    This happened to me this year, I was away in the military for 6 months, came back and my wife while working and taking care of my daughter forgot to pay the HOA, they placed a lien on my house and charged me $800 in fees, I was just getting back to work and didn’t have that much money and I explained that I was away in the military, they didn’t care, I had to pay like $1,200. The bill that we missed was for $300, I’m at the point that I’m just to exhausted mentally with the HOA to care anymore....

    @@cracetrick Sorry they did that to you and thank you for your service. After watching several YT news clips about HOAs am convinced that these organizations serve no purpose other than to harass homeowners like yourself into paying their fees and fines. They cite property values as a reason for their importance yet it is the real estate market/economy that decides, not HOAs!

    @Andy Larson Wow. I don't live in an HOA community. But, from the comments, I didn't know how those who did/do believe it's a scam. It seems a disinterested accounting firm should be looking at all the paperwork on these places? I don't know how these HOA's work, tbh.

    FYI: She later filed bankruptcy and her lawyers from the criminal case had to file suit against her because she reversed charges of $9k on her credit card after she fired them.

    I'm a Brit so I don't understand why you have HOAs in the first place but what really confuses me is how someone with a criminal record is allowed to become HOA President? Especially when she's been convicted of Forgery and Fraud. Surely you have to declare any convictions when applying for the position?

    There are good reasons to live in an HOA. If not for our HOA we would be forced to move or live in an area that was increasingly being taken over by Short Term Rentals. Do your research and you will get the best results.

    It depends on the HOA... this wouldn't be possible if she didn't have access to the accounts. Q: Why does a HOA president need access to a checkbook? A: They don't! Where I live the management company pays all invoices directly & will reimburse residents for anything minor that we pay out of pocket, with prior agreement after a receipt is produced.

    yep i have no HOA and thats fine by me, we arent lighting bonfires and there arent broken cars (we want our home looking nice we dont need HOA to tell us what color we can paint our house). I dont know why but i heard HOA hates both of those things

    She has a history of fraud, is a non-paying renter for her business and adding offenses every job she holds. It is evident she is a criminal who preys on law-abiding, good people. To boot, for her attorney to sit there and argue that “it is simply a book-keeping error” is a further fraudulent statement and she herself should be charged with accessory after the fact. As a former federal agent, it was so disheartening to have to sit and listen to defenders actually make crap up and look for the tiniest of loopholes (or case precedents) to get a client off. I feel that is just as criminal as the person who does the crime. Defenders are there to make sure the law is being followed, a fair and speedy trial is being accomplished and if there IS actual evidence that the person did not commit the crime, that it is presented. This lady was caught dead to rights and should definitively be prosecuted. Any investigative body who fails that task (due to a retirement?…..which sounds like the SO shitcanned the case) needs to be looked into by the State AG’s office. Well done citizens. Know your rights, question questionable crap that comes across your billing statements and don’t be fooled by a pretty face (or threats). 🙏

    Her lawyers in this case took her to court themselves after she paid them $9000 of the $15000 owed for her defense on a credit card, and after 8 months working for her she disputed the $9000 charge and reversed the funds.🤣😂 "www.nmb.uscourts.gov/sites/default/files/opinions/19.1038.22.pdf" She is currently suing a shopping center and restaurant for personal injury.     I know of an HOA , upon being elected president, all outside contractors were friends of his , he soon began driving a 100 K Benz, bought a nice boat , eventually was audited by the HOA AND the IRS , doing jail time now 🤣🤣

    Alex Flockhart HOAs are voluntary - meaning, “Don’t live there.” Taxes are collected at the point of a gun. Don’t pay them, and the sheriff will (at the point of a gun, if necessary) force you out of “your” house. You choose your battles. I for one, will never live in an HOA again.

    At the moment we are living in a house we bought in an HOA neighborhood and it is actually pretty good. But we have lived in rentals where the HOA sucked. It seems to depend a whole bunch on who gets involved and what the people involved think their job is. The last neighborhood we were in did not have an HOA and we had neighbors with 8 cars parked in and around their yard, loud music and partying every weekend, and groups of people hanging around their yard during the height of the pandemic, unmasked, drinking beer, working on cars and motorcycles, and racing cars up and down the block. So, on one hand you have an HOA and you might have the raising fees, the yard Nazis that complain about the color schemes of the flowers you planted, the holiday decorations you put out, or the color of your front door, or no HOA and have neighbors that have junk yards in the front yards, loud parties, dog shit covered yards that stink up the neighborhoods and dangerous animals that roam the neighborhoods frequently threatening your kids and pets. I personally think that anyone who embezzles HOA funds needs to go to jail. And I think that there has to be a whole bunch of transparentcy and oversight when it comes to neighborhood covenant and what is exceptable and unexceptable restrictions and activities on a homeowers personal, paid for property. I have no desire to dictate to my neighbors what they do with their own homes. But I also do not want to be in a situation where my neighbor is letting their property go to hell and negatively effecting my property value and more importantly, my ability to enjoy my home as I want. In the past, it was easy to get to know neighbors, and sometimes come to agreements with them. But recently I must admit that I have seen so much hate, violence and lack of respect show toward fellow human beings that it is no longer a safe option to just let a neighbor know that your have an issue with loud, outdoor parties every weekend that last long past midnight. Or that if they need help with the weed, you will lend a hand. When I was growing up, we had a next door neighbor that had 4 huge, indoor, outdoor parties a year with tons of people, a band in the back yard, a keg, and a till the last man drops time limit on the festivities. His solution was to give everyone on our block invitations to the party and he did this about a week before. Of course, not every neighbor choose to participate in his party, and even though we would go over to have supper, and maybe dance for a while, just the fact that we were welcome to come over, and we knew that these parties were planned, and not really very frequent, it was acceptable to everyone . Funny how being neighborally and tolerant solved problems back 50 years ago.

    I've often wondered why "redline" neighborhoods, are illegal, but HOAs stunningly have some of the same core "rules" to keep "the wrong" people out. Usually it just means a poor person struggling with bills. How is this legal ?

    Brings up a good question - how well do the association members know their board members, and did anyone do any vetting before they were elected? I'm on a board with 2 other members, and, as far as I know, no one's done any background checks on any of us. Might be difficult for us to do that - only 39 homes, and not a lot of income / reserves. Entire budget is only around $4,500 / year. I'm pretty sure we're OK, but I suppose there should be SOMETHING in place to make sure board members (particularly the one who's in charge of the money) are honest. Maybe we should be bonded? Don't know how much that costs.

    If you think about it it’s an organized crime syndicate just like the Mafia! These bullies get together and form a gang called HOA to basically threaten people to pay up or they put a lien on their house and do other things to the residents on houses that don’t even belong to any of the HOA bigwigs.     One of the problems is, so any places now have HOAs. The only way to deal with them is to hire a Property Management company and make sure that every home owner in their community has a VOICE and they get ALL the information about where their money is being spent.

    I was president of my HOA for nearly 10 years and proudly loved by the community. After I moved out I heard my replacement was a tyrant as she would abuse her power by being vindictive to those she personally disliked. They brought me back to review her behavior and her suspected misappropriation of money for personal gain. Long story short, she ended up going to prison for misappropriation of funds, extortion and accepting kickbacks from crooked contractors... bottom line... HOA’s suck and I will never buy into a community that has one ever again.

    I think HOAs are very similar to government. If you have good people in charge, who care about others and are intelligent, then it can work out great! Clearly, you fell into that category. But sadly all it takes is for one incompetent or greedy fool to be in charge and the whole system gets messed up.

    When you get a bill for $900 for a $30 bill, there's no way you think that's legitimate. I'm fighting that one till my last red cent. I've been in similar situations, and I'll fight to my last penny over $25. It's the principle of the thing.

    Agreed. Apparently this HOA has non-existent accounting oversight. She was caught when she got really greedy and the recipients of these outrageous bills started asking questions. If she was more devious, she could have inflated every member's bills by only a small amount every month so she would have better "plausible deniability." This makes me wonder how many other HOA Presidents are doing the same thing and aren't being caught because their bills didn't inflate to such absurd proportions? The accounting books of an HOA should be open to all members so they can track every penny and prevent this kind of thing from happening.

    I’m in the market for a home and my realtor told me she found a condo that fit what I’m looking for. A $124,000 condo that had an HOA fee of $178 a month. I told her no, but really I wanted to yell “hell to the no!” What on earth this HOA could do for me to charge me $178 a month? No way I’m gonna pay that outrageous fee just so these HOA criminal gang members could tell me what to do with my house and how to live my life! I don’t want to be an HOA member even if it’s free!

    You can't really fight. You agreed ahead of time to do what you are told. Then they put a lien on your house. Then they take your house. Judge shrugs his shoulders and points out you AGREED to this (and paid them extra for it!) HOA's are evil.

    @Bob -- HOA's can be formed in existing neighborhoods and you can be forced into it. I agree you should not be required to join a HOA if there was not one when you moved into your home.

    if you are in a neighborhood without a HOA, create 1 and make yourself the board director, (its a placebo HOA without any power) its only there to prevent greedy people from creating 1. or have some development agent come in and force everybody to leave their homes, since the city wants tho build a nuclear waste plant there, or something else stupid like a parkinglot for a wallmarkt that is 10 miles away

    If an HOA tries to move in to my neighborhood, I'll sign nothing from them so I'm not legally concenting to anything they want & tell them to get off MY PROPERTY. Then I'll find a lawyer so I'm better informed of my legal rights to keep them theives off MY LAND.

    And to those who respond "sometimes you don't have a choice when you want a new home". Its better for your sanity to have a hands off landlord. Then own your own home, and be a slave. Also, the more rural you get, and further away from subdivisions, the better. Honestly, your better off living in shipping containers in the new mexico desert. People do make their own little paradise. My uncle turned his Fallout landscape into a lush green chili farm with hard work, and dedication.

    I understand that, but they are the only authority you can go to in situations where neighbors don’t care for their property, let their grass die, have unruly kids that vandalize, think it’s OK to put junk in their front yards like old cars on blocks etc. When they do their job correctly there are supposed to protect the value of the neighborhood homes by making sure everybody complies with the same standards to keep things looking nice. But this bitch, I hope they put her feet to the coals!

    olivia15073 if you view housing as a great investment, can't wait for your new wake up call when China's grip on it collapses. I remember in 2008 when that market crashed. My parents sat pretty in their little house. While our community became a ghost town as all the jobs dried up. Not only did our house became worthless because of the economy. There was no one left to maintain anything. All the vacant ten year old houses were robbed of copper. The lawns and park turned to dust, the home owners association couldn't pay for anything. I grew up in that vibrant neighborhood, and after ten years, the desert took it back. The only power we have is each other, and the ability to create a home. To look at it as a property investment is the best way to get fleeced by the big people.

    Unfortunately, in some states a HOA can be formed in an existing neighborhood and you could have no say in the matter. One day you own your home and the next you are forced into a HOA and have to pay dues. It is the kind of thing that should not be allowed to happen and the laws should be changed to stop this nonsense.

    It is part of cc&r / conditions covenants and restrictions . It is part of original development of a project . No one is forced to purchase a lot within that development but once you do you are bound by it until the majority of property owners come together to modify or take legal steps to abandon the cc& r 's . Until things are changed you will abode by it or pay the fines .

    Some cities (like mine) seem to DEMAND that HOA's be set up on all NEW developments. It makes it easier for the city to enforce certain requirements (like parking restrictions, house appearance, yada, yada, yada....) if they make the HOA responsible, and not the individual home owner.

    It is a bookkeeping issue with someone from the HOA helping it along while they help themselves to your money. Also check out what the HOA Board members have in their front/backyard while they do not allow other non-Board members to have, i.e. pools and certain types of pool fences, childrens' play equipment, trees and certain flowers. What annoys me about this type of set up is they do not allow any individuality from house to house, okay you do not want a bright pink or yellow or green or purple house fronts but some variations in house colours should be acceptable. And for goodness sake if you ask permission to do something to or on your property GET IT IN WRITING SIGNED BY AT LEAST 3-4 MEMBERS (plus the BOARD CHAIRPERSON) OF THE CURRENT BOARD SO YOU DO NOT HAVE PROBLEMS WITH LATER BOARDS YEARS DOWN THE TRACK. 🇦🇺🇦🇺😁😁🏡🏠

    My Neighborhood HOA was a dictator. We couldn't park our vehicles on our grass. Without get a ticket or towed. Finally her boyfriend snitch her out. She taken our money going in vacations and buy clothes. She bought him a car. When she dump him he snitch her out.

    I have seen HOAs fine home owners then after they couldn't pay the HOA TOOK OWNERSHIP OF THE HOUSE AND HAD THE POLICE KICK THE ORIGINAL HOME OWNERS OUT OF THEIR HOUSE and then rent it to new people. So after the president of a HOA is found stealing? She will give the money that is left back, pay a small fine, and go back to work on Monday.

    Here in British Columbia, we have what is known as strata councils, now they can be self managed or they have a strata manager, but still have the council, also we have what is known as the condominium act, self managed or managed the accounts have to be audited every year, some of the horror stories of HOAs south of the border are just alien to us

We got through the decade with no computers, or IPhones! $hit just plain $ucks now, especially music........just saying. (Early 80's were so bad either except car design).

    @G B If you have the money to buy in a nice neighborhood you are likely to be the type of person to keep up your property. HOAs are a deal breaker. I worked hard for the house I do what I want. If I have noisy neighbors so be it

    That's why the vast majority of HOAs use professional management companies where none of the board members have direct access to any accounts.

    Professional management companies are the tools used by the Chinese and other foreign companies that are buying up ALL RENTAL PROPERTIES, and it's called equity management.. It's a scheme, and guarantees your rent will rise by $300.00 in one year, Then that company will sell the properties once they have sucked the lessors bank accounts dry and have to move out, so the next BIG conglomerate will basically be jacking up all the rents. If you pay you can stay, and the new rentors/buyers will be coming in knowing what their leases will cost, and then the cycle repeats Jack up rents, flush out, sell, buyer management Jack's up rent,sell, buy, the screw keeps on turning! Its call equity owner and management. Similar practices are taking hold in many different forms, such as the push to remove ALL older cars from the landscape, and replace with newer electric clean energy vehicles. Not all people can afford to buy an electric car or truck, thus they are forced to commute, they cant drive anymore. Soon more people will be forced onto the streets of homelessness as the rental equity screws continue to turn forcing eve those who think they can pay $1,400.00 a month for a studio apartment but the next equity management company that buys the property Jack's your rent up to $1,700.00 after 3 years. Too many very educated Crooked people with computer skills and heartless greed for money no matter ones life or background. They don't care!

    Dave, I've seen so many corrupt HOA's it's not even funny. I've seen entire HOA's use money for their own personal needs instead of sending it towards the community like it's supposed to. I've seen some that have used the funds for PRIVATE meetings at fancy upscale restaurants, to foot the bill. HOA's are out dated, and generally, they abuse their power. I've seen cases where someone was in a hospital for a month, missing one payment, their house immediately got sold to someone else along with all their belongings. HOA's are nothing but scum.

    Zach Kellner That's the biggest crock of crap I've seen in a while. You just literally pulled that out of your ass. For one thing, HOA's can't SELL ANYONE'S HOUSE. They can fine you and/or put a lien on your property, but they cannot just sell someone else's home out from under them. PARTICULARLY not for something as minor as missing a payment.

    @Zach Kellner That is a court proceeding that takes years. The woman would have been notified she was in arrears multiple times by the HOA, as well as being served with legal papers from the court informing her she was being sued, informed further on that there would be a hearing and where and when she was to appear, etc. Failure to appear is the kiss of death. I'm guessing she blew it off, thinking they couldn't touch her because her home was paid for. She was very wrong. They sued. They won. Now she's playing the ignorant victim who nobody told anything. Yeah, right....
