    I don't even care about monetization but I still wonder why videos that are clearly commentary which is under fair use get taken down just because KZread is hiring freaking ai to tell if the video deserves copyright in the first place. The whole system is corrupt like bruh!!!!

    It amazing she can state that its a law twice and people still blame them lol. The law was intended to help people who WORKED on the original project. Examples are anyone who works on film sets, video games, or other entertainment that wants to put it on a reel or resume later down the line. IT WASN'T INVENTED to give youtubers rights to copy-paste and profit off of other peoples content exactly 40 years later....

    however this is their platform still they involve in it. that why they do so many auto detect system about copyright.. . in simple word, they also want we to create completely new original video. but that also big problems for me croz lack of idea & shy to record myself. maybe i should record my cat dance "tiger show" later.. 😁😁😁👌

    @@LunaticMode Problem with the auto detecting algorithms is that it also picks up content that really is fair use. Using copyrighted material in the spirit of fair use does create new original content. This process that YT has hurts the creation of original content.

    There are so many creators, like Thunderfoot, that constantly use copyrighted material and long clips in their videos, and claim fair use, but never have to take them down. I also see many people performing full covers of copyrighted music without their videos being taken down. I don't understand how this happens when it's so easy for others to get copyright strikes.

    KZread will take it down, then you claim it is fair use, back and forth, and the end of that process you will have to go to court to defend our rights. But, that is the point almost all the fair use claims by the claimers are dropped and your video is restored.

    Why Would copyright even apply on KZread? why are policies like the three strike's implemented for copyright?. If there's no fair use applied on KZread any content should be fair gain.

    I have no idea why KZread hasn't incorporated a revenue sharing system for copyrighted material based off of an algorithm that pays a certain percentage of a monetized video to the copyright holder based on how much was used! That would be a win-win for everyone!!!!

    Ok men need your help here.As i understood from your answer, if I am starting a channel which is GENERALLY about music(so i will tell the biorgaphy of an artist for instance,) can i use copyrighted content without any fears for BAN? And does yotube ban videos in which there is copyrighted music or only demonetize some of them?

    @@OmniphonProductions thanx for the answer. Do you know anything about uing parts of other videos from youtube(maybe a few seconds) and parts of actual film in context of your video. Can youtube immideatly detect it and what are the consequenses ban or demonetization of its ok to use?

    I have to say I do appreciate the extra requirements KZread has added for those trying to claim videos. Especially letting us know what the specific problem is when there is one. No one likes seeing that yellow $ or getting that claim email. Personally, I've found that "transformative" is the most important for video. And I never ever use any copyrighted music. There's so much copyright free and creative commons 0 music out there! I look forward to KZread putting in place even more creator-friendly strategies regarding Fair Use. The more transparency we get, the more creative we can be! It's starting to feel much less adversarial with, and again, it's much appreciated! Now, if I can just figure out how to get videos suggested 😉. Cheers

    @Connor Welch not everyone has the option to go-to court. It is an expensive endeavour, and there is no guarantee you will get enough money to break even , if you win. It is KZread's responsibility IMHO. They made a system that is easily abused and have become complicit with it's abuse. There needs to be a built-in consequence for abuse. As it stands, I think KZread should be labeled an accessory on the cases that go-to Court. Maybe after that, KZread will reconsider the system in place.

    It seems impossible to find real world examples of KZread videos that are and are not fair use. Even searching the US government's website for past court cases about fair use, there's only a tiny number of cases involving this. We need more examples to better defend our works

    Since only a judge can decide if something is fair use, bigger copyright holders just have to threaten lawsuits or demonitization in order to win. Fair use (or any American law, really) is only as fair as the amount of money in your pocket.

    "Fair Use" can truthfully only be determined in court. As a platform for media hosting and sharing youtube can be held liable for the content they are hosting. Hence why things are the way they are on the site. If things are going to change it has to be done on a legislative level first

    It really is time that this was standardised. How are we as creators supposed to do our work if we constantly get claims and strikes? I teach guitar. How am I supposed to teach a song that I'm not allowed to play? Even if I don't use the original video or audio and simply perform the piece myself, I still get copyright claims. This appears to be getting worse of late. Perhaps an Organisation the size of KZread could be doing more to protect creators rather than passing the buck? Frustrating to say the least.

    this doesn't explain why copyright holders are the ones who hold all the power regarding disputes. youtube's default "we dont decide fair use" statement is a convenient cop-out that absolves them of any responsibility to address a rampant issue of copyright abuse from big companies like UMG that's plagued the site for years.

    Currently all the so called fair use claimant has to do is claim fair use and then KZread restores the stolen video and the only other recourse is to take the person who stole it court.. We hold all the power? Only until the person who stole our video says they didn't by claiming fair us

    They don’t. If they take down your video and you know you’re in the right, you can always file a lawsuit against them. Whether that’s worth it is up to you.

    because they are the owner.............. You guys don't seem to understand that this is LAW, not something youtube decides, as she stated twice.... "Fair use" was invented to help people who WORKED on a project to be allowed to use it later down the line. Think of all the people who work on film sets and want to clip it later for their reels, ect. It wasn't intended for people to just take other peoples work to improve their own.

    KZread doesn't decide anything, because no human looks at your claim/appeal. It's all done by A.I. routines. Google has worked very hard to insulate themselves from ever actually having to deal with the 'little people' who use their platforms and who create the content that make them profitable for Google. The only time a human gets involved is if a dispute garners negative media attention.

    Im not even going to watch the video after I read the comments. These kind of videos from KZread are the true reason they disabled dislikes. It’s a shame how less they care about their creators. People put their love, life and soul into their channels just to get them false striked and possibly deleted.

    True story: Paramount PR invited me to a screening of one of their Mission Impossible movies for review. I made a video talking about my thoughts on the movie and ranking the Mission Impossible movies using some of their trailers video edited over me talking and criticizing the movies. Years later Paramount claimed the video - I disputed through YT and said it should fall under fair use but Paramount responded with a manual rejection. I ended up just deleting the video since the views weren't so high but it's annoying when a company invites you to something for review - you make a review video and then they basically kill your video (even after praising the movie).

    We know where you are coming from but sometimes it can be hard to understand why a rights owner has claimed your video, but that doesn’t mean they’re not authorized to do so. You can always dispute a content ID claim that you believe was made in error: yt.be/help/LKJN. Hope this helps!

    This is very informative. One thing though, When people complain that their entire video got claimed for a two second copyright protected clip, they aren’t necessarily suggesting that two seconds is short enough to be considered fair use. They are saying that it’s not fair that the entirety of the ad revenue for the video now goes to someone that only owns two seconds of it. Your platform desperately requires revenue share.

    @TryHardNinja I generally agree with you, however I have exactly one viral video and another channel's author used a few seconds of mine video and of two other guys videos a) without my and their permission nor notification b) without any mention of origin c) he added paid advertisement to his video d) he made preview clickbate using stop frame from my video e) he claimed my strike as fraudulent one I won't go to court just because I have no spare time for that. I have less than $100 earnings for my entire channel a month, so I see no financial reason to sue that author. However it would be fine if he asked for reuse first, and added some link to my channel or my video he copied. Am I asking too much?

They don't need to do any of the things you are complaining about under fair use, and yes it sounds like your copyright claim was a frivolous one. I can almost guarantee that you would have lost if you would have taken it to court, so it was lucky you didn't. On top of that you opened yourself up to being sued yourself.

    Twice I pulled music from the KZread Audio library and it was flagged as copyrighted. The second time, I went through the dispute process and had to wait 30 days for the video to be able to be monetized, even though it was KZread's already-approved music.

    When I’m using music in my videos, I normally just stick to copyright free music, but there have been songs that I’ve been using like a “You Spin Me Round (Like a Record)” remix made by Tallcat-Man I had been using throughout October, but in November, I was getting claimed for it, i’m not sure if they were falsely copyright claiming me though, it’s a remix of the original song, which means the content has been significantly transformed, so it doesn’t make sense that I still got claimed :/

    Okay, KZread... explain this: I received a copyright claim because I played a piece of copyrighted music even though it should clearly fall under Fair Use. 1. I played a piece of music the original artist submitted to me himself, for the sole purpose of playing it on a live stream and giving him feedback on the production. 2. The content was educational in nature and the original artist benefits from it by learning something. 3. His piece of music wasn't the only piece played and critiqued, there were many more over the course of the stream, meaning the sole purpose of the stream was NOT to spread copyrighted material. 4. The claimant and the artist being represented are based in the US, so US Fair Use laws apply and thus the above-named things should be taken into account. I, of course, disputed the claim since this should be considered Fair Use, the dispute was rejected. I then muted the audio of that song in particular, because live streams and donations are a big part of my channel and I can't risk losing those. However, the fact that the claimant rejected my Fair Use dispute even though it's a clear cut case of Fair Use is what is a problem to begin with and this all ties back to the horrible system KZread uses where claimants get to decide if my dispute is right or wrong. So this video specifically says, that only a judge can decide if something is Fair Use or not. So why then is it, when I file a dispute because I believe the claim is indeed Fair Use, that the claimant gets to decide over that and not a judge as you say? There is no court case until it reaches the point where the damage to my channel is already done! The claimant decides if my dispute is correct or false... If they reject it, I can appeal that decision, however with the risk of putting a copyright strike on my channel, limiting my options for live streaming and receiving donations, which are the two things that keep my channel going. So, not a viable option to risk that. Only if my appeal is rejected again it'll become a court case, but by that time, my channel will already have a strike on it limiting my channel severely. So we can safely say, this is not a viable option for me to take. KZread keeps specifically stating in this video they can't decide if something is Fair Use or not and that only a judge can, then why is that not happening when I dispute a claim based on Fair Use? You are literally proven yourself wrong with this exact statement in the video. When you drag somebody into court, that is a fight between 2 parties and the third party, the judge, is the one to make an unbiased judgment. You are not going to let the defendant or accuser decide on the result of the court case right? So when I receive a copyright claim, why is there no third party to look over these? Why is the claimant the one to decide if I'm right or wrong? That is like having a court case and letting the accuser decide if the defender's arguments are false or correct. KZread should have a team of copyright specialists looking into every single copyright case as a third party overlooking the process to make sure things go the way they should. And then I haven't even talked about the copyright claims that I constantly receive when I'm making music on KZread, claims on videos where the video itself already disproves the claim itself and therefore should never be appearing on my channel in the first place. The fact that I receive claim after claim on content which is clearly my own is a big sign something is horribly broken when it comes to copyright on KZread. So, instead of ignoring all my tweets, comments, emails and other forms of contact I tried, maybe it would be wise to at least come back to me with an explanation like you would expect in the case of a KZread "partnership". We creators signed an agreement to be in a partnership with KZread, yet we creators completely lack the amount of transparency and communication you would expect from a true partnership. So, is it really a partnership or does KZread simply call it that when it actually isn't? As a creator who has spend a lot of time on this platform since day one, I can sadly say that I'm reaching a point where IF a new platform equivalent to KZread shows up, I would not hesitate one bit to jump ship. And as a creator who has put thousands of hours into his channel, that is a very hard choice to make. However, we've reached a point where things are so broken, KZread is moving into a direction that is favoring big corporations over the independent creators who have been the reason of the success of KZread, and I absolutely don't like that. If during this entire wall of text I have understood something wrong, then please KZread respond and explain it to me instead of ignoring me making matters a lot worse. I signed the partnership agreement years ago, but until this date, I have never received any help when it comes to issues with my channel, nor has KZread ever responded to any of my questions I asked them... Now THAT is a great partnership... not!

    How are music analysis channels even supposed to work then? Do you just talk about what you are referring to instead of playing at least a 5 seconds clip of it? That makes the video lose a lot of educational value, if not all of it.     Official answer is "deal with it." you have to bear with it, get dmca'd, go through the process and argue fair use in court. The biggest argument will most likely be "Market Usurpation." example if its a song and people go to your vid just to listen to the song, you clearly usurped the songs marketability. And it would be up to you to argue in court that examining 5 sec of a song for educational purposes doesnt usurp the market. So yes, its abuse.. But youtube doesn't care

    Unfortunately for the record labels out there they actually will lose in every court, and their only option is abusing the manual claim system and scaring people. The starting and stopping of the song, with your voice added with commentary about the music is in fact protected by fair use. By the same standard though you introducing a song like your a DJ or MTV VJ is not covered in anyway. Education, Critiquing, and some forms of Sampling are protected, simply put using the entire raw audio in a video is not ok. There is a lot of ways around this but thats not the point.

    KZread is pandering so heavily to the corporations in this video. "Only courts have the ability to decide" is KZread saying "We won't treat it as fair use until the courts decide". Look at how they threaten creators by saying "Even a few seconds may not be deemed fair use". This is how they convince you that removing content automatically without any legal action being taken by the corporation is reasonable. How can you have a fair use doctrine when every video, even those that fall under fair use, is swiftly removed from the platform when even a few seconds of material is caught by its copyright checking robots? This is "guilty until proven innocent", not "innocent until proven guilty", and it is truly unjust.

    From what I can tell DMCA muddies the water. It forces KZread to remove videos or risk being sued for inaction. So KZread is playing it safe for themselves by going over board and removing fair use content. I think if the law was updated to make the type of copyrighted content you have to remove more specific it would help.

    If you dress up as the Joker, act like the Joker and in no way change anything about it as well as monetizing your video... it would not be fair use. WB owns the on screen likeness of the Joker and you could essentially cause them to lose money (not really likely) from their version. So not fair use. If you parody the Joker in some way, it would be far safer overall.

    Here's a massive problem with KZread's "fair use" approach, however. 02:41 "Companies are claiming just a few seconds of a video. How is that not abuse?" Ignoring the "lol just use 3 seconds of audio and it's fine" nonsense people try to pull - copyrighted material for only a few seconds of a video DOES NOT at any point in licensing of copyrighted material result in ALL OF THE EARNINGS of that video being taken. There's so many elements of copyright-able work in a single video, that just copyright claim of the composition or recording of a song should NEVER take the entire revenue of a video. Period. This is a lazy, stealing method of not providing a tool for creators to license out these chunks of material. Sure, not every publisher will allow such licensing - but many do, KZread just isn't facilitating that.

    A lot of those Cobra Kai videos on KZread I'm sure is not fair use copyright because I'm sure them channels are monetizing off of them but the KZreadrs keep subscribing to them by supporting them breaking the copyright law, so they continue doing it.

    So in other words, it is harder than sh*t. KZreadrs make it look so easy, and the American manner is to always tell you "oh you can also do it" because apparently most people live in a fantasy bubble; and that "encouragement" at the end only serves to your downfall, because it takes a lot of a heck of work to learn by trial and error, tripping and falling, than anybody would ever let you see. They tell you "you can do it" as if it was the same easy to do it as to not do it. Next time they tell you "nobody said it would be easy" reply right away "yes you did! by saying 'you can do it'", because they say it to make it sound easy. People (acquaintances, friends) should only tell it as it is, with both your chances to succeed and to fail, and only at the end give you encouragement to do anything you want to do.

    This is just a nice way of explaining how great corporations are basically taking over youtube. Most of us, contents creators, know that companies have been striking us mercilessly for using a few seconds of their material in what would clearly classify as Fair Use. Those false strikes are being designed to actually take control away from contents creators.

    Thank you for keeping us within the loop with the KZread Creators series. I have a copyright question that I was hoping someone could help me with. I'm currently working on a video and want to mention, within the opening, "In admiration of Sergio Leone" (the famous director) - is that ok to do? Within my video I will be using music from within YT's video library, the opening sequence of my video will be similar to one of Leone's openings, yet the artwork will be my own unique creation. Is there any sure way to know, beforehand, if I'm crossing any legal boundaries? I have read the YT TOS several times yet seem to feel that I may be within a gray area with this idea. Is there any way to know for sure, or have the video reviewed BEFORE I publish it? Any help or suggestions would be greatly appreciated: Thank you!

    There is no "court" on youtube. The copyright holder is the judge, jury and executioner. If they detect their copyright in your footage, THEY get to decide what happens. Its completely unfair.

    4:05 Automated systems like content ID shouldn't be able to automatically demonetise someone's video. It should be able to notify potential copyright claimants, but that's it. Since fair use is in your own words "subjective case-by-case decision", you CANNOT use a guilty until proven innocent' approach. That is objectively wrong.

    j travolto if u use copyrighted content thats not yours the owner most can do is take it down and give your channel a strike,but as you said you are going to use copyrighted songs then -you can reupload them but you most probably won't make any money from them as the video will get automatically monetized by the owner

    Question let's say I am playing truck simulator and want to show gameplay, but I have the radio TruckSIm FM or something playing all the latest songs, even though the video is about the trucking and the radio is built into the game to be played within the game all the songs are copyright and so is this fair use or a no no?

    @@ReaIIyRichRecords Pretty sure you can but just checking as I keep getting copyright strikes and have to mute gameplay as the music in it gets flagged as being copyright, I suppose the music in the games are licensed for personal use and not to be recorded and uploaded onto KZread or other places

    If you plan to include copyright-protected material in your video, you’ll generally need to seek permission to do so first. KZread can’t grant you these rights and we can’t help you find the parties who can grant them to you. You’ll have to research and handle this process on your own or with a lawyer’s help.     @@Jaa_morant No, I uploaded a video featuring about 6 songs that sound similar; comparing 5 second clips each. I am not monetized and only have like 5 followers but YT deleted my video and gave me a 1/3 strike on my account. It was automated, nothing taken to reason

    I’m so tired of watching KZreadrs try to comment on videos, but can’t because it has some background music. They always have to muted the video because of “fair use”, making the commenting impossible.

    @@MichaelGlennglennimages An example is when a really boring video is being used for the purpose of criticism, which is valid under Fair Use, and the original copyright holder being criticized makes a claim not only because they don't like what's being said about them, but also because the new, edited, and highly transformative video gets more views.

    @@ursonate yes that is correct. The chance of losing a fair use case in that specific instance is unlikely. Although if one wanted to sue for it they could. It would cost them time and money.

    One thing that would help *_immensely_* for music problems, is for KZread to allow & keep multiple audio tracks in uploads. That way, any music that is NOT in the same track as the creator's voice or main audio can be safely removed without affecting voice or main audio quality. This way, it lies on the creator to record and/or upload with multiple audio tracks so these things can be separated from the start.

    The rules of fair use seem to be at the whims of some esoteric algorithms decision. I've had music that claimed to be royalty free get flagged one once video while the same music was considered fine on another.

Copying all the big KZreadrs will get you nowhere because EVERYONE ELSE is also doing it. I only post things that I would want to watch myself.

    @@rka1010 I make videos out of my opinions. Something that I wish people would care to watch.It doesn't matter if nobody watches them. I don't really care much about being a huge youtuber. I just love making videos and as I have free time, i will try keep making them.About KZread they are definitely more into promoting channels that post movie trailers and music videos, which is not balanced on content made on KZread. How to videos and motivational videos deserve their own place in this platform.

    ​@@wisevoice5393 How to videos and motivational videos are the only things I ever get promoted to me these days. You need to realize that everyone on KZread is seeing something different. They are promoting music videos and movie trailers to you because that's what you click on. If you want something different, you have to search for it and click on it, and keep doing that. There are billions of videos on here about everything, and most are not going away anytime soon. They are encouraging us to do original content because it saves them the hassle of dealing with copyright strikes. The more we comply, the more carefree money they make.

With professional looking thumbnails like those, they should at least be getting clicks. Also you're not one to talk about doing things everyone else does. Clips of TV shows and movies and gameplay videos with or without commentary are a dime a dozen.

    @@TheOutThereChannel the keywork here is clips and assuming the clips were used in a transformative piece of content why is this claimable? you always have to ask is it: "transformative" is it "educational" is it "a critic" the problem here is most of the time these things are often debatable and youtube doesn't have the authority to say one way or the other, unfortunately they are between a rock and hard place and have to allow people to report such things and this reporting system is hugely open to abuse by people who don't care or simply don'y understand these things.

    actually, I think she said, YT knows nothing, sees nothing, and DOES nothing.... unless you're big media.... it's all so rigged. CNN/FOX could run a 45 minute segment on the Batwoman on CW showing virtually the WHOLE episode and nothing, you can't play 12 seconds of the trailer and critique it. watch this video a few times, there's more double talk in there than there was in the last debate!

    Yes Bec, if you are using someone else's work to try and profit it doesn't matter how much money they have or you have, you are breaking the law and they have every right to sue you. Don't use copyrighted material unless you actually know what you are doing and are prepared to spend money defending that position in court.

    @@PrimalEdge There is no two class system and this isn't a KZread thing. This is copyright LAW, if you don't like copyright law talk to your government about it. In terms of your example, no CNN can not just run a whole episode of someone else's content and get away with that. CNN and The CW are both owned by Warner Media. CNN can run as much of an episode from the CW as they want as long as the editor approves it with corporate. What you're describing is called cross promotion. Further to that point, you also seem to fail to understand behind the scenes licencing. Large media groups have entire media departments filled with lawyers. They know what they can and can not get away with under the law, but where they want to use someone else's work they licence it just for safe measure. So let's say CNN wanted to play a clip shot by the BBC, they would contact distributions and licencing at the BBC News desk and pay a fee (usually somewhere from $500 - $5000) to licence that clip for the express use purpose. No copyright is violated because they have permission.

    TJ Marx I’m not really sure if you accidentally wandered here or not, but this is YT. You might want to check it out. Maybe see some of the hundreds of thousands of hours of content out there where people are critiquing movies books TV shows video games and pretty much anything and everything out there that is copywritten. The only reason this copyright fair use issue has come up in the last year is because big media has moved off of their platforms on to KZread. And before you respond go out there and check the hundreds of thousands of hours of people that have Paul proof that their stuff has been demonetized where in the past it has not. The fair use laws haven’t changed, the content creators have grown. And this all happened right around the same time KZread has made a large push towards throttling back on “non-confirmed media outlets“ and there’s tons of videos on that as well. Ever since all the big media companies have piled onto KZread and started monetizing their channels on KZread all the other content creators who have been enjoying monetization for over a decade have started to see Demonetization and D platforming as well as having videos removed. This was never an issue for almost 15 years it’s only come up in the last 18 months. Check the fax. This is not my opinion, this is me watching it happen first hand.

    There is no requirement under fair use to give a credit to the original creator. You could even be opening yourself up to being sued doing this.

    I have a copyright claim on one of my videos for using a free stock footage clip from a website that states right next to the clip that it's free to use and no attribution is needed. What I have learned is that KZread will let anyone claim ownership of a creator's video without investigating it, so basically anyone can steal ad revenue just by saying that they own a portion of your work. This system is seriously flawed.
