It’s high time everyone gets their opinion off rivers state. Make everybody dey there dey . You brought someone as governor, people brought you as governor and you ruled like an emperor without acknowledging those who paid the price for you, now you are out and still want to lord over someone, something you can’t take, you want to do to someone else. The Gov has shown to be people friendly and is working, I never voted in the governorship elections after the anger of how same Wike thwarted our votes for the APC but we must move on and God so kind Fubara is the best in terms of calmness we’ve ever had. Wike dey your dey, nobody worry Fubara .

This is the best lawyer I have seen regarding this Rivers State matter... the biasness of the news anchors is very visible .

Barr Ubani hasn't been totally forthcoming about that aspect of the law. The constitution said if they decamped and the Speaker of the house declares their seats vacant they have lost their seats. That is one aspect. Secondly... the constitution makes it automatic once you crossover to another party. Thirdly.... The supreme court has properly defined what a party's division or merger. So let the lawyer be honest to the constitution.

Was there really a division in PDP? If no, what can we call a situation where some governors work against their party's candidate during the last Presidential election. If no, what makes Peter Obi exit PDP to join LP even before the Presidential primary. These and more questions are still looming for us to determine if the defection is justified. Don't forget the fact that the minority cannot override the majority. My take.

Wrong, an armed robber is taken to prison whether within prison law or custody until granted bail. A person caught in the act of crime is not released to the public but is prosecuted.

In my own opinion, after listening to Femi Falana SAN and the same SAN speaking is that only court can make pronouncements of vacating a seat of senators. Court is the only recognised body that will make the position to effect the change of this circumstance even though is clearly seen that the assembly members have lost their seat. I am just wondering why a very simple issue is difficult for you and some prominent lawyers in Nigeria to understand. Now the issue is very simple. Judiciary makes the law. It's the duty of the executive(the Governor in this case) to implement that law any time he perceives that the law has been broken by preventing them to further sit as legislators. Thereafter, the presumed ex law law makers could approach the court to prove that there was actually a division in their party. If they prove their case, the court would then return them as legislators. This is the law implementation procedure. I don't know why people are so confused in this matter.

But there is a subsistent court judgement from Abuja federal high court on this matter. The matter has not been repealed against so why will the high court I Port Harcourt place a restraining order on the assembly members not to seat?

The governor has done the right thing by obeying first the section 109, then to restore their rights, let them go to court, and let the court determines if there was division or merger in the PDP. I am very sure, misunderstanding cannot be termed division.

My Brother, If the Judiciary open their EYE and MOUTH and tell us that there is DIVISION in this matter, I will start looking at every LAW Student in Nigeria not in US, UK or any other part of the world as fool without future. I know that they have done this first one by thwarting the understanding of the word AND during the 2023 Presidential Elections by telling us that scoring two-thirds in X number of States AND Abuja does not mean that you MUST score two-third at Abuja. Also telling us that a City (not a state) with only one Senator is a STATE or Equivalent with other States of the federation with Three Senators. JUDICIARY Should SAVE Nigeria because if they do not do it, they will be the first to run out of NIGERIA when it sets.

The issue here na English .. you can’t use the word automatic and subsequence sentence start with but or unless….. you can’t still hold your sit while trying to justify your reasons for defection … (it should happen the other way round )the law is most misunderstood by same lads who make them …

One can't speak without knowing what is it. Now, why not the judiciary speak through the constitutional? We all are participates in this. God help us.

Its interesting how all these lawyers are now giving an opinion on a matter that is in court. But when they dnt have liver to talk they all claim sub judice.

In my opinion and by the provisions of the law, the lawmakers should be deemed to have lost their seats. It should now behove on them to fulfill the proviso by approaching the court to stake their claim as to why they defected, citing the availability of those ingredients of the law to have been fulfilled.

Please tell oga san that as individual and citizens of the country, we have legitimate and substantive rights which dies not need judiciary to confirm. Do I need the judiciary to confirm my right to breath?. All these lawyers are the problem of Nigeria.

It is the law makers that should go to court to challenge the declaration if they think it was wrongfully done. If they think the provisos is in their favour. Sir you are more of an SAN than just a lawyer

Wrong Ubani. You need to go learn further maths: permutation and combination precisely. There is nothing wrong with the Constitution in this particular context. And the Constitution isn't a "living" document. The Constitution is to be read as a fixed foundational instrument. So, if the Constitution says a right is lost once you changed political platform, that is not ambiguous. A person who does that can no longer as a lawmaker. However, if s/he believes that an exception applies to them, they have the onus, duty, expense of approaching the Court and getting the Court to give them an order stating that they should be re-instated as Lawmaker because there was division in their State.

How can a lawyer be advocating for a political situation for a legal problem.
