    I prefer to charge $40 extra for a pet per month or have part of the deposit be a non-refundable deposit but then get ESA papers. I think landlords will just charge a higher rent overall since tenants will either sneak a pet in or it will be called an ESA.

    You're exactly right! I have had many tenants both sneak in the animals and claim said animals as ESA. Needless to say, the resultant financial loss to landlords just gets passed on to the rest of the (good) tenants. But that's ok, keep voting for communist politicians and you will get to share even MORE of your hard earned dollars with the deadbeats. Wake up people. It's not the landlords' pockets where the inflated dollars are ending up. They're just the middle-men...

    It is not illegal if you raise the rent for all tenants to the amount you would charge for pet rent so it won't matter if they have a pet or not.

    Liberty Walters You can’t compare that with a person that has allergies to pets and I have them severely. It’s as real a condition as a person that Needs a service dog or an emotional support animal. Thousands of people just like me need housing where no pets are allowed in the units or on the property and thousands of people just like me are animal lovers. We don’t stay clear of pets because we don’t like them. We stay clear of them because of low immune systems . I live with a chronic disease as thousands of others do all over America . We have sever allergies to pets . I am so sick of being told by people that I hate dogs and cats birds and bunnies when nothing could be farther from the truth. I Sit and watch animal planet every day because I don’t have the sheer joy and pleasure others have in handling or cuddling an animal. It would be a dream come true if only immune system could handle it. My GOD I spent three hours yesterday watching monies groom each other on animal planet just wondering what it would be like to touch one and hold one . Dear heart what I have is a real disability as real as any disability that a person has that needs that service animal. My medication would cost me 7 grand a month if my medical insurance ever decides not to cover it... but it does not cure what I have.. it only stablizes the situation. Hundreds like me would love to have a pet.... but we can’t. Why is it more than fair to have units where pets are allowed for people that need them but it’s considered unfair for people like me that number in the thousands to have units where no pets are allowed 61 years old now but none of this started until I was fifty and going through menopause. I wonder if that’s when my immune system went down. I bawled like a baby when I had to adopt my little dog out. I shook all the way to his new home because he was crying and whining.. I am crying now and can hardly write this because Winkie the love of my life knew something was wrong. I never left his new owners alone for several weeks always asking how he was and what he did that day. Really tore me to shreds but my health began to Improve... but only my physical health. I had to have counseling because I had to give my dog up so If any one understands why one needs an emotional support dog .... that’s me.... . Can’t stop crying at the moment. My dog was laid to rest not long ago and his photos are all over my house. I HATE MY DISEASE!!, Hating it won’t make it go away. I had a small darling lovable poodle mix. He was so darling and he was my family . I have said enough. Support people like me that must have a pet free apartment complex and mourn for us at the same time because most of us love animals P Erspn I Hope to GOD no one has to give away a pet because of the disease I have... you that have never had to give up a pet because of a disease that won’t let you be around your cat or your dog .... don’t know what it’s like to mourn that loss nor what it feels like to find a pet free zone because of your disease.

    @@janjbowman You describe that you have an acute allergy to the proteins carried on certain animals? If so your medication should be potent to help you improve your quality given the nature of your ailment. However, it is wrong to ask for a building to have no pets because you have this particular issue when you require one apartment within that complex. You could make such buildings with other people within your vicinity who have similar experiences and medical conditions? The difference between your request and that of service animals is that the service animal only impacts the building and apartment whilst they are present in tenancy or shop or amenity. It's not a permanent system that has to be put into place as you are stating above. You should be offered a deep clean and sterilisation off an apartment at no extra cost though and perhaps a mask that you could use when traversing between your apartment and the outside?. However ideally housing, bungalow or maisonette type of non-communal accommodation would be better suited to your needs. Really the council or housing body should be assisting you with that as they do for all other disabled people. It's not you who we assume hate animals but the manner in which these issues are dealt with. How other haters of animals use your inflammatory response as a means of discriminating persons who require Support/Assistant animals. I speak from experience and have been at the brute receiving end of such individuals. Who have created nasty situations because they personally don't like animals and want to make it more difficult for us with service animals to be able to go about our day like everyone else.

    FYI : some of your information dealing with service animals is incorrect. Service animals I know in the state of Utah according to the ADA have no certification whatsoever required just training this can be done by a trainer that does service animals or you can train your own. I know this because I have been helping my daughter train her on service dog. Because she has multiple health disabilities and when you purchase a trained service dog they only train for one disability and those dogs cost thousands of dollars. Dogs being trained for service animals are in training for the entire time they are with you. And just like people they have off days and bad days as well.

    The fair housing act doesn't have any stipulations about disclosing prior to signing a lease. Adding an "animals clause" to catch people not disclosing ESAs up front can get you in a lot of trouble if you try to evict them based off non disclosure of an ESA during the screening process. Just because it's in the lease, doesn't mean it's legal, you need to be very careful with that. Tenants could sue civilly & get triple damages, plus you can be fined over $10K by hud.

    @@jakejones5736 What? No. Contracts can stipulate no animals (ie pets). It's their property they have a right to not allow pets in their properties. They do NOT have the right to discriminate against someone who has an ESA or Service animal though. That is prohibited by federal law.

    @@sawyer4981 So let me guess. When a tenant wants to force the landlord to house their animal, they're gonna refer to it as a "pet" rather than an emotional support animal, service animal, etc.. As for your original comment, adding a "number of occupants", "inside smoking", "property vandalism", "I change my motorcycle oil on the living room carpet" etc. clause would also not be legal. Thus you cannot evict based on such non-disclosures...

    Here are your rights, move somewhere that accepts dogs & cats. You have that right. These policies are in place to protect other tenets in the apartment complex as well. Some people do not desire to live next to that smell, barking & possible dangers that are inherent with owning a dog. It's not right. No one should he forcefully subjected to your preferences

    You got it. This is a direct violation of private property rights! Here's the thing. If landlords can (rightfully) decide whether or not to allow animals on board, and there are not enough such rentals available, then the tenants can purchase their OWN properties and do as they like. Simple.

    It would help if it worked.. but regardless, service dogs are not required to wear any gear and the only way to truely identify a service animal is via a doctors recommendation that is required by housing. I live in CO and there are very loose laws regarding what identifies a service animal. I do like you getting the word out there though. It means alot that someone is willing to take that extra step.

    From someone who fought hard since 1980 to have LEGITIMATE SERVICE ANIMALS legally recognized, PLEASE read this. You confused service animals with emotional support animals. Other than an owner given title, that magically makes it legal They are no different than any other pet. Emotional animals have no formal training, no certifications. LEGITIMATE Service animals are restricted to large breed dogs and miniature horses. They are OFFICIALLY TRAINED to do a specific job. They have actual certification and must meet specific standards to hold certification. They wear specific gear while in public as they are “on duty” at home they usually don’t. Even though the animal still assists the person at home the animal is basically off duty.

    Heidi Willard Housing regulations is the only thing Service animals and emotional animals share. You are confusing True service animals ones trained to do specific tasks/ jobs.with emotional support animals nothing more than pets. They are two separate classes. Especially when it comes to training and tasks they do. I worked with advancing service dogs since 1980. I haven’t been as active in the past 8 years but I’m still involved. Since the bogus support animals were included as service dogs the training and certification standards have been basically shredded.

    Other than the comment about service animals having certification (there is no official certification, but there are a ton of scam sites that will sell "certification" with no verification at all, so anyone who offers "certification" is likely a fake), this is a fairly well done presentation.     I have one rental house , I also have a real problem around dogs , cats and almost all animals . I'm highly allergic to animal dander just the smell of animals makes it hard for me to breath , makes my eyes water, makes my skin breakout in a rash and I get a sever sinus headache . So I don't allow pets . What should I do ?

    There is really nothing you can do if someone has a emotional support animal/ESA or a survice dog/SD you can ask to see the Dr note. Because you as the land lord has to see it SO that you can get them the proper paper work for pet insurance and to make sure the dog is up to date on shots and vacsanion so they can fill it out to give to you for your file on them Because the insurance they have to have covers the dog if it bites anyone but legally you can't deny anyone because it's the ADA federal law and they can sue for denying them just because of their ESA or SD animal and you can be fine from $10,000 and up for denying if they wanted to take it that far... But the key is if they can't provide you with a copy of that note then most likely it's not a ESA or a Service animal it's just probably a regular house hold pet...i went through this WITH MY LANDLORD when i got my Dr note for my ESA.... I'd look up your 2019 landlord and and tenets rights for your state on that matter because every state is different plus read up on the ADA law's

    I highly recommend you speak with a lawyer that handles property and renter's law because there may be an exception we're not aware of. No one here is a legal professional and for damned sure, no one here is authorized to provide you with legal advice. We're all just internet schmoes providing our opinions out loud and that mean squat legally. Protect yourself and ask someone who's license to practice law.

    If you have 1 single family house that you are renting, then to you can deny an ESA. That is one of the exceptions allowed. You can have up to 2 single family homes for rent. If you have more than 2 houses for rent, then you are subject to the rules.

    Where is the six month clause in the HUD form? Had a tenant move in August and she gave me an emotional support animal letter in October from her doctor dated back in September. She got a notice about having an unauthorized pet last month and said that it was her mothers now she’s calling an ESA and it’s causing damage to the house.

    Can someone help me. We had an ESA cat (fully vaccinated) for about 3 weeks. She charged us $400.00 pet deposit, made us lock her in cage while we were out of the house. 3 weeks after we brought her home she had 3 kittens (we didn't know and were scheduled to get her spayed in a week) we told our landlord as soon as we realized what was happening. They told us to get out within 24 hrs. This was the 1st of this month (November) and they are telling us we're still own them December rents. Can I fight any of this?

    Landlords cannot charge a pet deposit for ESA or a SD right there you're landlord has broken the FHA law you can file a complaint with the FHA and the ADA you can take it to court you have to have proof you paid a pet deposit as we'll also you're DR note and take it to court

    You can fight it you have grounds as long as you got proof of paying a pet deposit plus they cannot make you lock up you're ESA and did you're landlord give you a written notice to vacate the place if not then you shouldn't have to get out plus if you have no were to go I'd also fight that to cause some time's a judge can extend it for you to stay until you find a place to live... I have a ESA my self and I know they can't charge a pet deposit

Hotel and motel can charge a cleaning fee but not a pet fee they can only charge a pet fee if it's not a service animal and just a house pet

    My landlord completely denied my request we did have the dog one day before I got up with my mental health provider I have been seeing for over a year to get the ball rolling on getting the paperwork which took a week and a half the landlord said you are not allowed a pet I said so I can't have an emotional support animal she said no this is not up for discussion and said that they made an exception for my fiance's emotional support animal that has paperwork from her license physician and they charged us a $250 pet deposit for her ESA and now my landlord is evicting us saying they didn't renew our lease 2 months ago they just gave us a copy but didn't sign theirs we are now months to month renters and because I didn't take my emotional support animal to the pound which is a kill shelter and would break my heart because this dog helps me mentally and so many ways but now we have till January 31st to get out and she is even trying to bully us and say that she doesn't even have to evict us no landlord can evict you without a court order but our neighbors who rent from the same person have two emotional support animals one stays outside on a leash most the time barking his head off which is really annoying but she said the same things don't apply to everybody and then discussed his mental health issues with me which she also cannot do without consent from him can anybody give me some advice here I will lose my whole business if we have to move

    Ivan Martinez well since the laws are apparently designed completely against the best interests of the landlords assets, yes, legally speaking it would be ok. but that is not to say that you are not a total asshole fuckhead for doing something that stupid and you should completely expect resistance from the landlord whenever they find out what youve allowed to happen to their property. if you do that I would fully expect your emotions and overall ego to be pressed into the dirt which is the complete opposite of the stated intention of the esa in the first place.

    @@IvanMartinez-hf1vz I would ask for a second appointment, I would call and ask if they would be open to a second face to face or over the phone appointment because you have questions about the residence, with the tenant after signing papers. If a person is completely okay with you renting an apartment and then you go to the second appointment and have a medically necessary piece of equipment then they have a problem you can file a complaint.

    Im in Ireland my landlord has recently received yet another complaint about my dog as i had been having harassment and verbally abused while pregnant and this family has made my life hell i lost my fiance of 12yrs together he died suddenly in my arms. Then i escape houee fire over possive man after my sis. Now this family crashed in my car i Have witnesses and she even made other resident's move out 3mths after buting into the apartment complex. I done i.v.f just had baby 4mths old he is i live alone and this woman has got a sale agreed sign up but still Int gone. Now my romeo has to go fri i. Sick to my stomach. I can't eat sleep. I need help but i don't kno where. Pls help me kno if the orchill mangement limted is over us or something and they come plant to the ppl

    Wow. A lot wrong with your service dog information. No certification is required. No vesting, tags, or ID is required. No formal training is required. A large percentage of service dogs are owner trained.

    My landlord is currently in the process of trying to evict me because my boyfriend was in the halls with my second ESA walking with no leash seen through cameras . And said I violated lease policy. And Also stated I never showed documentation on the second ESA WHEN I DID .

    The Department of Housing and Urban Development is responsible for administration and enforcement of the fair housing laws in the USA. It is irrelevant whether or not someone has a hud voucher through section 8. Landlords have to make reasonable accommodations for ESAs regardless of how the rent is paid. Your comment makes no sense.

    I applied to rent a house. Before applying, they disclosed approval requirements, 1-month rent deposit, credit and income requirements. I met all requirements, however, after applying and disclosing that my son has 2 ESAs with medical documentation; they approved my application, but then the realtor said that the landlord was asking for a 2-month deposit. Can I prove discrimination? I exceeded income and credit score is above minimum requirement.

    In most jurisdictions it's still legal to charge an additional deposit for pets. I know, I know, it's an "ESA". But guess what, it's still a PET. But the landlord doesn't have to refer to it as a pet. They can simply say "animal" or "dog" or "cat" or "goat". You sound like the kind of person that would cry "discrimination" if they wanted to charge more for 3 bedrooms than for two!

    I recommend you have your paperwork ready to show LL. A true service dog will have been specifically trained somewhere for someone with a disability and to help with your disability. An ESA requires no specific training

    Ty, I actually already settled this in court. My yorkie may be small, but he is trained to be my service dog. He helps me around the house as well. Just bc someone doesn’t have massive animal doesn’t mean they can’t be a service animal. I have the legal papers and won the court case. I am disabled btw.

    i have an issue with my landlord as per my property manager, and assistant property manager about my ESA, my question to you is: do i have to carry my small animal (dog) within the building, or can i keep him on the floor, cause on their rules says i have to carry or put my pet in a carriage, but hes not a pet` therefore he should not apply to their rules, please let me know, its very important to me, thanx in advance, God bless

    Emotional support animals are just pets according to the ada. Go read the ada laws. Emotional support animals are NOT service animals. They are just pets that bring comfort.

    My landlord is trying to make me tell them what specifics my dogs helps me with (anxiety,depression,etc) and wouldn’t have fall into the category “needs an esa for mental health diagnosis’s” and not “need” a specific that’s none of their business if I have depression, anxiety or anything right?

    I looked at the link provided. Not an attorney, but my interpretation is that the illness has to be so severe that it rises to the level of the individual being disabled. A person that sometimes gets depressed or has occasional anxiety would likely not be considered disabled by the issue. And of course, the animal must has some definitive ability to mitigate the disability.

    Kitty Love If you have a letter from a licensed physician/doctor/psychiatrist etc... your landlord has to comply with the FHA and make reasonable accommodation because of your mental/emotional disability .

    They also try to deny legitimate service dogs because of fake service animals especially if the animal a farm animal. Emotional support animals are only domestic animals that can live inside the home.

    Ok. The thing about service dogs was so good until the end. There is no certification for a service dog at all. And I know she probably didn't quite know that. It is misinformation to be telling people that. Although she was right. They are trained for two entire years to help assist a person with a disability.

    Our lease clearly states "No dogs on the dangerous breed list are allowed on the property at any time. If a pitbull "ESA" bites and kills a child, who is at fault?

    I can only guess, I'm not an attorney. The disability law overrules the "no dogs on the dangerous breed....". However, an animal owner still has to control his animal. So the dangerous pit can be permitted on property but must remain under control. If not under owner's control, the fault probably lies with dog owner unless somehow it can be proven someone else provoked the dog.

    10:15-10:30, NO!!! Service Animals do NOT have to be wearing anything specific to show that they are an SA. Completely disagree and ADA expressly says they do not need to wear or show anything (special vest, etc)

    And the first time said animal attacks someone, either the insurance company will drop you or your premium will go through the ROOF! Meantime, the tenant disappears and the landlord is left with literally THOUSANDS of dollars of financial loss. Sounds fair to me....

    @@powerbottom4971 Indeed! Worse, for those who have mortgages, the bank can call the loan for lack of insurance coverage. Then your losses can easily mount in the TENS of thousands! I have had tenants force their "emotional support" animals with all the accompanying risks on me many times, which keeps me awake nights.The animal is supposed to help them with psychological stress. But what about the LANDLORD'S psychological stress?

    Landlords in low income apartments where I live have the right to deny an ESA to tennants and tennants MUST comply or face eviction. NO exceptions. So in some places, landlords have the right to do so, some places, they don't.

    @@EmmaDee , an apartment 'complex' indicates that they have enough individual units to be covered by HUD. She should absolutely be covered, presuming she has a legit reason for having an ESA, and a letter from her mental health professional. Getting support for this is another issue. I have a service dog for mobility issues. He's obedience, public access, and service task trained, and I've been declared disabled by the Social Security Administration. In my locality the police keep ticketing me for using my dog off leash on days that my disability prevents me from being able to manipulate a leash. The ADA protects for this, but only in print. If i can't afford an attorney for defense or a civil lawsuit, which I can't, I'm at their mercy. For housing, she should be able to get help from legal aid.

    People like me that have pet allergies are not people that are catorgized as people with a disability. People like me are screwed when it comes to pets allowed in their rentals. Why only create housing for people that have service animals and emotional support animals.For years now people like me are told to suck it up even though we have a clear disability . It’s time housing was created for people like me and their are plenty of us. I have stopped breathing, suffered migraines , sneezing , coughing , wheezing, shortness of breath because of allergies .... why is there not housing for us . Relocate ... there is no place for people like me to relocate because there is no such thing as the no pets allowed on the premises for people like me. There needs to be entire apartment complexes for people like me. My GOD they do it for every one else but us. I have a chronic liver disease and live with a low immune system .... but an all free pet no pets allowed in any apartment in the apartment or on the premisses is fought against in this country even though plenty of people like me need pet free zones in on the premsis I love animals but they make y body I’ll. Why not create medical housing units for people like me and many others like me that have basically become invisible in today’s low income housing units. It’s not discrimination against any one at all to build medical units for people like me. New laws need to be created for people like me. My disability isn’t any less important than that person that needs a service animal. When my doctor tells me to get an apartment in a no pets allowed apartment complex I tell her they don’t exist and she says ... this has got to change,.... but will it ever change for people like me. It’s not likely because some animal advocates will just say that I hate animists. I love animals and have longed to have a dog but my allergies won’t let me have one . Stop discriminating against people like me who need an apartment with a no pets allowed in any unit or on the premises. Either that or provide us with an air purifier that actually works and we can stay in that unit forever . I asked my doctor why my friends horses don’t make me sick and she said when did you ever see a horse eat its own shit or it’s own barf like a cat or dog does. I am not putting down cats or dogs that do this but because horses don’t do it they are not carriers of things that can make me sick. Also it’s a huge lie that a dogs mouth is clean and a cats mouth is Clean so let them lick you all they want to. I asked a vet and she said that is such a lie. Also horses don’t drink from toilets like a dog or cat will. When the neighbors dog licked my leg while I was on a walk I had a ring worm there the next next day. Not blaming the dog he didn’t do any thing wrong he was just doing what dogs do... but my immune system won’t tolerate what dogs do naturally. I wish it did because love both dogs and cats .... but my immune system doesn’t like them. Well ring worms spread on your body, first one , then two and to say the least I had to deal with many of them because of one dog lick on my leg. God bless that dog he was just saying I really like you and want to be friends. I wish I could . Well any way hundreds of people just like me need a medical low income unit where pets are not allowed in or on the premises is.... it’s not to much to ask for ..... BUT ALAS PEOPLE LIKE ME AND HUNDREDS OF OTHERS JUST LIKE ME ARE INVISIBLE. IN THE FAIR HOUSING ACT FOR PEOPLE WITH MY KIND OF DISABILITY. LANDLORDS HAVE BEEN FORBIDDEN TO CREATE THE NO PETS ALLOWED IN THE UNIT OR ON THE PROPERTY IF ITS LOW INCOME HOUSING IF ITS FOR PROPLE LIKE ME. THAT PERSON THAT NEEDS A SEVICE DOG OR AN EMOTIONAL SUPPORT ANIMAL TAKES TOP PRIORITY OVER HUNDREDS OF PEOPLE JUST LIKE ME AND JUST WHY SHOULD IT BE THAT WAY. JUST WHY IS LOW INCOME HOUSING UNWILLING TO ACCOMODATE PEOPLE LIKE ME AND LET LOW NCOME . WE AND HUNDREDS LIKE ME ARE INVISIBLE . I DONT CARE IF I HAVE TO LEAVE A DINER BECAUSE OF PET ALLERGIES TO LET THAT PERSON THAT NEEDS THAT SERVICE DOG. I LEAVE WITH OUT AN ATTITUDE. I REJOICE THAT A PERSON THAT NEEDS THAT SEVICE ANIMAL GETS TO DINE OUT. I JUST ORDER MY MEAL TO GO AND WAIT IN MY CAR AND ITS ALL GOOD..... BUT MY HOME SHOULD BE DIFFERENT TO ACOMLDATE MY MEDICAL NEEDS THAT ARE JUST AS VALID AS PEOPLE THAT NEED A SERVICE DOG OR AN EMOTIONAL SUPPORT ANIMAL. THOUSANDS ALL OVER AMERICA LIVE WITH CLEAR MEDICAL CHALLENGES BECAUSE WE HAVE TO SHARE SPACE WITH DOGS AD CATS AND BORDS AND RABBITS..... WE NEED APARTMENTS WITH A NO PETS ALLOWED POLOCY IN ORDER FOR OUR QUALIY OF LIFE TO IMPROVE . E

    I had a verbal no pets agreement when my tenant signed the application. A few months after move-in, guess what? I find out the tenant moved in two dogs, claiming they are Emotional Support Animals, and saying federal law states I must accept them onto my property. And since they have been certified by a medical professional, I can't even ask for information about these dogs -- breed, weight, etc. I can't levy a pet deposit fee, so now I gotta pay for whatever damage these dogs cause to my property. ESA madness must stop. This loophole must be closed.

    Tony Perkins Tenants are still responsible for any damages caused by esa animales. You are also allowed to ask for paper work showing the animal is an esa.

    Nakai Yaz I don’t know if you are aware. Service dogs are used to help people cope with severe anxiety and depression, PTSD. Animals can cure a lot so medicine doesn’t have to. It’s not about being able to not live by yourself. These animals are trained to do this. Animals are a God given gift to this earth. Sorry some people can just shove pills down their throat and it’s all better. Animals are saving these humans you love so much. They protect them. Animals need us and we need them, period.
