    Truly, I'm shocked at the Colorado judge who found that Trump incited the insurrection against the government, but then concluded that presidents cannot be disqualified by 14A section 3. How can that possibly be so? How? If the section doesn't apply to a presidential candidate, because that's all Trump is at this point, then who would it possibly apply to? Nutty, this Colorado Judge is nutty...and weak kneed.

    Well, 14C3 doesn't include to POTUS under it's grasp. It simply doesn't state the POTUS is included. Consequently, the judge was unwilling to disqualify him. The case will likely be affirmed on appeal. 14C3 was litigated aggressively in the trial, they were unable to show that 14C3 specifically says the POTUS is included in it's list of positions.

    why ? it was always obvious that this is where this was going to go . I am an avid never Trumper - but I never thought this was going to work - had the senate upheld his impeachment - as they should have - that would have been a different story. These legal scholars are well regarded but the law is applied in the real world .

    The obvious question here is: How could the US military continue to fulfill their oath to support and defend the US Constitution against all enemies foreign and domestic, and obey the president, if the president was someone who had previously not only engaged in, but who had also instigated, an insurrection against the lawful government of the USA?

    @@Grandhotel256 I imagine that having to try everyone that fought in the Civil War would not be reasonable. Everyone who supported the insurection after taking an oath would not be eligible. Even ex soldiers police etc because they violated that oath.

    The most troubling part of the Colorado judge's ruling is that she found that Trump engaged in insurrection yet can still run on the ballot in Colorado. That simple fact shows how broken our system of justice is.

    @@jannichi6431 and this is why her decision is so sad. She is a coward. She could have set the precedent. It is beyond comprehension how she can say Trump engaged in insurrection and yet he can be on the ballot, when all others that have or would do the same thing cannot be on the ballot. She took the easy way out. Remember, there is always a first for each precedent. Trump is clearly an elected official, who held office, and swore to uphold the Constitution.

    @@jamesdavis8731 The Amendment also states those holding military offices, the President is the Commander in Chief of the military. It further states those giving comfort to insurrectionists. The Colorado judge found that he did participate in an insurrection. By that ruling, those congressmen and others that also participated, should be disqualified as well.

    Not only do we have the justice system failing to protect the American people but we also have the legislature unwilling to discipline its members. From Marjorie Taylor Greene poster board pornography violating private citizens and professional ethics during a congressional hearing to Nancy Pelosi being unwilling to discipline the squad back in the day for whatever they were pulling at the beginning of their terms. The bribery abounds and if they refuse to legislate to hold themselves accountable then they should have to wear jackets showing patches of all the corporations and bribes that they are taking that stop them from protecting the will of individual voters.     Actually, unfortunately, it doesn't. "No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State...... " I think I've figured this out. The 14th amendment , Section 3 includes everyone except the President. The President isn't specifically a civil or military office. I'm guessing that the writers of the amendment intended for the Electoral College to handle the case involving a Presidential candidate. Oops!! Congress CAN enact special legislation to exclude him, but.....

    Thank you for this sober conversation - I am perplexed by many things - one in particular - how is that in many states convicted felons who have served their sentences are not able to vote, but a convicted felon can run for, and serve as President of the US. This is crazy making.

    SPOT ON, my state won't even put air conditioning in the FOR PROFIT jails. DeathSINTas* revoked Felons from voting! Texas extended more restrictions for parolees and jailed one for voting with a valid registration. Thank Senator Hughes for #1 voter Suppression laws over last few years. Gov. Abbott signed them.

    Many state laws conflict with federal laws!!! EX: Marijuana laws. Now Dobbs vs Roe is at issue. For the record, typically to make it illegal for any felon who has served their time to still not be able to vote is exactly what red-ruled states do. That's because typically the black & brown-skinned felons tend to vote for Democrats! And NOW, that same political tribe, Rethuglicons--bent on keeping or stealing power happens to have a cult leader that is running for president & they don't want anyone stopping that! If ANY Democratic candidate was indicted, like Dump-not even convicted, know that EVERY Rethuglicon would be raising hell!! Rethuglicons don't want every American to vote. They've believed the fewer ppl vote, the better off they are. And they are right. This has been their mantra since 1977. It's Rethuglicons that passed over 500 voter suppression bills in the past few years. It's Rethuglicons that have gerrymandered their states so they don't have to change any of their policies for their voters, & keep power over any Democrat that may run. That's also why they love electoral college so that their loser candidate has a greater chance to take power over the more popular candidate. Rethuglicons hate rule by majority. Their state laws favor them to stay in power.

One of the KZread commentators did a review of those recent polls ~ I forget who did the review, but it turned out that a huge percentage of the folks polled had NOT even voted in the previous presidential election.     The judges and lawyers are always citing the defendants rights to this and that, what about the peoples rights. ? We have the right not to live in fear for the safety of our judges and witnesses and law, clerks, and ourselves. They keep saying nobody is above the law, but that’s a flat out lie.     Authoritarians succeed where the laws and courts show weakness. And the US courts and laws have not reacted decisively. They continue to re-write the laws to accommodate one man! If the judiciary does not face up to this very real threat and apply the laws of the land without fear or favour authoritarianism will take advantage of that weakness

    On Friday 17th the Colorado Judge found that Trump did engage in insurrection but could remain on the ballot as the 14th amendment does not specifically state "The President". It will be interesting to see what the Appeal Court makes of that!

    They will probably affirm. 14C3 just doesn't state or list the POTUS. It's just that simple. There is reason to believe he MIGHT be included in the admendment but it is simply not clear. if the framers wanted the POTUS to be included that would have stated by title. Simple and clear cut.

    I believe Professor Tribe is exactly correct & in the court of morality & justice as well, but the judge in Colorado just shot it down, I believe yesterday. He admits Trump was wrong yet moves to leave him on the ballot. How does America hold to its principles when judges like this make these kinds of decisions? One more defeat for the freedom of America & all that it represents. One more judge giving strength to corruption.

    Actually, my part of the world is pretty fearful of the consequences if Trump gets back in! And for all the peculiarities of the USofA, the Judicial reference to The Constitution is impressive - as it should be in Constitutional Republic!     There's that pesky "Specifically Enumerated" clause in the Constitution getting in the way again. The Constitution specifically enumerates three (and ONLY three) qualifications to run/serve as President. As a previous President, there is no possible legal argument that Trump doesn't meet those 3 requirements. Insurrection is a FEDERAL crime. Without being accused/tried/CONVICTED of insurrection by a FEDERAL Court, Trump is NOT an insurrectionist and the 14th Amendment is irrelevant. STATES cannot convict you of insurrection and the Supreme Court agrees: Ableman v. Booth, 62 U.S. 506 (1859) State courts cannot issue rulings that contradict the decisions of federal courts.

And, to thumb the nose at Justice, she was "somehow" reinstalled AGAIN as the the judge for THAT Case!! There is corruption *installed* .     If a politician wanted to run for president and is 34 years old they would not qualify. The minimum age is 35. Insurrection is an obvious disqualification under the 14th Amendment and all states should disqualify him, and the fight to be on the ballot should fall on Trump alone.

    The main issue that seemed to bug the judges in the other cases I listened to was the task of defining insurrection. Now that the Colorado judge determined him to be an insurrectionist, the language in the 14th amendment clearly means any office, and any office means any office. If you can’t be a representative, or serve in the army, then how in the hell can someone serve as president? This tyrant must be stopped. The court has a chance to do that and they need to follow the constitution.

    The biggest problem with your comment is that Trump has NOT been ruled an insurrectionist by a Federal Court (due process). The DOJ ruled there was no proof/evidence to accuse/try/convict Trump of insurrection. So from the Federal level (and the LESSER State level) Trump is NOT an insurrectionist. Insurrection is a Federal level crime and cannot be ruled on by State Courts. The Judges "mention" that Trump was an insurrectionist is from his own bias, and the statement has no legal standing. Trump is not an insurrectionist unless (or until) a FEDERAL Court convicts him of insurrection (again, that is Due Process). The bottom line is that UNTIL Trump is convicted in Federal Court of insurrection, Trump is NOT an insurrectionist...and the 14th Amendment is irrelevant. This has been tried many times before in US election history, and always fails because States cannot find citizens guilty of Federal Crimes. As per SCOTUS: Ableman v. Booth, 62 U.S. 506 (1859) State courts cannot issue rulings that contradict the decisions of federal courts.

    The ruling that section 3 of the 14th Amendment doesn’t apply to the Office of the President is patently absurd. Of course it does. But it does beg the question why the drafters of this provision wrote it in such a cumbersome manner. They could have written the proscription in a clearer and more concise fashion and they could have laid out the procedure(s) to be followed. All rather curious.

    Well, actually, it’s not clear at all. Why didn’t the drafters specifically state no person shall be President or Vice-President? And what’s the procedure for disqualification? Is it a court proceeding? In federal court, state court? Who decides? A judge, a Secretary of State, is it up to Congress ? The Senate or the House? It certainly cannot be on a state-by-state basis, but we just don’t know.

    For 1 the amendment is not patented. And too presidency is not SUBJECT to 14th amendment.
