (mainly to pay insurance against those fines). And then either everybody will pay crazy amounts of taxes/insurance for security, or security will become something for the rich only (probably somewhere in between just like for healthcare). Careful what you wish for, government and crafting policies is very different from writing 13yo level comments on YT.

    @@HexJK wrong actually.... Very wrong. Police can fine you for specific circumstances like trespassing without the property owner's permission. He was given a $300 fine as a "fixed penalty notice" and even mentioned himself in tweets and other short videos that the police conducted the entire process in a questionable way. Furthermore, the hotel gave him permission to have the car meet there and even confirmed it was okay moments before police arrived. There is no evidence anywhere of who called them. Police also like to disperse car meets since its easy targets and they often get money to the department by auctioning off seized cars under Forfeiture Laws.

    Cops can’t make that call. Trespassing doesn’t work that way first of all. Trespassing works only if the owner requests someone to leave. Then that person can be trespassed, then a trespass warning can be issued, then if refusal is present, then one can be arrested for trespassing. However if an officer walks in and suggests the employees to trespass someone, that’s called “solicitation of trespass “ and that’s illegal for an officer to do.
