Dr John Hlophe's appointment to the JSC a surprise - Prof. Bohler-Muller

MK Party caucus leader John Hlophe has been elected to represent the National Assembly on the Judicial Service Commission. Hlophe is among six members selected from five political parties to serve on the body that interviews and reviews complaints against judges. The impeached former Western Cape judge president is accused of trying to influence Constitutional Court justices in a matter about former president Jacob Zuma. EFF leader Julius Malema, the DA's Glynnis Breytenbach, the ANC's Fasiha Hassan and Action SA's Athol Trollip will join Hlophe at the JSC.
Professor Narnia Bohler-Muller from the Divisional Executive in the Developmental, Capable and Ethical State Research division of the Human Sciences Research Councils weighs in.

    For a start: a. The JSC consists of TWENTYTHREE(23) members. That in and of itself reduces the impact of a vote of any sole member; b. secondly the JSC is by definition an ADVISORY commission to the national government in matters relating to the Judiciary or administration of justice; c. THIRTEEN(13) members of the JSC, interview candidates for judicial posts and makes recommendations for possible appointments. s. and so the opinion of Dr John Hlophe, in case him being selected to participate in these interviews ONLY constitute 1/13th of the COLLECTIVE of interviewers; d. as far as 'dealing with complaints about judges is concerned: well, it's up to the president of the JSC to decide if HE deems it wise to permit Dr. Hlophe in these kinds of deliberations. My final conclusion: VERY MUCH ADO ABOUT NOTHING!!!

    Dr Hlophe was Judge President of the Western Cape Division of the High Court of South Africa from May 2000 until March 2024, when he was impeached. He first faced accusations of gross misconduct in 2008, so for 16 yrs he sat on the bench with that cloud. Zuma’s corruption case goes back to 1999 but he served 2 terms as President of the republic & to this day the case is still pending. The same due process applies to Ramaphosa & Phalaphala case. What has SARS, Public Protector and Reserve Bank said about the transaction?

    Some people keep on saying Hlophe should do the ethical or right thing, if he doesn’t believe in his whole impeachment, certainly the right thing for him would be to avail himself to serve in JSC. What is ethical to one, might not be ethical to another person, it depends on certain groups interests ( think of inequalities and economic differences due to others benefiting from the gains of apartheid and see if ethics are seen by All from the same angle). The constitution is not a book written by Almighty creator of heavens and earth, it might be respected around the globe, but why can it not be legally changed within the parameters of the law? It makes provisions of amendments itself, which means it can be changed following specific processes. The reality is that there are South Africans who believe that the same constitution of their country is not addressing the injustices of the past. The question is, must they not talk about their views of challenging the status-quo? The comments just depend on which side of the table you are, in terms of life you are living. The reality is that some are happy with certain parts of the constitution and some are unhappy and it is not being an unconstitutional individual if you voice your opinion otherwise that is trying to silence people. If the parliament was to agree in constitutionally addressing the “Hlophe issue” to avoid from happening in the future, would that be unconstitutional to add/amend the constitution because our constitution is respected globally? Our constitution should work for us, not us working for it. It needs to address our realities not to please people out of South Africa at the expense of the voters who have not yet gained the freedom which they dream of in their country.

    No he will not. Office of the Judge is a lifetime appointment to the bench unless you are impeached, meaning even when retired they can’t be members of a political party or run for political office. Code of judicial conduct Article 17 (iv) is very clear “retired judges must not enter party politics”. Zondo would have to resign his life time appointment, lose his life time title, prestige and the generous retirement perks for an MPs salary that can be less than 5yrs. He will need to be a special type of ‘stoopead’ to do that. There is no upside gain to that.

    Not all members of JSC agreed to impeachment, may be Malema was one of those. If one does not agree with certain groups, he is labelled as causing trouble, but the vise versa is not true to the very same group. Inconsistency. Talking about morals, where are the morals of those who are still benefitting today from the deeds of the then legalised apartheid? What are their morals saying in undoing injustices for past, in order to close the gap of living conditions?
