If you wait to gather your evidence & witnesses for your custody court hearing it can cause dire consequences.
You could lose parenting rights or custody of your child.
Today I want to share a piece of advice that is really very simple but is really powerful if you use it. If you are in the middle of child custody court case or think you will be in the near future, don’t just sit by and wait for something to happen. Take action now before the worst could happen.
If you do nothing, the other parent may be able to get a final order without you.
The reason I am giving you this advice is that in the last week alone, I’ve had a couple of people come and consult me and some really bad things had happened involving their families. It is because they didn’t take action until it was too late.
A man had receive paperwork from his ex-spouse and mother of his child and he claimed she was trying to terminate his parental rights. In the paperwork their were instructions to the father that he needed to respond. His response was to write a letter to the court that his rights should not be terminated and then he waited and did nothing else. He made no phone calls to the court or to his ex-wife’s attorney .
The next letter he received from the court was that his parental rights had been terminated. And now it was too late to do anything in his case. If you receive paperwork in your case you have to respond always respond in a timely manner and don’t wait for the worst to happen. Follow up directly whether it is your ex-spouse or the other divorce attorney or even with the judge in his chamber. Don’t just sit and wait because you may be hit with some really bad news and you will have no recourse..
The 2nd situation I had, was a grandmother who I consulted with about a little girl who was her granddaughter and the mother’s child. The mother had had some issues in the past, so the grandmother had guardianship of the child, and the mother had given that voluntarily. Well the mother and grandmother did not see eye to eye on a couple of things, so she was getting a little afraid that the mother of the child and the grandmother was worried that the mother was going to revoke that guardianship. So the grandmother was exploring getting third party custody rights over the minor child which is allowed in Arizona under certain circumstances.
Due to certain circumstances grandmother had to wait in this case and could not take any action as she wanted to. In the meantime what happened was the mother terminated voluntary guardianship and took back the child and now that grandmother no longer has physical custody it is going to be a lot more difficult for mother to get custody of that child.
So a lot of times things get in people’s way, it could be money or a lack of knowledge, it is important to get the knowledge you need. You owe it to your family to research, to ask questions, make phone calls, get on the internet or go to the law library. It is important that you are not on the defensive waiting for things to happen.
If money is an issue because they don’t want to do it on their own, for example, and need to hire a divorce attorney whose retainer fee is thousands of dollars. You must find a way, whether it be borrowing money or selling things, etc.
You have 2 choices: Either you can represent yourself in family court in which case you will need to prepare and gain the knowledge that you need because the judge will hold you to the standard of an attorney OR you need to get the money. Period.
But whatever you do, please don’t wait. Over the years I’ve had sad stories where people want to hire me after the decision had been made by the court and there were no appealable issues. There was no recourse left.
The time to act in when you are in the midst of a custody battle or you are going to be in a custody battle in the future. Do your research and make sure you understand the basic custody concepts so you can decide what to do.

I survived every round... shock numbed the pain.. ..he tried to ripe apart my family. TO PARENTS SUFFERING CUSTODY DISPUTES and navigating through that hell..     You also need to mention that the Title IV-D is under the executive branch and the states contract with the courts for administrative purposes this is not a court but a administrative hearing for a corporation not a judicial court. The state with this contract receives 66% of the money coming into Child Support which is a voluntary for the states. You also need to mention that the Bar Association is also under contract with Title IV-D. A Conflict of interest ?? Also know that USCS 42 is not slated into positive law...

    Your videos are very insightful. From all the videos I've seen you have included a real story alongside the information given. Court is very unfortunate. Nothing is ever fair and sadly when a judge is the decider everyone loses especially the child. I'm very confused also at the person who is emotional during the court proceeding as to why they are not looked at or listened to as they should. I would think it would be more concerning if a parent showed no emotions especially if the parent was not in the child's life because of choice and they only filed papers for a control factor. Anywho thanks for the videos.

    Lawyers here are advicing me to just move on and wait untill his 18 yrs bcs what will happen is I will only be made to pay child support but not get custody of my child. I don't have any criminal history and I don't use drugs . Am employed and have have my own house and am newly married . Why can't I get custody of my child

    Hi Wendy this is my story my son Joseph had children with Julia the mother of my two grandaughters. Because of their drinking and other events cps got involved and took away the kids and placed them with my daughter and her husband. Since then the mother moved to New Mexico with her mother my son is in jail and I believe that his parental rights were taken away. I am getting ready to get custody of my grandaughters as soon as I find a place to accomadate them. I just found out that the mother julia is finishing the program that she is supposed to do in order to get the girls back. I have been in my grandaughters lives since they were born. Now she is going to take them away. What can I do to not be shut out of their lives. I don't want to take the kids from her but I do want to find out what my rights are as a grandparent is

    I believe my ex gave birth to our child 3 days ago. She lives in a different state and has blocked me from getting in any contact with her. Her mother was only way i could reach anyone in her family for past two months. 2 months ago was when i found she had been cheating and lying to me for a few months by seeing her Ex -Girlfriend, who all of sudden she moved back in with a week after she dumped me cause i found she been seeing her. So her mom was only way of getting any contact. Well her mom blocked me out of nowhere about a week ago. Only way i found the baby was born was because her moms profile pic was of the newborn. She must of thought because i was blocked that I wouldn’t be able to see the pic. So no one contacted me that the baby came a week early and no one of the my ex side even knows iv found out. Because i cant contact anyone, all i can do is write a letter to her grandparents house. Any advice please

    I have a question, In my case, my husband is fighting for custody and he currently has primary custody of his daughter. It's considered "shared". She has been dragging me under the mud saying it's my fault, that I'm manipulating my husband, and that everything that happens is because of me. She has been taking some of these frustrations to Facebook and has been saying some pretty bad things about me. Can we bring this up in court ? Or no? I do t want to make the case about me vs the child. I feel like that's what they are trying to do ( the other party) . Can I sue her for saying bad things about me?

    If you are waiting a month or two after meeting with a guardian ad liem assigned to your should there be cause for alarm if they haven't scheduled a home visit? Is it appropriate in that case to contact them?

    How would my daughter be able to regain the custody of her son when she was mislead and she had no knowledge of any court appearances due to the fact that they were sending the paperwork to the wrong address when the plaintiff knew where she lived in the right address but did not tell the courts

    I am kindly asking for some advice, I have a child with someone whos family doesn't want me to involved in my childs life they have gone as far as trying to get me deported.     hello I really need help and have gone to 3 different free legal clinics and all said need to hire a atty. In this motion I just received yesterday and need to be in court in 5days has so much lies & slander. his exhibits are from 2008, 2014. I have had to file police reports both of my ex and her friend who is attorney for harassment and Stalking. but the attorney has flipped it all around and now I'm the bad guy.     My daughters father lives in Texas where we met I was about 4 months pregnant when he told me to move with my aunt when she moved to Montana where my daughter was born. We now live in Phoenix, Az while he is still in Texas I have brought her town to see him twice for a week and a half each time. They have skype sessions every Tuesday Thursday and Saturday but he often skips them. He stopped paying child support when he found out I was dating my now husband. It wasn't official child support it was just something we agreed on and there has been no proof of paternity he isn't on the birth certificate either. He wants me to send her to him multiple times through out next year and/or have me bring her down. I was just looking for some advice pertaining to custody, if I would be able to change or hyphen my daughters last name to/with my husbands last name, what rights he currently has, and whether my husband could adopt her he has been in her life over a year and she turns two in February of 2017 she has called him dad for a long time without any coaching. Any advice is very much appreciated thanks in advance!
