    KALYAN SIR I HAVE A HUGE DOUBT ON ARTICLE 15 (3).. IS IT NON JUSTICEABLE ?? CAUSE 1) ITS A LEGAL RIGHT AND GIVES POWER TO THE STATE TO MAKE SPECIAL PROVISIONS 2) THE SPECIAL PROVISIONS WILL BE GIVEN BASED ON ITS FEASIBILITY AGAIN.AND NON ONE CAN COMPELL THE STATES TO MAKE SPECIAL PROVISIONS.. AGAIN IF ITS A FUNDAMENTAL RIGHT IT SHOULD BE ABIDING FOR THE STATE BUT AGAIN IT BASED ON FEASIBILITY OF SPECIAL PROVISIONS WHICH IS EXACTLY SAME WITH THE NATURE OF DIRECTIVE PRINCIPLES OF STATE POLICY SIR PLEASE ENLIGHTEN ME ON THIS GROUND AS I FROM MTECH ENGINEERING BACKGROUND !!!     if we were talking about RIGHT TO EQUALITY don't you think it's not properly implemented because one side the constitution is saying all are equal and on the other side there is RESERVATION which makes difference among peoples.

    prashant mehan Yeah It has been discussed in Indian constition but Right to Equality as mentioned in constitution is not absolute. 2nd thing is that Right to equality has two aspect, 1st is negative where no personal can enjoy special treatment at the cost of others.2nd is government has a positive role in fulfilling equality and the same positive role is enforcing of GOI to make reservation for deprieve section. In this way, you can not say equality is violated by reserving some seat.Inorder to revise reverse discrimination, Reservation should not more than 50% and finally Creamy layers has been discarded from reservation just to stop reverse discrimination.

    Vijay Bhaskar this 50 percent is increases by each year. in rajasthan u heard abut that the GURJAR get the reservation from the general seats. and if the creamy layer concept will not modified it may cause the serious damage to the society coz some sc st are mitigate by there own cast candidates who have all the resources still even take the seats. it doesn't make the difference, the reservation is started for 10 years only and the irony is it still doesn't confront the lower caste. and one more thing the reservation is started just for ECONOMIC COMPENSATION only coz that time the lower class is in terrible condition but the things are different now days. the creamy layer concept should be modified after each 5 years and those who earns 5 to 6 lakh in a year should be eliminated frm reservation. THIS is need to be taken seriously by the sc st itself who earns a sufficient amount of money. atleast for there own category.

    In Article 16 clause 4, Reservation is given to backward classes or downtrodden section to bring equally in society.You talking about Uniformity.But equally is different than uniformity.

    aabi jay During emergency, every single article can be suspended except articles 20 and 21. But the moment you enforce article 31 B, then even 20 and 21 can be suspended.

    +Rishank Devadiga what's the difference? can you not go to a court of law for legal rights? i guess making it a legal right gave state a right to acquire private property which would otherwise not have been available with the state provided the state gives the property holder a fair compensation. Had it been a fundamental right, owners of the property would have gone to courts and prevented the State from undertaking infrastructure developmental activities.
