Essential Updates on IHSS Parent Provider 2024 Guidelines!

In-Home Supportive Services (IHSS) recently announced some major changes to who can be a paid provider for their child. If you or another family member have been unable to be a parent provider because of full-time work, full-time schooling, or another restriction, these updates may apply to you!     I plan on moving in with my mother from another state. She already gets IHSS for my disabled adult brother. However, when I move in with her, I would like to have IHSS help me with my son who is severe with autism. My question is, would I be able to qualify with IHSS living with my mother while she receives IHSS for my disabled adult brother?

    Hi hoping you can help me out with a couple questions I have. 1)They are lifting the rule that one parent has to work full time in order to get PS? 2) I have extra hours between my 2 kids. Is my husband, who does work full time, able to sign up to be a provider and claim the additional hours?

    Yes and yes! Also it wasn’t in order to get PS, but in order for a parent to be the provider. Hope that helps!

    What if you have protected supervision and they are 18 can you work full-time while they’re in school. My son leaves the house at 6:40 AM and comes back home at 4 PM.

    I lost my job due to my son having leukemia and I’m his provider but I only get 3 hours a day for taking care of him full time is that fair in hours? I tried to ask for more hours but they denied because they said I’m his mom he’s 9

    Hi Cece, our apologies for the delayed response. In speaking with our experts they said that you would have to see the NOA to really know because it’s based on specific needs relative to other kids his age. If he doesn’t have developmental delays then there might not be a ton of hours. Our specialist suggests that you may want to look into Paid Family Leave if you haven’t already. Hope this helps!

    What if it's a two parent household and one parent is working full time and another parent is working part-time. Can the parent working part time be the provider?

    Yes! The parent employed part time could always be the parent provider if the other parent was working full time. What’s changed is that the parents’ work status no longer matters.     I am my daughter’s provider and she gets 280 hrs a month for protective supervision and she’s in school during the day, she also gets SSI once a month. If I find a part time job during the day while she’s in school will that disqualify her for SSI benefits??? 🤷‍♀️

    Hello! It all depends on how much money you make. IHSS income is exempt but anything you earn from part time work will be counted when they determine the child’s eligibility for SSI. We hope that helps!

    280 hour's a month,Plus SSI and Looking on trying to fit in a part time in your schedule, how does that add up? My son has a genetic rare condition they award it him with 70 hour's and can't fit a part time because SSI gets involved in manipulating his medical in case I get a part Time. What is the catch here on trying to get another job to help meet the needs to have a roof over our heads with one income.

    @@ruffraff4697 Hello! The catch is that it impacts SSI eligibility. But some parents don’t have 283 hours and they were prevented from being their kid’s provider even if they only got a few hours a month. In other situations the child would have the hours but be unable to use them because the parent was not eligible to be the provider but was considered available, so nobody could be paid for the IHSS hours. They’re not saying they expect anyone to get a job or that you have to - they’re just saying it’s allowed. Hope this helps!

    I am my child’s provider and my husband just retired. Will he have to get another full time job for us to continue to receive IHSS? The wording is not exactly transparent. Thank you for your help!

    Hello! Yes, provide them with a link to our article or video about the February rule changes for IHSS parent providers. Either way, the child’s eligibility for IHSS is separate from whether the parent is eligible to be the provider. Hope this helps!

    My son's school is now saying he is not eligible for special Ed and I get ihss and he gets SSI can I get protective supervision and do homeschool?

    Hello, if you already have protective supervision then homeschooling shouldn’t impact whether or not it continues. Getting it in order to homeschool him is based on the specific PS eligibility criteria (undivided.io/resources/4).
