    My brother won his domestic violence hearing by himself. I am a family law lawyer and advised him to do so and I was available on the sidelines. If a lawyer had represented him, he would have lost. You have to know your jurisdiction, the judge, and be able to understand human nature and read the room. Much more goes into it than simply black letter law and attempting to win on a technicality.

    One of the single biggest mistakes in my life was hiring a lawyer to "help" me against bogus OP charges she trumped up to "get the house" in the divorce. I lost. Ejected for 1 year. Now, the year is almost up, her lawyer already threatened my via email that they are going for another 2 years, and that hearing is in less than a month. I am a nervous wreck. The police, lawyers, courts, and judges have one goal in mind: Money. And they'll destroy every family on earth to get it.

Seriously...Getting a new partner before the divorce/custody hearings are even over, running up debt right when a divorce process begins, fighting over how to screw the other person financially, because, you couldn't just let the other parent live and move on, right!

    People are dirt bags. I wish your philosophy was accepted by more people, but divorce is such a vindictive and adversarial process that one party is almost guaranteed to attempt one of these aforementioned “tricks” or as I call it the standard divorce playbook.

    Think about this anecdote. You and another person (In this case will say it’s a stranger and that they have no reason to be vindictive) have the chance to win $1 million each but if just one of you decides they don’t want to share it that individual can win 2 million. Just knowing this little fact right here, will that change your assumption of whether or not they will share or be greedy? The following is not necessarily a ominous characteristic of humanity. It’s just a fundamental aspect of human nature to be cautious. That caution becomes suspicion only after nefarious attributes have been allocated to the concept in retrospect. This is more instinctual than an actual nefarious action Consequently when you add the vindictiveness of a divorce, the suspect/suspicion of human nature, and the greed that accompanies most humans.

    "you can't afford not to hire an attorney" i.e. in "family" (civil) court a pro SE party (not represented) really has no rights if the other party is represented by an attorney. The Court must defer to the party represented by an officer of the Court and should "liberally construe" (disregard) a pro SE litigants motions, testimony, etc. Rule number one: file an objection to referees.

    A guardian ad litem or amicus attorney is an informant for the Court. Like criminal informants and cops, they absolutely do not care about the "truth" or justice. If you choose to cooperate with them you do so at your own peril.

    "avoid conflict" If there is a huge disparity in income or resources, the party with more resources will frequently use "conflict" as a weapon. Everything will be grounds for "conflict". The case will be designated "high conflict", the Court will automatically defer to the party with more money using "best interest" factors.

    spouse left a year and half ago due to my substance abuse. There are no children involved. i've been to a few treatment programs and continue to relapse.     Child Services and Family Court are an industry where children are the currency, and taking children is extraordinarily lucrative. Mother’s have a higher percentage of children in their care than fathers. Hence so many more single mothers are targeted by Child Services and Family Court as the single mothers are deemed easy pickings. When it’s a Family Court dispute between parents the game is set against the concerned parent because that makes the concerned parent fight harder, which entangles the parties in court battles that will drag out for years guaranteeing all the gamers have another stream of income set. Most concerned parents will be the mothers because generally it’s seen that males are often the physical abuser in relationships and so mothers file the concerns. The players turn on the concerned parent. That makes the concerned parent (often the mother) fight harder to prove their case. Hence the legal fight has had petrol thrown on it by the industry gamers. The Family Court has been Hijacked, and the Family Court Judges whom previously were Family Court lawyers playing the same scam are now the Mafioso Dons at the head of the Cartel. The custody switch, by targeting the concerned parent, banks on the protective/concerned parent most likely willing to spend any amount of money to continue fighting for the safety of their child while the Family Court players and scammers rake in the cash. Without a doubt the Family Court has been hijacked by an orchestrated Family Court Cartel, whom are committing corrupt commercial domestic terrorism through the use and abuse of law for pecuniary gain. In the Family Court and Child Services children are a commodity. They are withheld so the legal fight will drag on and keep their industry healthily employed and their coffers full. Families and the wider community need to understand the alienated parent is most often not the abuser! The Family Court can be a toxic environment that entraps parents in a web of entanglement. In most businesses, you want to harvest the low hanging fruit, as it is cost effective, requires minimal output, and generates good income. Lawyers know this, its their bread and butter. Family Court lawyers have mastered the Art of gaslighting the parties once in the Family Court. They then create a legal entanglement, and milk the parents in a web that will often drag proceedings out for 2-5+ years. By the end of it one if not both parents will have lost most of their accumulated wealth, and at least one is likely to have lost a home. The lawyers will have moved the wealth to them via streams of Court filings, and applications. Often the concerned parent will be targeted with accusations of malicious notifications, and "emotional" abuse. Lawyers will even run "Potential emotional abuse", they don't even have to prove it in the Family Court. It's enough that they raise it as a possible risk. Not probable, nor likely, but "possible". These lawyers, and the parent not being targeted can even accuse the other parent of mental illness, and the Court will act on that concern. Then Specialist report writers will come in and often back up that concern and rubber stamp it for the majority group targeting the sole parent. Why do they do this? If you target a genuine concerned parent, and disbelieve their concern for a child's safety that will cause the concerned parent to try harder to prove the concerns are valid and real. The lawyers, Child Services, Specialist report writers and Judges then often push back harder on the sole parent defending the safety of their child. Eventually they push the parent into supervised contact, or no contact at all. That causes the parent to fight even harder for the child, and meanwhile the cash registers keep ringing. Its an evil system that is abused by those on the gravy train. They hold children for ransom over the heads of parents that will spend every last dollar they have attempting to save their children. Many of these parents run out of finances in the first 1-3 years, and then if lucky they secure Legal Aid, but either end up with a junior lawyer, or if they are lucky to have a senior lawyer, that lawyer often wont put the necessary hours in that the web of entanglement requires. Your legal aid becomes depleted before you get to the substantive Hearing. Your lawyer becomes difficult and you are pushed until you remove your file from the firm and look for another lawyer. Because your legal aid is now gone, you have to prove further legal aid is warranted and justified. It is at this stage you will struggle to get a lawyer, because you had one, they didn't do the work they should have, and a new lawyer will be reluctant to pick up the file left over from a previous lawyer. These lawyers prefer fresh picking$... So, you self represent. At this point the lawyers and Judge's whom were previously senior Family Court lawyers playing the game, see you as a hopeless case that hasn't come to accept you have lost. You are now bumped around in the court with numerous judicial conferences and round table meetings, reports undertaken, and pressure put on you. You either break, and then they gleefully say "see, we called it right early on, they have mental issues...", or you give up and walk away from your child, or at worst, take your life. If you survive, they will beat you down with an award against you for Legal costs, which they will throw on you now you aren’t protected by legal aid. That is the sad reality of the destruction caused by Child Services and the Family Court gravy train Rort where children are the currency.

    In Ga. I became a victim of their outdated divorce laws and I am trying to change them through legislation but don't really know how to start. I was thrown out of my house and the business that I own by meritless claims of physical abuse . I contacted most of my state representatives about introducing fair and nonsexist legislation and have gotten no response.

    Omg- I was just watching because I was curious..I am the mother that had to move out from an extremely toxic marriage to a narcissist…I suffered 19years of emotional abuse-coercion, manipulation, gaslighting, belittling…I am suffering from PTSD now and trembling at the thought of having to go up against him in mediation..in Canada divorce court is NO FAULT!! Totally supports the abuser and continues to abuse the victim… Now my ex, who used to make an amazing income has manipulated the healthcare system into granting him LONGTERM DISABILITY!!! So the alimony that is supposed to help pay for my health care will be cut in half… My therapist’s bills are going to bankrupt me😢😢

    here in SC, my lawyer filed under one year legal separation right before I had a PI show proof of adultery. now my lawyer will not change the grounds for divorce to adultery he wants me to keep it as one year legal separation. ----------------------- also, how can I get a mediation agreement changed.     Child Support open case in Ohio, but kids have been with Mom for 2 years, CPS case in Ohio, where child in an altercation with dads new wife..so now dad will not reverse or transfer, close the child support in Ohio. Kids live with Mom in PA. & Ohio Child support coming after mom for arrears..which do not owe, since kids with Mom. What is the best way or what to do.

    @@dennisa4092 if you are in a state with equitable distribution, you could get much less than half. IF she is 67 years old and has never worked, but you have social security income, the courts could give her more of the house and other assets to make it equitable (i.e. fair).

It's always funny to me that they claim to be strong and independent but want the money someone else worked for. Don't try to hide money or anything when you go to court. The more honest you are the better it is to the judge.

Keep track of all your financial statements, dates and times, and above all else don't do anything that gives her the excuse to call the police. Don't even tell yourself it's not my fault. In the eyes of the law it is.

    Here is how my ex kept my kids from me after divorce. 1) she says the kids are both sick this week. And next week too. 2) the kids do not want to go on visitation this month. 3) says the kids now hate you. The courts will not do a thing about these. You can fight in court if you have another $30,000. I did not have it because the courts already gave her the house, alimony and child support. Guys think they are starting a long, loyal family. It's probably not going to work out that way because the man was her last pick, not the first.

I’m sure you are a very mature and responsible husband and father, kind, affectionate, not abusive in any way, and you not only payed the bills, you were loyal yo your wife, supportive of her and very involved in your children’s life.     @@harleyfsbo3027 I am not fond of placing labels but this is the quickest way to explain what may be at play here. It’s he said she said we don’t know what’s going on but from what he wrote those are classic signs. Look up narcissistic abuse, and parental alienation.

    1. Wife wants husband kicked out so she can divorce him and live in the house, so she files for an OP, and at the hearing, her attorney submits texts showing the husband calling her a b i tch and an a ss h ole the night before she files, ie. this is the last straw! Hearing is held via zoom. Wife's attorney surprised the court with the texts. For some reason, the texts are allowed as an exhibit. 2. Judge ejects husband for 1 year. Immediately after the hearing, the husband's attorney asks opposing counsel for a copy of the texts. 3. After 4 months of asking for the texts so an appeal could be filed, wife's attorney finally gives husband a copy of the texts. 4. Problem is, the texts were fabricated and it can be proven. 5. Question: at the appeal hearing, if all parties agree the texts were fabricated by the wife, will the judge overturn the OP?

    @@coreyanderson1457 imputed, and women also (and often do) have theirs imputed as well. If you are voluntarily under- or un-employed, you probably should have income imputed. This goes for both parties imho.

    One thing for sure, if your a married man with children, you will become homeless. Your going to pay 33 % of your take home pay, your going to pay her alimony for years..... in other words. Your going to lose everything, including children. Men should never marry. Women should marry the richest guy they can get to marry them.

    I love the fact that these guys are actually admitting that they are a huge part of the problem as to why there is such disparity in the courts and the reason why most of DV goes undocumented. And then one of these guys admits to that by saying , if there is merit to the claim then we get in front of it by making him look good to the judge. Making claims that women largely make false claims and it it is the most abused statute….Where is the source on that? I can point you to studies that say otherwise. Really? I love how there is so much evidence that counters what is being said here. ‘We don’t want the ‘boys’ to be on the defensive…’ what a joke. Instead of talking about abuses of court system regardless of gender, you are making some pretty baseless claims against women as a whole. If someone says ‘I’m going to kill you’. Who says that anyway? This video is a JOKE and minimizes what is a glaring problem

    @ K Michel - you are very right! This is all meant to take ACCOUNTABILITY away from ABUSIVE MEN who abuse day and night in the private where no one is looking and then put on a clean facade to look good outside the home - it’s disgusting how DV victims are first abused by these monsters and then a 2nd time by the system. I’ve got Good News for these A$$h@le$: The days of these covert, two-faced criminals are numbered. There is no crook or tyrant who lives forever. Go put the judges in your pocket here but who’s going to save you from the Judge of all Judges? No one. Not even your own mother. Good Luck. You’ll need it.

    Most times women do in fact make false claims of domestic violence, it's a tactic used often by women to win divorce battles.
