    I watched every minute of every court day. Brian Albert, Brian Higgins, and possibly Colin Albert committed murder!! If Norfolk County is serious about law and order, and seeking the truth, they will put all three of them on trial, convict them, and send them to prison!! Along with Jen McCabe, and all others involved in the cover-up! For folks who are short on time but want to really understand the defense position, watch the five defense witnesses in the last three days of the trial. Compelling!!! The FBI should take the lead in investigating 34 Fairview Basement and Bulkhead, and the Sallyport tail light corruption!!! Good show Vinny as always.

    Bonnie, you said you want phone GPS. John’s GPS was on. It proved he never went in the house. That was demonstrated in trial by the Lt. It showed him in the yard at 12:24 and never moved. It showed it was impossible for him to have gone into the house. All demonstrated in the trial by MSP using GPS.

    Why is nobody discussing that there was NO SEARCH of the Albert's house. Notwithstanding that the crime scene was outside, any normal investigator would certainly have secured the house as a possible crime scene and done a thorough search of the house and all of the rooms of the house to eliminate them for being connected to the crime. This case screams COVER-UP and malfeasance by the police and investigators.

  • @johndevlin

    @johndevlin

    Ай бұрын

    I think you're getting ahead of yourself to complain that there was no search of the Albert house. There wasn't even a search of the area where the body was found! Several possible eyewitnesses to the collision (Sara Levinson, Brian Albert Jr., the other people in Ryan Nagel's truck, Lucky Loughran, Caitlin Albert and "Trissy Tightlips", etc) weren't even interviewed until Proctor found out people were getting federal grand jury subpoenas sixteen months after the crime. If this investigation was being done in good faith, in the genuine belief that it was a vehicular homicide, why didn't Proctor ever arrange for a comprehensive search of the accident scene? Why didn't he at least try to interview everybody he had reason to think might have seen the collision? Why wasn't the location of ANYTHING measured? Joe Paul's collision reconstruction is based, in part, on a second-hand *estimate* of where O'Keefe's body had been found. Trooper Joe Paul got it from Lt. Paul Gallagher, who wasn't there when John was found. Some unidentified person told Gallagher that O'Keefe was about seven feet from the curb, and Paul just ran with it.

    @@oiooi6460 The search team arrived at 5.45. The car was taken on a 15 minute drive at 4.16 but Proctor 'mistyped' and wrote that it was collected at 5.30 to cover the missing 1 hour 15 minutes. So they had the vehicle for over an hour before the search team arrived. The tow driver said he left the car outside the sallyport so it's easy to smash it, drive 5 minutes away to 34 fairview, lay the pieces and return to the sallyport before the search team got there. Also a search team had already searched the area, when the snow was softer and before it had been treaded on making it easier to see. They took the leaf blower and moved the snow all the way to the ground but there was no taillight. Taillight was found only after Proctor took the car on a 15 minute journey that lasted one and a quarter hours. That's how the 2nd search team found things. And even though they had shovels its strange that they didn't find all the pieces. They just magically appeared after 2 sets of police searched.

    I'm mainly interested in seeing whether the prosecutors will ever show that they're capable of feeling shame. They probably never will; their usual practice is just to ignore new exculpatory information as it arises. But maybe someday? I was looking through the "Statement of Facts" in their last pretrial filing this morning. It says Jen McCabe texted O'Keefe at 12:31 ("Hello"), 12:40 ("Pulll up behind me"), and 12:45 ("Hello"), and that she "observed the black SUV drive away from the house" just after the last one. It's now incontrovertible, from the state's own evidence (Nick Guarino) that the absolute latest Read could have driven away from the house is 12:33 (her first ping off a cell tower other than the one nearest 34 Fairview), and that's if she drove back to 1 Meadows at more than twice the speed limit (there is no evidence that she was speeding at all). So, we know Jen McCabe texted John at least twice (probably three times) after the SUV left. The 12:40 text clearly implies that she can still see the SUV, though it had been gone for *at least* seven minutes. Worse (and I cannot understand why the pretrial filings omit this), she also called his phone seven times during this period, including six times between 12:41 and 12:50. These calls were all deleted from her phone (though not from John's) and she claims they were butt dials. She sent a fricking text after the third call! I think any reasonable person has to admit that this is at least a *bit* suspicious. Incidentally, John's call records also show that he *answered* Jen McCabe's call at 12:29:44 and was connected for 8 seconds. So, until 12:29:52. According to the prosecution's new timeline (from the closing argument), "trigger event 2" (24 mph in reverse) happened at 12:30 a.m. Does this still work? How did Jen McCabe repeatedly miss seeing the body out there in plain view and not 60 feet from where she was standing? What SUV did she see driving away? Was that a different SUV? How come that one didn't see the body on the lawn? She called John at 12:29, got an answer (presumably him saying "I'm here"), then this horrific collision happens at 12:30, then she texts him "hello" a minute later? And she deleted that call? I mean, WTF!?

Even if they have the right person, the investigation was so badly done, and the evidence is so contaminated/ manipulated that there an be no justice from it. The investigation is being investigated. There was so much misconduct that justice simply isn't possible unless someone comes forward and confesses. The evidence doesn't match the state's story. "Evidence" that doesn't show up until the trial starts? Evidence that's effectively missing from the record for nearly 2 weeks... That's not justice. If the family and friends REALLY want justice, they would be willing to look at the TRUTH, which is he was associated with some super shady people. It's easier to blame a girlfriend that no one likes than it is to admit that the victim's own friends might be the cause. That's NOT justice. Justice would be finding the truth no matter what it is, and holding the RIGHT people accountable. No one seems interested in doing that, so I am sorry to say, there will be no justice.

    Did any of the people on the panel follow this trial? Higgins AND Brian Albert destroyed their phones and threw them away after they were told not to! The defense questioned all of them about the phone calls and texts that they were allowed access to. I think these people on the panel fail to understand that if the CW doesn't want the defense to obtain information that could hurt their case, Bev has zero issues telling the defense they can't have it. In pretrial, the defense had to fight for what phone records they actually were able to obtain from the McAlberts. Bev and Lally accused the defense of going on a fishing expedition when they requested the phone records.

Maybe they feel she was abusive to him. Maybe they feel she set wheels in motion that fast forward, resulted in his death. Questions: the motive behind the killing? Did John discover something in the Dept? What cases was he working on? What are his injuries consistent with? Why would the girlfriend be used as a cover up? Who picked up her car? Why didn’t the individual driving it up the ramp get details on the cars condition first so as not to be blamed for damage? Why was a trooper involved in this case. Does the dept have a extensive relationship with him? Why were so many in the house?

When he could get away with saying such savage stuff about KELR TO HIS SUPERVISOR and get away with it. It can only be the Culture of his department. He can’t be used as the Scapegoat, his Supervisor must be held accountable as well! His Supervisor is and should be his Mentor. That Supervisor she be held accountable every bit as Michael Proctor. If one must go then both of them need to go immediately! I’d love to know how M Proctor explained to his Mother how he could be so degrading to another woman.

    @MaureenODonovan Trpr Guarino testimony on Direct Qstning said the black box ie the chip w the data was destroyed from them trying to retrieve it. That's why Trooper Paul had only a little to work with (Key cycles only, without the GPS and time of day assoc to key cycles). If the full Blackbox data had survived, then this would have been over, either Karen exonerated or not. So given that why would Norfolk Co DA/Troopers not pulled out all the stops to preserve it? Why not get FBI experts to do what they do best? Mistakes like that are what leave such Qs in Peoples/Jurors minds. It starts to look shady how many mistakes the police made. @DutyRon, Ed Wallace, @JoeGiacalone and many more are aghast at how accepted police processes weren't followed, ie like no witness statements were taped nor signed statements. Etc. If police do not do their jobs properly, sadly a case is never going to be successful.
