Thanks! Sadly that crappy USPTO page has a logon loop when trying to logon when filing. So ridiculous. Basically when already logged on and click on "Utility Provisional" it says "Want to logon?" and if press "sign in" it does same thing again. Sigh...

Saw now. Thanks for replying so promptly. The address on My driver's license is a silicon valley address also, by the way. I did and honestly that patent office website has been somewhat disappointing. Did the entire provisional patent filing process and then tried to pay the fee for filing that provisional patent application, but that website failed to process that. I have an application #, etcetera, but none of those seemed searchable when I tried to pay that fee for that PPA again. How to find that PPA and get that done? Thanks in advance for answering how to do that, if possible. When going ahead with filing the full patent, are My short list of patent attorneys that I would likely choose from. By the way, friends with daniel kottke? Seem to be from that era there. @@johnferrellesq.

If you are filing a PPA, you can submit pictures and video stills as your figures. The format requirements for a PPA are very informal. Warmest wishes, -john

Hello John, I am thankful for your insights! One question: Why did you opt-out of Authorizations to Permit Access to Foreign IP Offices? (You checked not to authorize USPTO to allow access to foreign IP Offices and EPO at the 7:00 minute of your nice video. If e.g. I file a PCT in the 10th month of my PPA filing date, will I then have the priority rights of my UPTO Provisional? Thank you for the comments and the question. In my example, I elected not to authorize the USPTO to allow foreign access because as a small inventor I was not planning to file later for foreign patent protection. In your case since you are filing a PCT application, you should leave this blank. You will want to let foreign patent offices have access to your PPA. If by mistake you check this box anyway, this choice can be changed later when the nonprovisional application is filed. Good luck with your patent!!! -john

Love the video! I'm getting the book!

Thank you john, (10/9/23 completely up to date, site looks same s video) I followed this video step by step & did it in 15 minutes. I also bought your book for a quick read, good stuff. I actually do have a question HYPOTHETICALLY Let's say I file a patent to move a boat without a sail (this is the purpose of the patent, to "make boat move.") There are 2 methods, or ways in which the boat can then move. 1) Wind fan above water like you would see in the everglades or swamps 2) A propeller beneath water like a typical motorboat SO my Question is Can I include both of these methods in the Provisional App??? (All I care about is owning a method of the boat moving) OR do I need a separate App for each method?? Same 2 questions for official Patent App. Do I need 2 separate Patents? **That's basically what I did. I found a way to "build a better mousetrap" but know of 5-6 different ways to build that mousetrap, all of which I included in my provisional.

I am so glad to hear that my video was helpful! 😊 Yes, you can include both embodiments of your invention in your PPA. You may however need to separate the two propulsion inventions into two patents later if both methods of propulsion are different inventions and could both stand alone outside of the overall boat method that you are claiming. There is no need. It is part of the web form that you you fill out as you submit your application using the patent center website.

Hi john, when uploading the documents as a Micro entity are the only documents you need..... SB15a, SB16, specifications (line drawings, summary etc) Kind Regards, Dean

This is a great question. Thank you. The SB16 is not required when filing a PPA using the new Patent Center web portal. This SB16 form is replaced by the ADS (Application Data Sheet). However, the SB15a is required if the micro entity payment discount is selected. See the reminder in yellow, briefly shown at 10:13 in the video. I did not need to complete and upload this form since I filed as a small entity and not a micro entity. Thank you for pointing this out. Warmest wishes, -john

If you file using the web ADS form as shown in the video, you do not need to include an SB0016. For authority on this, reference 37 CFR 1.53, MPEP 601.01. Also, the warning you received was advisory only (printed in yellow and not red) and thus can be ignored. Yellow warnings are advisory, red warnings will not let you proceed. I hope this helps. -john

Note that a design patent protects the way something looks. A utility patent protects the way something is constructed or how it works. If the designs are closely related then you may be able to combine the designs in the same patent application; otherwise, you will need to file separate applications. 'Hope this helps. So I finally filed my provisional, thanks to your book and videos- and just realized that I didn’t include my entire write up on the product- just photos and diagrams and a title. Should I resubmit another patent application completely? I’ll pay again if need be.

No. The PPA is not available for public inspection until after the utility application is filed later. If you never file a corresponding utility application the PPA will never be available to the public. 'Hope this helps. -john

So in the upload the documents part, is that where you provide all the information regarding your invention, title, summary, detailed description, claims, pictures, parts, and references?

Yes. The upload contains your written specification and figures. For example in the video I filed a 10 page write up of my invention including 5 pages of figures. Hope this helps. -john

For a Provisional Patent application the drawing requirements are very informal. The test is that there is enough information in the figures and in the written specification so that one with ordinary skill in the subject matter of your invention could look at your application and learn how to make and use what you have invented. As long as the application was submitted and you received an application number on the Acknowledgement Receipt from Patent Center, then you’ll receive a Filing Receipt from the USPTO in the mail. The Filing Receipt will include a notice to pay the missing fees and will provide a two month deadline. Since Patent Center guest users cannot submit additional documents or fees to an existing application through Patent Center, you will need to submit the forms and payment by fax or mail. If you are unsure whether the final submission step was completed on Patent Center, you can resubmit the application and pay the fees with the new submission. When I tried to upload specification pdf file, it was rejected because of a “non-embedded font”, even though it was written by “Times new Roman” font !!! How can I proceed filing? Thanks a lot!!!

I have filed 4 PPA so far to have come back as rejected as no signature, I used an electronic signature. Now they're asking for me to notarize customer number, this would cost more than starting a new application. It seems that they do not accept electronic signatures as you have to print and scan back to the system a little archaic. When you phone the USPTO somebody always gives you conflicting information. They should have a warning that electronic signatures do not work. They do not give refunds back to your credit card.

The electronic signatures do work, but you must follow the format exactly as I entered it, including the back slashes. Your signature would be: /Tim Peterson/ , if that is your name. Thank you for this very useful video. I did not automatically receive a receipt after credit card payment (I actually had to contact the Patent Office by e-mail to retrieve it). Is there a way to obtain a receipt through self-service or automatically after payment? Thanks.

You will receive a filing receipt in the mail several weeks after filing your application. As for a credit card receipt at the time of filing, I’m not quite sure how to get this. With an NPA, the application normally publishes 18 months after the filing date of either the PPA or NPA, whichever is earlier. It is possible to request that the NPA be published 6 months after its filing - for example, if there is a desire to chill the market with your pending patent. Why did you put "5" for the number of drawing sheets? Is it truly optional to do so? Does that number include photographs as well?

Hi Flippin1999, as I recall my PPA included 7 pages of text and 5 pages of figures. Yes, figures includes anything that is not text. Hope this this helps. -john

I filed a provisional utility patent last night for my wife online, and think that I may have entered in the wrong email address for her. Two questions: Can I edit that in the application, and if so, how do I access the application to do so? I have gone to the site and entered the application number, but it says that it does not exist...thinking it may be too soon for the system to know that? Rick, if you entered the correct physical mailing address, you will receive a paper filing receipt in the mail within 2 to 3 weeks. That said, you can always just file a new application and spend another $60 if the exact filing date is important and you want to be sure. As for amending the email address, I would think this is possible, but you should contact the patent office help desk for the exact procedure for this correction. This video helped me out a lot. The only thing i would add to this is about the PDF drawings errors pertaining to the size being too big. I ended up shrinking the diagrams to fit the size of paper allowing some padding. Then, in converting the jpeg to pdf, I used adobe acrobat and selected “print” and printed as a PDF then I changed the paper size to A4. I also had to select “off” for almost all of the compression options. Then when I added the pdf diagrams, they took with no errors.

It’s an idea I have that involves AI assisted person re-identification spawned from the work that I do that involves leveraging surveillance cameras to detect specific objects or people. As far as a video I’d like to see.. Id say seeing the complete process that involves going from a provisional patent, to an actual one. What that entails, what would be expected (patent search, approval process etc) I like how you used an example patent with the jitterbug, but I know going through the actual complete patent process is expensive.. but at the very least, clearly defined steps after the provisional patent has been filled and what might be expected next would help. Bonus A “what if” video on if AI was allowed to do the patent searching. What the impact would be on the cost of filing a patent, on the time it would take to do a patent search, the efficacy of that search, the impact that would make on the patent attorney job market etc. and this is potentially likely since there have been cases of AI assisted defense attorneys. Just an idea Oh! And the impact on the increased number of patents filled by the disenfranchised, because let’s face it, we all have good ideas but not all of us can afford to apply for a patent. Maybe that would change if AI were involved

Hey John! I've followed your exact steps and applied for a provisional patent, and paid the fees. I did this late last year, am I supposed to get some type of official paper / document for this provisional patent? I only have the PDF version of the payment receipt. And also, going into the patent center again, are we supposed to be able to input our application # and find something? I tried and can't find anything. Thanks!

Two to four weeks after filing your PPA you will receive a filing receipt from the PTO in the mail. This filing receipt will constitute proof of your filing date and normally also include a foreign filing license permitting you to file your application in other countries. I hope this helps. -john

Yes. But remember that the patent won't be published for public inspection until after you file your nonprovisional application. No one will know that you filed a patent application until then. The patent office will invoice you for the missing payment. You must make the payment within the prescribed time in order for the PPA to be valid. -john

I just checked today and the micro entity status is available for those with a gross income of less than $212K (inflation has been rapidly pushing this number up 😊). I chose small entity (greater than $212K, but fewer than 500 employees) since my law firm has a gross income of greater than $212K. Since I was really filing a PPA with the patent office in this video and I used my office address, I did not want to misrepresent the Firm as a micro entity when it is not. Great question! -john

Hey John, i finished the application process and got my electronic receipt, i ended up accidentally refreshing and lost the pay not option. Now i cant seem to find how to pay the fee. I even went to the existing submissions tab but and put my application number in but it wont show. does it take some time for the application to show availability? how long do i have to pay the fee?

OK. I am completely stumped by this. If you are a guest, then you should have all of the privilege that you need to Continue. The Patent Center has a help desk link. My best suggestion is ask the Patent Center help desk what is going wrong. @@ashokankam574 You don’t need to check that box. That box applies to applications that claim priority to something that was filed prior to March 16, 2013. Provisional applications cannot claim priority to another application, so it doesn’t apply when filing a provisional application. Also, the "Statement under 37 CFR 1.55 or 1.78 for AIA (First Inventor to File) Transition Applications" is on the Application Data Sheet, which is not a required form when you file a provisional application, as long as you have a provisional cover sheet instead. The PDF that I uploaded in the video was a PDF file containing my specification and figures. I loaded mine as a single file, although you can upload the specification and figures as two separate documents. 'Hope this helps. -john

What's the deal with the download section? I took pictures of my product with dimensions, converted it to PDF, Compressed it to 102KB and the system states file is too big. The application is 118k. You had like 700kb when you download your image. I've tried over and over again. Then when I convert it to docx it accepts it but then states A4 paper or letter is required, when I try to covert to A4 or Letter it cuts off my edge/ dimensions of my product. I'm just submitting without any pictures or dimensions

When you file your PPA electronically using the USPTO Patent Center, even before receiving a mailed filing receipt, you immediately receive a patent application number. See my video @user-wm1yy9bt3u at 11:29, where I suggest you save this number. The number in the top left corner is the PPA serial number: 63/515,038. Sorry for the confusion. Hope this helps . -john

Guest users can’t view the status on the application online. (There is no need to see the status of a PPA, since this application is never examined and the USPTO will provide you with a filing receipt evidencing your filing date.) However, If you sign up for a registered eFiler online account, and file your application as a registered user, you can save your submission, submit documents or pay fees at a later time, and review the application and its status online. Hi John, I just filed my 1st provisional patent application. I had a heck of a time with formatting my Word doc to comply with proper formatting for numbering and kept getting a yellow message saying one or more of my claims contained more than 1 sentence. Hi Bill, claims are not required in Provisional Applications (PPAs); so as long as you received a filing receipt from the PTO your application is good to go. My patent description and figures were both scanned and stored as a single PDF document to a folder on my computer and then uploaded on the Patent Center web portal as shown in the video. The section described in section 4 relates to foreign patent offices and is not related to licensors or the public. The public cannot see a PPA (provisional patent application). Hi Samuel, It's a shame that PDF files are still so difficult to work with. You might try downloading Acrobat Reader from Adobe. I am pretty sure it is free. 'Hope this helps. Warmest wishes, -john

What is included in the PDF of the submitted documents? Cover? Application? Claims?

The PDF that I uploaded in the video was a PDF file containing my specification, one claim and figures. I loaded mine as a single file, although you can upload the specification and figures as two separate documents. 'Hope this helps. -john

Does filing a provisional patent protect my intellectual property while improving the final product?

Yes. You will receive a patent priority date for everything described and enabled in the PPA; however, note that you must convert the PPA to a Utility patent application within 12 months of the PPA filing. Good luck with your invention!!! -john
