They referred him for criminal charges in federal criminal proceeding, that does not matter. a conviction by federal or state court is irrelevant in this matter since it cannot evoke the 14th amendment, that is described in detail in article 3. The due process for It is independent of criminal proceeding conducted in other courts outside the scope of congress or the supreme court, in accordance article 3. The house has to bring up and vote on it, and pass, then the senate has to do the same. Once that is done the supreme court has the final say so in whether or not he qualifies, since the language in the article does not include the president only members of congress and officers. I doubt it will pass the house because of the republican majority, and if it does I doubt it will pass the supreme court with the conservative judges voting on the matter. This is going nowhere, he will be on the ballot, and his arrest did more for him than any campaign could ever do.

Section 3 of the Fourteenth Amendment prohibits ***anyone who has previously taken an oath of office*** (Senators, Representatives, and other public officials) ***from holding public office*** if they have "engaged in insurrection or rebellion" against the United States. The 14th Amendment Section 3.. states anyone who has previously taken an Oath, from holding public office... that also means the president and vice president are public officials..

You can't. It applies to the sitting president and it can be applied to Joe Biden. This does not apply to DJT and it is not applicable because DJT advocated for the Constitutionality of the Constitution which gave him the rights and the authority to do what he did. He essentially told the nation to exercise their Constitutional rights, to have all and ALL THE BALLOTS VERIFIED because they were not.
The 14th amendment does apply to Trump, he has a right to due process according to section 1 of the 14th amendment.

"Wikipedia" - In 1866, Stephens was elected to the United States Senate by the first legislature convened under the new Georgia State Constitution but was not allowed to take his seat because of restrictions on former Confederates. (not invoked?, not true.. better check your history books.)
