To begin with, cannibalism is absolutely legal in the United States (with the exception of the state of Idaho), the UK, much of Europe, Japan, etc. However, as Cornell Law School notes, a number of laws are in place across America “that indirectly make it impossible to legally obtain and consume the body matter”. The same can be said for the many other countries in which cannibalism isn’t directly illegal.

    @@tiffanywelton5116 the only real issues that arise from eating human meat is when you eat the brain. Our brains contain prions, a bacteria that cannot be cooked out no matter the temperature. it essentially unravels the proteins in your body. Most animals brains contain prions but it only seems to effect when you're eating in the same species family tree. Mad cow disease was from cows being fed other cows brains among their feed

    @@davidking3922 Even with prions there is cases of ppl growing resistance to prions over generations of ritual cannibaliism, so given enough generation could probably grow completely resistant if not immune to prion dieases causing to do barely any deteration or make it so long a process they'd take an entire life time to die before the prions killed them if they even died from the prion dieases itself. And on that, prions do not naturally occur in our brains. They are a mutation much like cancer that spreads through others of the same species consuming the brain. If prions occured naturally litterally everything with a brain would either be immune to deteriation effects of prion dieases (and by extention to the dieases itself), or we'd all die painful deaths from prion dieases regardless of whether it's a cat, dog, fish, human, or any other animal with a brain. That's why mad cow diease died out. They stopped feeding unaffected cows the brains of infected ones and the infected ones naturally died out and were cremated.

    My take: Starvation medically leads to an altered state of mind, and so does survival. Ultimately, even if a law existed, ruling would still favor not guilty by temporary insanity.

    Possibly, but insanity pleas are incredibly difficult to get. It’s nothing like the law shows where someone gets off on insanity because they were mad or depressed. Typically you have to be in such a mental state that you literally don’t understand that you’re doing something wrong in order to actually get it.

    True, insanity pleas are hard to get. However, I think if you went through a very detailed description of what it felt like to have your body begin to digest itself and the madding effect of hunger on your psyche, the uncertainty of rescue and your own survival, and the paranoia as you begin to suspect the other people will turn on you, you could convince a jury of letting you plead insanity. It's a lot different than being drunk.

    The donner party was a party of people traveling to what is now Sacramento California unfortunately when they arrived at what is now known as donner summit or something like that it was winter and they’re horses and stuff got stuck in the snow and they were unable to pass they sent our scouts ahead to look for help but they took a long time. They ran out of supplies and had to resort to eating people they did not however kill the people they only ate them after that had died. What remained of the party was eventually saved and settled at sutters fort which you can visit in Sacramento

    I had a friend who was a descendant of _those_ Donners. His forefather and foremother were among the survivors. They started a restaurant in San Francisco, which proved to be very successful.

    I find it very telling that it's always the cabin boy. I'm weirdly way more on board with the guy who ate a willing participant rather than the guy who was held down and had his throat slit. One guy ate his own nephew who was also a cabin boy. Often they are not actually starving but dehydrated like the peeps at Lake City.

    When I cover the necessity cannibalism legal cases in my Torts course, I compare the British approach to the American approach. In England, the sailors were found guilty of murder but then the crown pardoned the sailors. In the United States, there are a couple of spelunking cases where victims were murdered to save the remaining people trapped in a cave. In the American cases the defendants were found not guilty by reason of necessity. I believe the British approach is better because it recognizes the sanctity of human life, but then shows mercy through the pardon process.

It’s true that most people who receive a life sentence in Germany only spend an average of 20 years in jail (first chance of parole is after 15 years), but that’s not the official limit. A life sentence can indeed mean life and currently Germany’s longest-serving prisoner is Hans-Georg Neumann who was sentenced in 1963 for a double murder.

    @@leviroch Interesting, but we don't do that. Here in Germany you can only get one life sentence at a time. If you've committed several serious crimes, though, your chance for parole will be postponed (so you're definitely in prison for more than 15 years) or you're denied parole altogether.

    Levi Roch not sure about other countries, but here in america getting multiple life sentences is just a way to show how extreme the crime was and ensure a parole board won’t let them out early. here people who get a single life sentence usually serve most of the sentence

In an extreme survival situation where 1 person is badly injured and without the possibility of medical attention and ask the other guy to kill him and later when rescue does come and the surviver tells the story to the police and even when they 100% believe the guy why should he still have to do time even though it was only a mercy killing under extreme circumstances?

    generally a ship at sea is required to fly a national flag and while in international waters, the laws of flag nation apply on that ship at sea. could be wrong but i'm pretty sure that's how it works. seeing as you can't really be stateless in this day and age (major goal of the UN), everybody is under some national jurisdiction at any given time and in any place conceivable.

    rsjabba that seems plausible. I suppose it is after all the captain’s right to punish, but he has to abide by some standards. I’ve been on international waters though and there was always a sign warning that there was a strict no drugs policy, which would lead to immediate detention and offenders being handed to the police.

    What a ridiculous comment. How can a child aka a just born baby get a communicable disease from the placenta that has literally been keeping them alive for the past 9 months? If there was a disease they would already have it!

    Nathaniel Offer Communicable diseases can be passed from mother to baby. That is the very reason that silver drops are placed into drops of almost all newborn's in Western Civilization. While inside of the amniotic sac the unborn child is not exposed, but after the water bag breaks the child is definitely exposed to sexually transmitted diseases, if present, while passing through the birth canal. Whether or not the placenta would actually contain communicable disease is debatable. Syphillis does affect many body organs including the brain. Can't remember off hand if babies can be born with syphillis, etc. Either way, don't eat blood. Alone, that would bar eating a placenta. Newborn babies are geared to drink mammary gland colostrum then later milk from the same source. No babies chewing & swallowing raw or cooked placenta. As far as moms, I know that some have the strong urge. But I don't see any of them capable of getting up & cooking it either. Blood prohibits the eating of it raw. So yuck, yuck, & double yuck! Not judging the mothers' urges, just grossed out at the idea of anyone acting on it.

    I used to say there was no way that I'd do that and that I'd rather die first. But twice in my life I've been in situations of extreme hunger, and it is in a whole different category than regular hunger. It's like a primal part of you kicks in and you realize that you will do whatever it takes to eat. This urge overrides any intellectual or moral objections you might have. It no longer becomes an issue of if you want to do it or not. Kind of like going into labor, your body is going to force you to do it whether your brain is on board or not! Luckily both times I was able to get food and didn't come close to having to make the horrible decision these other people had. But I did finally get a better understanding of the body's undeniable need to survive by any means necessary.

    @Kristie C we call our sheeps balls 'mountain oysters' aswell lol, didnt know we shared that with the US. Here in australia most food you get in restaurants and food stores are stereotypically 'multicultural yet tame', but if you travel off the main tourist spots you can come across some amazingly odd cuisines. . . Aussie haggis is a thing to behold, slow cooked feral cat pies with local mushrooms, deepfried emu fingers, croc tail stew. . . We are tge only country in the world that eats BOTH animals on our coat of arms lol. Personally i dont eat beef anymore, i only eat kangaroo, lamb and pig for my red meat (it wasnt until i started hunting with mates did i realise that beef is well and trully flavourless compared to just about every other source of red meat)

    How did the Donner Party not get talked about in this video? It is one of the most relevant, and most well known, story of cannibalism in the US. I'm honestly surprised it isn't a part of this story.

    It’s more about the legal consequences of canibalism. While the donner party is famous it doesn’t really apply to the subject of the video considering that the area where it happened was pretty much lawless
