The Supreme Court is hearing three writ petitions that raise questions about the interpretation of Office Memoranda (OM) dated 19.01.2019 and 31.01.2019, which prescribe the eligibility criteria for the Economically Weaker Section (EWS) category.
* The petitioners were denied the benefit of reservation under the EWS category by the Union Public Service Commission (UPSC) for the Civil Services Examination of 2022.
* The main question involved is whether the UPSC was justified in denying the petitioners the benefit of reservation under the EWS category.
* The three writ petitions involve different sets of facts, but the legal submissions broadly overlap.
* Writ Petition (C) No. 724 of 2023 involves Ms. Divya, who was a candidate for the Civil Services Examination, 2022 and had already qualified for the Indian Police Service in the Civil Services Examination, 2021. She applied for the CSE-2022 under the EWS category but was denied the benefit of reservation.
* The Civil Services Examination Rules, 2022, which govern the CSE-2022, are crucial for the adjudication of the case, particularly Rules 13, 27, and 28.
* The Office Memoranda dated 19.01.2019 and 31.01.2019 prescribe the criterion for eligibility to apply under the EWS category, which includes a) not being covered under the existing scheme of reservations for SC/ST and Socially and Economically Backward Classes, b) having a family gross annual income below Rs.8 lakhs, and c) not owning or possessing certain assets such as agricultural land, residential flat, residential plot, etc.
* The income and assets of the families are to be certified by an Officer not below the rank of a Tehsildar in the States/Union Territories, who is to issue the certificate after carefully verifying all relevant documents following due process as prescribed by the respective States/UTs.

If you have got IPS which is an elite service, still you are claiming seats against ews category is TRUE show case of ethical aptitude in a candidate. They claiming high ethics value in GS 4 or interview but when it comes to real life they show their TRUE greedy nature. Do they don't have any moral responsibility for others who are economically backward? They must have shown courage to attempt the exam with UR category and get IAS if they desire so. But leave doing that, they have filed a case against this and shown that too what extent they can go for thier greed. People like these don't even deserve a seat in UPSC and they are selected as IPS, it's very disheartening.

Because she comes in ews category that is why she is claiming it. He didn’t say that divya didn’t qualify being a ews he said the mistake was about the date of financial year. And if provision is given of reservation then people who qualify the criteria will get select under reservation, right? Agr IAS mila toh reservation q use kiya what nonsense?? Unke andr wo kabiliyat hai tabhi wo itna aage aaye and wo wualify hai reservation seat k liye isliye unko aur achi post mili - ye UPSC ne hi toh provision diya h na unhone khudse toh nhi liya hai . Ek bhat btao sir, EWS 2019 ka use Kiya in case for example pre mein unnoe EWS se pass Kiya but ews to valid tha he nhi na.. pre for general 90 and EWS 85 n lady ne 86 score kiya hoga to
Even Ravi Kumar siihag misused EWS. While working in class 1 govt job he used EWS doc. Prelims he qualified in EWS category but got 18th rank in mains so issue nhi hua tha yeh.

Currently i am also not using obc reservation because my father salary increase from 8 lakh anually . There are many cases of OBC candidates whose candidature is cancelled after getting thier name in UPSC.

Even if she was shifted to general category and got IPS but she cleared the prelims and mains by using EWS category cutoff. Isn't that unfair? It might be possible that in general category she could not even clear prelims.

The OBC candidates applying for CSE-2023 must produce OBC (Non-Creamy Layer) certificate based on the income for the Financial Year (FY) 2019-2020, 2020-2021 and 2021-2022 and issued on/after 01.04.2022 (after the completion of FY 2021-22) but not later than the closing date of the application for Civil Services (Preliminary) Examination-2023 i.e. 21st Feb, 2023. Sir I am from Bihar and the Bihar Govt. is not allowing NCL certificate based on income of 3 financial year. What should I do? Will my candidature be dismissed in CSE-2024 exam due to this?

The issue date of the OBC NCL or EWS certificate must be within last one year (365 days) from the date of notification/examination. My suggestion is keep updating your certificate every 10 months.
Agar ews cetificate galat ho jae to kya naukari chali jayegi ya general me count hogi

I think 2023 ke April ke baad Income certificate banana chahiye and usi Income certificate se NCL apply karna hai...abhi apply kar dene se 2024 ka notification aane se pehle certificate ban jayege NCL ka...to may be wahi valid hoga naa...

I'm not preparing for civil services and I don't have much knowledge regarding this field so can anybody please explain why candidates are running behind IAS only? Is there any significant difference between an IAS, IPS, IFoS and IRS officers? It seems to be similar like Medical, Engineering and Agriculture entrance exams where candidates are fighting for MBBS, CS and Bsc(Hons) Agriculture respectively 😅

IAS has all the powers because they control administrative wing. Ips comes 2nd. And IFS is mostly posted in other countries. IRS controls the revenue but the thing is allocation of these services is also controlled by IAS only. That's why ppl choose IAS because of power.

IAS can get fast promotions and have most chances of becoming directors in various ministries of government that is it provides diversity of work compared to others. After ias it is ips and ifos to attain that level of promotions. Ifs and irs are different they are eligible to handle high post in their own ministry , diversification of work is not there, but ifs have another level of perks and privileges which are most desirable to many candidates.

अगर किसी के मा पिता जीवित नही है और अपना मकान भी नही है तो EWS सर्टिफिकेट कैसे बनेगा। क्योंकि लखनऊ में वकील बोल रहे कि लेखपाल बिना मकान की रिजिस्ट्री के EWS सर्टिफिकेट नही जारी करेगा।

I dont think so... during training you get around the starting salary of an IAS is 56000 so it is well below the 8lakh per annhm

@@niteshthakur4459 Bro, If Income of family is even exceed than 8 lakh then EWS will not be generated. Residents should not more than 1000 sq. Ft, 200 yards resident area in Municipalities area, More than 5 acre of land If any one posses any of the above 1 or more condition he/she is not eligible for EWS. Me as a Revenue clerk first verify it then RO/CO generate EWS.

Without pay wala scene nahi hai. Sirf naam ka 1 saal pehle ka Income mentioned hai but actually 2 saal pehle ka certificate Dena padta hai,Divya ji ne 2020-21 financial year ka EWS certificate wo 22.02.2022 tak ready rakhna chahiye jo unke paas nahi tha. Toh wohi awareness ki kami thi. Abhi IAS nahi mil sakta aur ek attempt agar dengi to thik.

@@shivworshiper Rule hai ki Previous financial year ka Dena hai. Lekin UPSC exam process jab notification nikalta hai toh February/March last date hota hai apply karne ke liye toh. 2024 ka abhi Jo exam hoga, iska apply karne ka last date 5 march hai toh, 5march 2024 mein tumahre paas EWS certificate hona chaiye. Toh March 2024 mein 2023-24FY ka EWS nahi ban payega.kyun ki 2024 March 31 mein financial year khatam hoga. Toh aapko 2022-23 FY ke EWS certificate rakhna padega. Toh exam 2024 mein hoga result 2025 may ko ayega. Lekin EWS lagega 2022-23 FY ke. Isiliye yeh sirf naam ka last year ka EWS hai , Lekin originally 2/3 year piche ka chahiye. Process bohot kharap hai EWS ka waise bhi exam process 1 year 4 months ka chal Raha hai Yeh bohot Sad cheez hai.

Sir agr koi form 2023 February ya march main aata hai toh us pr 2023 ka EWS lgega ...or agr wo exam march ya April main hota hai or result may june tk aata hai ..toh document varification main kya wo EWS certificate valid hoga ? Kyonki mera EWS 2023 April se 2024 31 march one financial tk ke liye hai ..or agr result late aata hai toh or tb tk new EWS certificate nhi bna ho toh kya ye valid mana jayega ? Koi problem toh nhi hogi ... please help... I'm confused ki kya krna cahiye ....
This is very common, obc, sc, st candidates who have qualified or they are in any government job still they use the privilege of these quotas

Aur ye obc sc st kon banaya hai ye apko pata hi hoga ki ham apse uche hai to raho uche nuksan sabse jyade obc ka hai 10% log 90% nokri kar rahe aur sc st 9% aur jo sabse jyade hai obc wo 1%? EWS ka cutoff to obc se jyade niche ja raha hai bharti bhi jyada hai obc se kai exam me apko ye bhi pata hona chahiye kya kare obc 1% bhi nokri na kare ese jyade practical sochu?

If u gets IPS your salary itself become more than 8lpa ... So if u show them then too u will be rejected for EWS 😅... Well she tried it's great.
