The judges were unanimous in their decision, declaring Australian citizens should not be prevented from participating in representative government . “where it can be demonstrated that [they] took all steps reasonably required by foreign law to renounce his or her citizenship of a foreign power” Exactly what this requires however depends on the circumstances of each particular case and it will also depend on the law of the relevant foreign country. In Payman's case, she took all reasonable steps to renounce her Afghan citizenship as per the High Court's ruling.

It is about time Albanese, and Dutton for that matter came clean about the Gaza genocide, and instead of bleating about a two state solution, and doing nothing. As of June 2024, the State of Palestine is recognized as a sovereign state by 145 of the 193 member states of the United Nations. It has been a non-member observer state of the United Nations General Assembly since November 2012. Australia does not recognise Palestine as a separate state, and until they do, any talk of a "two state" solution is pure hypocrisy. Albanese and Wong need to get their act together, instead of kowtowing to the Israel lobby. Payman is an Australian citizen, full stop. While we are on the subject of religious influences in politics, perhaps you might like to consider why the Christian Lords Prayer is recited in the Senate before each sitting. I would also add that if Payman is alledged to abide by sharia law, why then did she leave Afghanistan, where that is practiced? In other words, it is nonsense. If you are really worried about Islam, I also remind you that there are over 300 million muslims living about 300kms to the North of Australia.

It was checked in the beginning, and it was deemed to be a non-issue because she had taken all available steps to renounce her Afghan citizenship, this is and was publicly available information at the time she was elected. The public has a 40 day period at each election cycle to raise legal challenges regarding citizenship (which, again, is public) and then after that 40 day period any challenges to eligibility must come from Parliament. After the 2017 crisis, parties have by convention not challenged each other's candidates on the basis of citizenship provided the candidate has taken all reasonable measures to renounce. There's a constitutional laywer with a channel called The Constitutional Clarion that explains these circumstances in detail. This is only now being cooked up into a media storm because Senator Payman has left the Labor party, and they want to prevent her from further using her position to speak out against the genocide being perpetrated in Gaza.

@@MenaceGallagher No, it's not Gaza and Israel. As passionate as you and Senator Payman may be about that, truth is that's a millennia old fight overseas, that has SFA to do with us here. It's much more about internal number games in Canberra. Payman received less than 1700 direct votes herself. She was put in as a Labor Candidate, and is ONLY there because of Labor and their silly diversity game playing. She knew their policies about crossing the floor, and their stance on Israel/Gaza when she signed up and swore an oath. Given there is an informal agreement between the parties not to challenge each other's candidates based on duel citizenship, and she is now an Independent, she no longer automatically enjoys that 'informal protection'. There is no standing agreement with her. So she very much is open to being challenged based on her duel citizenship issues, by one of the current political parties. If she's ousted due to that, the next Labor candidate will replace her. So it's unlikely the coalition will challenge. From their perspective... a pain in the butt for Labor is better than another Labor senator. Will Labor challenge her now? Hmm, they shoot themselves in the foot if they do, because THEY endorsed her in the first place. Given that the Greens voting block typically back Labor in most big issues in the Senate as it is....they'll likely have her vote on most issues anyway. So they may well just sook about it, but not challenge her. One Nation be the dark horse here.... what is Pauline and co thinking. If a vote among the public were taken.....Payman may well find her disingenuous, ungrateful, parasite activist self on a plane back to Afghanistan for a life lesson in reality.

The House of Representatives and the Senate have other separate rules i.e. age, length of time in the USA, time residing in a state etc. however, migrants can be members in both houses, providing they meet the requirements.

Constitution needs to be updated. You need to 1) renounce citizenship of the former country and 2) Live in Australia for 30 years as an Australian citizen only, so they can learn OUR way of life before even being able to be nominated. I will be fucked if I am going to let foreign entities come here and start controlling our government within a year of their arrival and they still have duel citizenship. Civil wars start over things like that.

Fatima is supposes to be standing for the interest's of Western Australia , as one of the 12 WA senator's . Fatima is not in politics to be a Palestinian representative .

Why arent they sacking her for her dual citizenship? I remember, years ago, quite a few politicians had to step down for this very reason. Her views do not align with Australain culture and values and she does not belong in our parliament.

She tried to renounce her Afghan citizenship but could not do it due to the Taliban government.

Its abundantly clear where her loyalties lie and its not doing the job she was elected for and that is as a participant in AUSTRALIAN Government issues, she can have ger own personal opinion about Palestine but it is the height of arrogance and SELF INTEREST to expect the Australian government to agree with her personal opinion, she has no right whatsoever to bring that into Parliament then dramatically spit the dummy when SHE doesn't get what she wants, theres no place for her in the Australian Government her judgement is blinded by her religion she has squandered a unique opportunity to demonstrate that a Muslim woman can show leadership and opportunity for other Muslim representing AUSTRALIA , but all too sadly there seems to be an a barrier when loyalty to her country and loyalty to her religion is challenged, for this Senator she chose the latter and that makes her ineligible to have ANY position in our government, she should be disqualified assp.

Unbelievable, how on earth did they allow her to become a member of parliament as Section 44 clearly stated in black and white that she is disqualified irrespective of what was the process of renunication of her citizenship of Afghanistan. Change of government does not preclude inability of government to revoke her citizenship as there are still uncertainities going on. ALP knew about that and went ahead. Now Australia is in a massive mess because of it.

The Rohingya people fled from Bangladesh because of attacks by other Islamic sects. They fled to Myanmar and set up their communities there. However they then started demanding that Myanmar give a portion of the land to them so that they could have their own nation. Myanmar, quite rightly, would not agree to having their kindness and hospitality treated in such a way and violence erupted between them.

Isn't she an MP in Australia? Why is she only fighting for the people of Gaza? Her main priority should be to the people of Australia. The problem is her religion. Her loyalty is only to that, nothing else.
