    I recall that Americans were very upset when the Ayatollahs took over Iran creating an Islamic state...and the Taliban imposing their religious ideology on Afghanistan, and particularly on the women, was considered evil. Yet here we are with the same thing being implemented in the USA.

    You missed another radical reversal. Also last week, The Supreme Court ruled in Vega v Tekoh, That the police cannot be sued if they do not read you your Miranda rights. In Vega, Tekoh, Hey certified nursing assistant underwent an illegal interrogation by Vega, Los Angeles police officer. Vega Failed to read Tekoh his Miranda rights after accusing him of molesting a patient, kept him in a secluded room, prevented him from speaking to a lawyer or to his supervisor, Waved his gun around in a threatening manner, And threaten him with deportation. This ultimately led to a forced Confession. At Trial, Tekoh was found not guilty and sued on the basis that his Miranda rights have been violated. The supreme Court ruled that he could not sue the police on the basis of this Constitutional violation, thereby essentially eviscerating the Miranda ruling, which had been in place And protecting American citizens since 1966.

    The nail is in the coffin of this nation's trust in the Supreme Court. It is gone, and it will not return. Four justices who in their nomination interviews and in their testimony under oath before congress stated on the record that RvW was settled constitutional law, have decided now that it is not. The opinion doesn't state that new evidence has come to light that compelled these justices to change their mind, which is their right to do. Alito in his confirmation hearings back in 1990 stated it was settled. Yet his opinion stated Friday is that RvW was always wrong. So if these four justices are on the public record during their confirmation that RvW was settled, and there is no new and compelling evidence put forth that has changed their mind, then there is only one conclusion that can be drawn. They lied. They lied to get on the court. They lied to get on the court with the intention of waiting until the day that their "side" would have the votes to overturn RvW. They lied to congress. They lied to the American people. And it could be argued they lied in front of God. When the evidence is clear that half the court lied to get on the court and then deliberately waited until the right opportunity to carry our their agenda, an agenda that is either driven by their personal interpretation of religion or is driven by their political affiliation (or both), you have a court that cannot be trusted. It is not acting on behalf of the will of the people. It is not acting on established constitutional law. It is acting on self interest, personal interest. And this is why the U.S. Supreme Court has irrevocably squandered its trust through a political process veiled in religion. The supreme court is now just another political hack institution, used by which ever party can load it to their benefit, to drive political agendas and not to serve the constitution or the people the constitution is supposed to serve and protect. No matter where you stand on RvW, today is a dark day. No one wins. Everyone is a loser, because the branch of government our founding fathers created as an essential check on the other two branches is now cemented in history as just a political hack. For those of you celebrating a single decision today, take note. Whether it is five years from now, or 25 years from now, the court will be loaded the other day, and the institution will function then as it is today, serving the party that loaded the majority.

    ???? The courts decisions this week were CONSTITUTIONAL. Nothing else. Guess he didn't read the rulings. They EXPLAINED why starri decisive failed. It didn't hold water based on the underlying ruling was unconstitutional. They even quoted ginsburg, who would know better than her.

    It's not radical to follow the Constitution. The decision to court made in 1973 was beyond radical. It was a poor interpretation of the law relating to the amendments and the Constitution.

    Thank you for calling the SCOTUS out. We blew past conservatism long ago, by the time McConnell decided to hold up any and all legislation and nominees proposed by the moderate left. This is what he paved the way to do, and the GOP as we know it now is not trying to say otherwise anymore.

    We will vote for those who still respect the rule of law and understand the difference between a democracy, a republic, states rights, Federalism, and what separation of powers means. These justices didn't do a thing to obliterate a woman's rights. Our institution, SCOTUS, opined correctly and made right a 50 year wrongly decided law. They returned back to the states and their people, to decide through their elected representatives, the right to make their own decisions/ laws. That's democracy which Liberals claim to revere.

    Honestly, the argument that public opinion shouldn't matter when deciding over the rules a society abides by and the country should forever follow the same set of rules that was put in place when it was established centuries ago seems nonsensical. The SCOTUS didn't just suddenly realize one day that those things were unconstitutional. The constitution actually contains a clause that was originally meant to protect slave trade (Article 1, Section 9, Clause 1).

    It's abusive, actually. Women are currently feeling terrified of becoming pregnant - even those who want children - because if something goes wrong, a woman could be forced to birth babies not compatible with life, forced to birth despite danger to the mother (and in which the timeline goes from risk to fatal is often unclear), forced to carry high order multiples because they can't selectively reduce, forced to carry in their bodies the constant reminder of horrifying traumas, forced to carry despite their bodies being too small to deliver without surgery. And for what reason? Because women are no longer protected by their country as full and equal people under the law. They are now subject to the whims of, usually, male legislators who think a 100 cell organism that is indistinguishable between what MIGHT become a child and the organ that MIGHT support is "a person". More importantly, that said "person" incompatible with life separate from the physical personage of another must be protected even in opposition to the actual person's wish to be physically responsible for continuing its development up to the point where it MIGHT have actual personage. Let's be very very clear. An embryo, prior to 24 weeks of development is 100% part of the host carrying it. It cannot, with any degree of medical intervention, "be" without that host. Like it or not, it is a parasite. The fact that it MIGHT have agency at some point does not make it a person at fertilization, 6 weeks, 8 weeks, or 12.

    Ruth Bader Ginsberg spoke to some Chicago Law students. She said Roe was based on shaky ground. She knew the right litigator could present a case that could over turn that 50 year old decision. RBG wanted the legislative branch to step up and put some of these rights into the Constitution, so it is protected like the court can protect the first and second Amendments. Remember, women did not gain the right to vote because of the court. Slavery was not abolished by a proclamation. These were done with Amendments passed by Congress and ratified by 3/4 of the States. This is how rights are enshrined into law. The Supreme Court recognized that this past week.

    Every decision by the supreme court that's split on partisan lines is NOT based on legislature and precedent, but partisan politics! This is ok in the legislative branch, but NOT ok in the judicial branch. Unfortunately the supreme court is partisan because they are elected based on their partisan pedigry! The only way to have legislation based decisions by the supreme court is to enforce unanimous decisions like some juries! Supreme court decision should not be based on majority, but based on law, precedence and unanimity. It is absurd that the outcome is based on who the judge is, instead of the law!

    At common law, at the time the Constitution was written and for eons before, abortion was fully legal until the fetus had “quickened”. This term means that at the time the fetus may be able to survive outside the womb. Not only was abortion legal, but it was encouraged and managed by women healers. Roe v. Wade’s timeline of unfettered right to abort up until sixteen weeks is based on the common law that did not define a fetus as a human being at the time of conception or at any time until there was a substantial likelihood that the fetus could survive on its own outside the woman’s womb. Furthermore, at the time Roe v. Wade was decided, the Southern Baptist Conference supported a woman’ right to abort an unwanted fetus, as did many other Protestant denominations. This changed when there was a major push by the Republican Party to capture the religious vote in an effort to shore up its dwindling numbers (Republicans are still in the minority). At this point, the Republican Party and the religious right are so fully intertwined they are no longer separable and attitudes towards a woman’s right to determine decisions relating to the governance of her own body hardened. A great majority of US citizens support a women’s right to manage her reproductive future and to determine if the circumstances of her life and health can support bringing a child into the world. Despite this, the Supreme Court majority-a cadre of male and one radical religious woman ( who, by the way is the least qualified justice to have ever sat on the court-literally, she has no real court experience and submitted only 1800 work papers, less than 1% of the usual submission for review) decided that they can better decide whether the woman can give a child the care that they need to succeed in a very difficult world: that is, 1) does the woman have the ability to provide adequate financial support 2) to provide the emotional support necessary to avoid mental health problems that will occur when a woman is forced against her will to raise children she does not want and 3) will the family unit or the woman herself suffer by the addition of a child. These are questions that can only be answered by women.

    Cleary, the first part of the 2nd Amendment is a context phrase (a preposition) to the second part which is the declaration phrase. Meaning that the right to bear arms is guaranteed in the context of forming a militia. That's patently clear, and any English grammar scholar knows it.

    Precedent laws have been overturned hundreds of time. If it's bad law, not meeting the Constitutional requisite, they should be overturned. The Dred Scott Case and Plessy vs Ferguson comes to mind. Nobody lied, you aren't very informed or just not very bright. You are either misinformed or didn't bother to see the confirmation hearings. Not one of the three justices said they wouldn't overturn precedent laws. They said they gave precedent laws great reverence, but didn't say they wouldn't overturn them. It would have been unethical for them to do so.

    Regarding Roe, the judicial branch is the only branch that can protect the minority from the majority. It has the obligation to keep the church separate from the state. There is no science that can tell us when a fetus becomes a person. Millions of people know all about the egg and sperm and chromosome and do not believe that the fetus is a person at conception. Million do believe that it is a person at conception. These are just beliefs, no different than countless other religious beliefs. Abortion affects only the woman and the fetus. The many that scream that abortion is murder are unaffected, except their own conscience. The courts must protect us from anti-abortion laws, because those laws are fundamentally about forcing beliefs onto others. We must pack the court with judges that can comprehend that concept. All 6 judges are Catholics. Is this a coincidence?

    They’re not consistent. If they were they wouldn’t have touched the NY gun law that was in place for 100 years. It’s either the states should make their own laws or they shouldn’t. This was clearly an agenda and undermines the legitimacy of SCOTUS. When did this country take back individual rights? There’s nothing stopping them from doing this again with our other rights. Idk how that doesn’t terrify you, especially since Thomas already came out with a list. Should we let states decide to bring back slavery, ban interracial marriage, etc? Will it then become ok for states to start forcing people to donate organs, blood? And are you saying you’d be ok with the state government basically invading your body? Or Is it ok cause it’s not your state so it wouldn’t necessarily impact you? And if states can force women to do this, why shouldn’t they force men to have vasectomies? Or force people to give up organs every once in a while? Roe was a super precedent, which means there’s a domino effect. It does not end here. Body autonomy is my right as a free individual. No person is ok with their body being used against their will.

They should not depend on the vote, respectively the "tyranny" of the majority, where people decide on the fundamental rights of others. Otherwise you could just as well argue that the right for a women to vote should be up to the states to decide or each town etc.

Formerly, the government at any level could not create an undue burden to abortion in the earliest stages of pregnancy, protecting individual freedom.     I can help with the second amendment. People argue over the fist clause but in reality it doesn't matter what we'll regulated militia means, but that doesn't mean it doesn't have any bearing on the amendment. The first clause says that a well regulated militia (insert your meaning here) is necessary for a free state. Whatever you think that means does not affect the right of the people to keep and bear arms. The second clause says because the first clause is true people must have arms so that they can join a militia. What it doesn't say is that in order to own a gun you must be in a militia.

    the court lost all respect in 2000 with Bush v Gore. it wasn't JUST that it was nakedly political, it wasn't JUST that the decision was nonsensical, it wasn't just that the sole reason the made the decision was to save the republican party from election defeat in 2002, it was that they declared the constitutional principles they applied do NOT apply to other elections. iow, they declared that the recount was unconstitutional, but that every OTHER unconstitutional recount could remain unconstitutional. and they remain unconstitutional according to Bush V Gore today.

    Mr Zakaria, I think you a missing the point on the 2a ruling. The NY State law's burden of proof on the Applicant that they need a Gun for Self Defense is absurd and unjustly inhibits a person's right to protect themselves, family or others. The Burden of proof should be on the state to show that the Applicant is unfit to own a firearm using legitimate reasons (felons, Domestic Abuse, Mental health) not just randomly stating we don't think you need it.

    The Women who cannot get their abortion should form a class action lawsuit against the 5 justice's for personal and religious discrimination in opposition to their Constitutional oaths! Which precludes them from claiming protection from redress. They should also claim being held hostage by those Justice's and forced to Indore; Psychological abuse (during and after the birth for their entire life.) Physical abuse (most may not be able to recover from, could cost lasting health issues, and could cost their life.) Financial theft (for all the cost incured during and possibly after the pregnancy.) -- & in some cases Child abuse (for those molested children who will be forced to give birth to a child!) Get yourselves justice! It will be fought all the way to the Supreme Court when they will have to recuse themselves!!!!👀 Whatever a woman decided should have been between her and her God!     For now, they're using the precedent established in Brown v Board as a justification to overrule the precedent in Roe v Wade, so they will most likely keep it until it is no longer useful. But they've stated their next targets very clearly -- in the ruling against Roe v Wade, the Supreme Court indicated they plan to review cases such as Griswold v. Connecticut (which protects the liberty of married couples to buy and use contraceptives without government restriction), Lawrence v Texas (which ruled that criminal punishment for sodomy was unconstitutional), Loving v Virginia (which struck down state laws banning interracial marriage), and Obergefell v Hodges (which ruled that the right to marry is guaranteed to same-sex couples by both the Due Process Clause and the Equal Protection Clause of the 14th Amendment). Each of these landmark cases, in whole or in part, is based on the legal precedents established in Roe v Wade. And with that foundation removed, all it takes is a single legal challenge from a single state to strip even more freedoms and choices from us. This is not a path that will end well for any of us, regardless of which side people are on.

    Fareed entirely misses the point. It is not precedent but the issues of substantive due process and unenumerated rights which are the keys. The most famous cases in constitutional law are those where bad law precedents were overturned. The Roe decision was debatable from the outset. Giving power back to the states, their legislatures, and the electorate could be viewed from a variety of perspectives.
