I'm glad I found this. My husband is a owner operator. He's been a trucker for the last 28 years consistently over the road. He has never had an accident and hasn't had a ticket in a decade and does 100,000 miles a year on average so I think he's a pretty good driver. Well, he had a. I pulled him over and gave him a seat belt ticket that he didn't deserve because the seat belt was on. Then I called the court in Arizona to pay the ticket and they said that if I pay the ticket he's probably going to lose his CDL because they've made it a 7 point violation there and it'll show up on his PSP and make the place he's leased on with and has been there a decade have points. So they said our option was to get a lawyer or pay it and deal with the consequence I started calling lawyers and talk to 7 lawyers that all declined the case when they saw the ticket because this particular. Top Road it using a federal statute instead of state which made it like a civil case on top of everything else and he was pulled over in Tucson but the court was somewhere on the border like three and a half hours away from Tucson. We finally finally found this old prosecutor that was willing to take the case for $3,000 but he couldn't guarantee that he would get results. It was better than nothing so we did it and he went to court on our behalf because the cop wouldn't call him back Luckily the ticket got reduced to an equipment violation which is great. He told us to run our reports a few months later to make sure it was gone. Sure enough we ran the report and they have the seatbelt ticket reported as a seatbelt ticket and in addition to that have a second violation reported for equipment violation so we're worse off than before we even got the lawyer because now we have two violations I never did receive the final paperwork from this lawyer and I just found out about this so I have a message in with this lawyer to see if he can help us. There should be some kind of penalty when this stuff gets reported incorrectly. I'm not sure who even reports it, the court? I'm going to call the court tomorrow and see if I could start there. This is just unbelievable. We stressed out so badly all the way up to this court date and we thought it was over but now it's compounded with now 2 violations. He could lose his job over this nonsense I'm also a driver recruiter and every single day I disqualified drivers for that PSP and it's usually from one pull over. I had one guy today that got pulled over one time and the cop wrote 11 driver violations so it counted just the same as if he had 11 moving violations that we couldn't touch him with a ten-foot pole. One of the violations I remember was that he didn't have enough spare extra log sheets in case the ELD failed. It was literally ten other violations just as gross as that violation. It counted as 11 violations. He will never get a job. It's literally giving adeoti cop the power to take away your career if they don't like you. They can come up with any reason to write a violation. If the. Stops in a bad mood, you may just lose your house because you can't work anymore. In our case, that truck and him driving it is how this family functions financially. This is really unreal and completely unfair. No cop of any kind should be given this kind of power because we all know that there's a lot of people that have a little bit of power and use it to purposely hurt anyone that they can because they're miserable people

Thank you so much for the detail in how to contest a citation. I was charged $500 by CDL 360 to do what I can do for myself using your instructions. My advice is if you ever get contacted by CDL60 to represent you, just hang up the phone. My question is should i contest one citation at time or should I submit multiple one all at once? I was the victim of a road rage incident and a lady passed me pulled into my lane and no other cars were near neither of us, locked her brakes up and I bumped into her causing only a scratch on her bumper....I had a camera in my truck that clearly shows this, my trucking company's insurance at the time, ruled it to be intentionally caused by the other driver and they denied her claim in which she was lying and stated to the cops that there were major injuries. There were none.....I now can no longer find a job as a driver because the reports show there was an accident and possible major injuries. I can't prove any of this because I don't have the money for an attorney to obtain her hospital records to prove she's a liar. I am 53 now, I have no other skills and I have been out of a job since 10/2022 and all my bills are piling up and I have become severely depressed and feel hopeless and suicidal. I am losing everything because of a lying dirtbag!

How do you find your score , basically the score that your insurance pulls up

It’s so hard to dispute the violation. The officers don’t obey. I need someone who can help me to dispute the violation on the sms portal, or at least teach me how to do it.

Yes, assuming it's on your FMCSA data report from a roadside inspection. Tickets that you 'just pay' are guilty pleas. By paying the violation directly, you are pleading guilty to whatever is on the charge document and it'll show on your state MVR. Your CSA data reflects what is on the exam/inspection report, and a guilty plea on the ticket means the DOT record isn't going anywhere.

Hi. Question back on sep/2023 I have an inspection officer found an out service violation ( chamber air hose wear) but dot officer did not put out of service on the spot also dot officer said he won’t put me out of service even on the report because I was on the way to my yard less than a 1 mile away from where I was pulled over.but when I go online I see I have 1 out of service 100% is possible to do something about this??

One thing to always ask before leaving the scale. Is "Did I get an out of service?" sometimes they don't tell you if you got one, it is your responsibility to ask. In this case the only thing you can do is get more inspections and pass them to Lowe the score. It's a bummer they don't tell you.

Same here, they gave me an OOS for dirt piled up on the rear deck of my dump truck, which of course I didn’t notice on the ticket. I cleaned it out in front of the officer, as he requested, and he let me keep driving. I requested on data Qs the removal of oos but they denied it. My insurance went up about 10 to 15 grand for next year. Frustrating.

I jus wanted to know if I was gonna be able to pass a drug and an fail and they put me in clearing house…what’s the best way to appeal it?

If the violation was dismissed and that violation was listed on an exam report, get the 'disposition' from the court (final order of dismissal) and log in to Safer or the DataQ portal and issue a challenge. You'll need to upload the dismissal document in the challenge. Depending on the details of the dismissal it may not qualify for removal, but often the dismissal is enough to have the state examiner remove the entry. The key that makes it a slam dunk is if the dismissal is a straight dismissal without costs paid.

How can you fight tire violations? They really are heavy on CSA scores and hurt you when it comes to insurance.

I don’t believe you can fight a warning. Some DOT officers issue warnings so that you are not able to contest the violation since it is just a warning.
