    This is actually A very interesting topic - in particular meme culture. If someone creates a meme using someone’s likeness (any celebrity), and post a meme for entertainment purposes only (eg: not being sold/marketed), where does that fall in the legality side of things? Also as a second follow up related to the specific one you brought up today, what if let’s say someone had created a meme - the same exact picture that Fesley tried to use - but instead of for marketing, it was just a joke or meme picture on someone’s page for entertainment only - what are the legalities on that? In other words how much does the monetary/marketing aspect balance against the entertainment and joking aspects. Im genuinely very curious about this. As a part time graphic designer, I must say I’m very intrigued in this topic as the line gets blurry as to what clients want done - and AI doesn’t help that very much either. “Can you just recreate the album so and so band did but put our name on it??”…. “No!” lol I don’t want to get sued plus that’s just tacky anyways 😁

    Memes for entertainment are doing a parody of a public figure--but Fesley tried to generate business using Bryant's image--which violates his right to publicity.

    @@blueslawyer yeah exactly. I should be clear that I 100% agree that what they did was wrong. I was more just asking as someone who likes to make joking stuff for friends and entertainment purely just for our internal use and of tasteful nature. As always love your videos and find them very insightful. Everyone always says if I didn’t pursue the career I did I probably would have been involved in litigation lol
