At least in California, the DOJ/FBI fingerprint background check is governed by the dissemination criteria applicable to the request for live scan service. If FBI level service is requested, the cumulative rap sheet forwards from the FBI back to the DOJ and the same criteria is applied to the federal or out of state information. In other words, it discloses or not based upon the type of position sought and the current status of the record. As you pointed out, licenses and law enforcement always see it no matter what, but even for a regular government job the DOJ/FBI report does not show the expunged record for that purpose only. In that situation, only the DOJ technician can see the raw data on the report, and must report back only which is disclosable pursuant to the request and California law, which states that on the "communique" as the so-called final response report. Also, with regard to private sector employers, in most cases the record purges from the court files according to the government code after a certain time period so it cannot be seen in any form, i.e. where is says the charges and that they were dismissed. Commercial background checks can only access and copy public records and not your live scan, so once it purges it is not visible to them even in "dismissed" form which is where the expungement may be considered second rate to it having never happened.

Question, what about background checks for renting purposes. Airbnb or just apartment rentals?
