Episode 133: Taking Up Section 3 of the 14th Amendment

There's been much conversation about Section 3 of the 14th Amendment and whether it can be used to keep people who engaged in the January 6th insurrection off the ballot. Lindsay Langholz speaks with Donald Sherman and Nikhel Sus from CREW about their lawsuit aimed at keeping Donald Trump off the ballot in Colorado. They discuss the ruling of the trial court and look ahead to the December 6th oral argument before the Colorado Supreme Court.

    It is Pretty CLEAR. Like the man said If we do not UPHOLD the constitution NOW...Then when WILL the US uphold it (U.S. Constitution)?????

    Imagine for a moment that you have had surgery but instead of fixing you, the doctor decides to remove some of your organs just because he doesn't like them. He fails. So now he tells you he wants to operate again only this time to remove your heart, brain and liver as well and he even tells you this on top of it all. For you to not do anything and simply ignore the problem would not only be crazy, why would you even allow him to operate? We need SCOTUS to give us a truly fair decision on the matter that takes both sides into account. Fair and balanced. It needs to be very clearly defined. Why should we who voted him out give this man another shot at destroying the constitution? Shouldn't a doctor lose his license after the first time? Remember, this is not merely negligence we're talking about here. Will we stand by and just watch as the donald performs his next level of surgery on us?

    An insurrection is an armed rebellion. A revolt is a rebellion with an aim to replace a government, authority figure, law, or policy. If a government does not recognize rebels as belligerents then they are insurgents and the revolt is an insurgency. A belligerent is an individual, group, country, or other entity that acts in a hostile manner, such as engaging in combat. The term comes from the Latin bellum gerere ("to wage war"). o one was charged with being armed in the capital ... so how is it an insurrection?

    "Armed" is not limited to firearms. It is clear from video evidence that these "patriots" possessed and were wielding weapons such as batons and flagpoles with the intent of causing grievous bodily harm.
