the short answer is, it’s not illegal because It’s not the same formulation, just the same ingredients (usually) but sometimes brands will add another ingredient to the product as well but they can definitely get sued for using the same formula so they don’t. Also these products aren’t patented.

Temu, has a bunch of these as well and the ones I've tried aren't bad, but they just aren't the best and there is a very cheaper alternatives that might be good for your skin type! :)

The reason brands can dupe other brands whether its drugstore duping high end, mid range duping luxury and some cases drugstore duping drugstore. Unless that product has the patent for ingredients used or the product design meaning the packaging then no other brand can dupe that product. Urban decay is trying to get a patent for their packaging but not the formulation. So if Maybelline wanted to make the same foundation they could but in different packaging.
