    I don't understand why Dr Grande doesn't think It rises to malice. The legal concept of malice is saying something you know it's not true or reckless disregard for the truth. It's not the common concept that implies being malicious. In the end for the jury It ended up being about who told more truths or less lies and Amber lied pretty bad.

    Well there is actually an argument that she didn’t make the statements with actual malice. She might have convinced herself that her lies are the truth due to some mental health disorder and that’s not actual malice.

    @@cocodogg3228 which If argued would probably make her win. But It wasn't the strategy used by her lawers. The lawers instead tried to prove her lies as truths and created the dicotomy of having to choose a side. The problem is that no one watching chooses her side because of the blantly discrepancy of the evidence and her testmony. You could actually see that Elaine was going for the "victim" defense while Rottenborn the "law" defense which didn't help because having two lawers on your side defending diferent lines of argument didn't protected Amber on all fronts. Instead made Amber vunerable on all sides.

    Regarding "it's plausible that Depp was abusive at one point in time" : if there's no proof of evidence of that statement, it has no merit.

    Look at photos of Rihanna the day after Chris Brown hit her 3 times. Her face was so messed up and swollen no amount of make up would be able to hide it and no amount of ice would have helped the swelling. And the look in her eyes? I recognize that look and Amber should be ashamed of herself for lying about abuse.

    To the argument of how high the bar has to be to be able to call yourself a victim: I think the problem was that Amber set that bar way too high: Johnny didn’t just abuse her in the ways that are apparent for most of us, he did unspeakable things and was violent to a degree that never got to be proven by her evidence (I.e: her feet were shredded by glass but was walking fine the next day, and even went to a red carpet 3 days after; he punched her unrelentingly and the photos afterwards didn’t seem to match the severity of the beating she described, etc), it felt like she added so much to the story that it wouldn’t be fair to accept her version of the facts as truth. And then you see her twisting the pledge/donate thing when she had a year without being sued to actually make contributions to the charities and she didn’t… she made it impossible to accept her recount as truthful

    His substance abuse became much worse after Amber entered his life. She thought this was going to go the same way as the UK trial. She also had posters of Johnny on her wall as a teenager. She did admit on the stand that the OpEd was about Johnny.

    I think everyone saw his drug use and weren't surprised. Most people wouldn't be surprised by a celebrity doing drugs. It seems like he was the one trying to get away from the arguments and she kept pushing him. He should be commended for not striking her back when she hit him.

    I was always under the impression that free-speech did not cover lies. In my opinion, the jury saw that Amber was clearly lying, so at that point it was no longer freedom of speech. To lie about someone harming you in the manner that she stated, to me, is malicious. It wasn’t like a little white lie as it’s called. The point of lying was to make herself a victim and, intern, Johnny the perpetrator. I don’t know how you can see her lying is not malicious. There was no other reason to do it except to make her look better and look like “the monster”. That’s just my take.

    Also setting up herself as a victim and then spoke person for movement against DV/SV - she was profiting from this whole shitshow/lies. I agree I definitely consider her intention as malicious!

    My wife is a covert narcissist and I didn’t have any issues with substances, I didn’t use didn’t drink nothing. But after years of being within my wife, I began to have back pain that nothing could alleviate. I went to specialist throughout the state and no one could pinpoint what the problem was. I was given muscle relaxants pain killers all the way to oxycontin and it did not help. It almost killed me. Once I learned about covert narcissism, I realized what was going on and was able to learn techniques to block what was happening. I can see why Johnnies use would have ramped up.

    They did during the cross. They grilled her about using drugs while JD was trying to stop using. They pointed out how she had put dinner, dancing and drugs on the wedding agenda.

    I am glad to hear Johnny’s drug abuse addressed as part of the reason he lost work. While Amber has her issues, and clearly isn’t a good partner for Johnny, more than likely, a sober Johnny would have left the relationship long before it reached this level of insanity and maintained his professional status in the process.

    Guys, it wasn’t a freebie for Amber bc it was clearly shown that Depp’s former atty had been guilty, and bc he had represented Depp at the time his statements were made, it casts guilt in Depp in that one question.

    The reason he won was becasue his claim was based on the title of the oped which said she was a victim of sexual violence, which she clearly was not. The rest almost doesn't matter. She spent 150k on wine in one year... and he was letting her friends live in his penthouses for free. I don't think he was financially abusine her in any way.

    Exactly. If it was "I was a victim of emotional abuse" then you can totally make an arguement on its validity with all the evidence presented. But if you are going to say sexual abuse theres gotta be something more than just your own statement.

    I once had an allergic reaction to a facial moisturizer. I looked awful. I took pictures and kept records. In this age, it would be easy to take photos and keep records. There wasn’t a pattern of photos and records (even as simple diary) and that made her claims very difficult to believe.

    The way I saw it, there was a ton of pictures. They just didn’t show any evidence of what she claimed happened. She took pictures of messes and mirrors, of the bed after it was broken. But not of herself? That really makes no sense

    A big name Disney has made money off of with a long rap sheet is Robert Downey Jr. I think Japan kept him out during the premiere of Iron Man 3 because of it. RDJ was hired prior to Disney’s acquisition of the Marvel property, however. It’s interesting to think about because the risk of hiring RDJ payed off substantially and Disney profited from it.

    Great discussion as always. I watched the entire trial and while there were pictures of JD sleeping there was no evidence to confirm he was passed out in those pictures. Also, no evidence at all was submitted that he was a blackout drunk. AH certainly said he did but the blacks out were always conveniently located when she needed to create abuse scenarios. She is hardly a reliable source

    There's pictures of our whole family like this. We also work really long hours and have a tendency to fall asleep anywhere. My dad fell asleep in line at the DMV. We have pics from some holiday meal, with three of us sleeping at the table with plates. Was he blacking out? Was he working 10-14 hour days in the heat? Was he just over 50 and on vacation? Or a combo? Why did she have more documentation of him being embarrassing than she did of any bruises (ones that actually look like bruises) swelling, glass cuts on feet, destroyed property?

    I suspect that had Depp actually signed the new will she wanted him to that he would have had an "accidental overdose" on something laced with fentanyl on the private island hours from a hospital. Then she would have written a piece or book about his addiction and her having been "so worried for a while". "See this is what a heavy user her was." I don't think she thought to accuse him of abuse until when his mom died and he said that's it. Get out and take your friends with you. She asked for the penthouses and a monthly allowance among other things and gave him 4 days to comply or else. He didn't comply - he was in Europe. And she did the TMZ photo of her getting a TRO. For ehich she did not have to appear in person. And she could have used the private entrance with no press allowed if she did want to go in person.

    Wait what? Plenty of people testified that Depp destroyed his own career? I disagree. I think they did a great job of establishing that the OpEd was responsible his career being destroyed. I hope that he’s able to start acting again. As someone with 13 years in recovery, I truly hope Johnny is sober and able to remain sober. My life has been so much better since I got clean off of RX drugs. My worst day sober is 100 times better than my best day using. I have a wonderful group of sober support.

    Just in relation to your closing comments, I think that one of the reasons why men fall victim to physical abuse at the hands of a woman, irrespective of her stature, is because of a deeply held belief that a man should never hit a woman. It is something that is taught to boys and men as being a line that one should never cross and so, when a man finds himself at the receiving end of a woman's fists he will often just literally stand there and take it without ever hitting back. Then, after this, there follows a sense of shame that a man will feel about a woman having beaten him up. It is so emasculating based on what men believe about having to be big and strong and the protector. It is extremely difficult for a man to admit to being in this kind of abusive situation which is why it is so under-reported and it happens way, way more than anybody could imagine. This is why it was important for a very public figure like Johnny Depp to come out and 'tell the world' as Amber said, that he was and is a victim of Domestic Partner Violence at the hands of a woman. I saw hundreds of posts on so many threads of men coming out and telling their story for the first time during the course of the trial and afterwards. It most certainly has opened a door for male victims. I don't think she did any favours for female victims though and that is very unfortunate.

    This was a great episode! A nice wrap up to the trial. I feel called to state an opinion, which is always dangerous for me because when I open my mouth my foot typically enters immediately, and I use the words “But I didn’t mean it like that” more than any others in the English language. But anyway, here it is. Just remember I meant no harm. I think people in general have violent instincts. Aggressive territoriality is part of who we are as a species. Anyone, of any sex, gender, creed, nationality, ethnicity, status of ability, or any other ephemeral line we might draw to map out what is human, is capable of harming someone else. There are trends, and people in some groups have a tendency to get harmed more than others. That doesn’t invalidate the fact that there are instances of that swinging the other way around, and when you talk about domestic violence and abuse in terms of more than just physical assault that pendulum might swing more the other way, as it rightly should. It seems to me that some people, when they hear about men suffering domestic abuse, have a knee jerk reaction that if they accept that, it means they invalidate all of the women who have suffered the same thing. It’s not an either or proposition, but it’s like it makes some people feel threatened. It honestly makes me feel threatened, even though intellectually I agree with Dr Grande that each allegation needs to be evaluated in an evidence based way. I think hearing about men being abused reminds me of all the times in my life I saw that situation the other way around. But our experience can blind us as well as educate us, and the decisions we make as a society can’t be based solely on emotions. The last thing I want to say is to repeat that everyone has a right to be protected from abuse. When society tells you you don’t have a right to be protected, it is damaging and that opinion comes from personal experience. It doesn’t matter if that’s the cop not taking a woman’s allegation seriously, or people saying that men can’t be abused for some magical reason simply because they’re men. Everyone has the right to be protected from abuse. We have to at least stand up and say that. We have that responsibility to each other.

    What sunk Amber was her arrogance. A different affect on her part would have perhaps had a different outcome for her. Amber’s use of substances and violence also predate her relationship w Johnny. I still think she’s without conscience, looking at her history. It’s the malice on her part, and the creation of false realities and the cruelties that make me tend to think of psychopathy in Amber. Depp is also a deep study, Guys. I can more understand where he comes from. He may be on the Spectrum to some degree, if you’ve watched his persona since the start of his public life you can see painful inability to communicate. As psychologists, these guys could be a fun study to you. Depp, particularly.

    I find myself triggered by someone who can just invent lies designed to harm another person. Maybe we all have an impulse to cover over embarrassing things, and deny true things, but inventing things about others is harder to explain. Amber's final testimony gives me some hint. If in your mind someone is "powerful", then you may believe you have to lie to be able to protect yourself, so forging evidence of a bruise to ask for a restraining order because your lawyers tell you you'll be homeless. But anyway, her statement is all about power, and seems to justify lies, and rationalized somehow. But it still seem terrible, how a mind words that can confidently repeat accusational lies like this. Horrible. Amber: "I know how many people will come out. That's his POWER. That's why I wrote op-ed. How many people will come out in support of him and will fall to his POWER. He is a very POWERful man. People love currying favor with POWERful men."

    i was also thinking he might be on the spectrum. from his speech patterns and also the doodling and candy, to me it seemed like he was stimming. it CRACKED ME UP when elaine suggested the candy and drawing might be narcissistic behavior. i know that a lot of us autistics end up spiraling out into drugs and alcohol, certainly chain smoking, and attracting people who aim to take advantage of or control us. he likely took her at face value while in the early lovebombing stages.

    I understand that their relationship was very toxic and they both acted horribly with one another. However, Amber undermined her own abuse by the exaggeration of events, lies, and inconsistencies during her testimony. Somehow, her claims of abuse got lost amongst all of that. Furthermore, her statement regarding the results of this trial “being a setback for victims of abuse” is just nonsense. Her claims were taken very seriously, however upon close examination she wasn’t believed. When she first appeared in the news with a bruise on her face, the vast majority of people were on her side. As the story developed, opinions about her began to change. Lastly, I agree with Dr. Grande about the result of this trial, I was also in shock when it came out. The burden of proof for malice is very high. Again, excellent analysis and thank you so much for sharing your thoughts. Love you guys, stay well.❤️❤️❤️

Id buy it:) and the doc maid a good point about being abused by bpd personality traits… i feel like that awareness is most important!!!     Amber gave a "maximal" performance, seemingly on the idea the most she offered, the more believe would believe "something" was there, while the reality of listening is the more she said, the more hints we had that she was elaborating and then contrasting to all of the audio clips where she was clearly aggressive and admitted starting physical fights, it became easier to conclude she was simply lying. But it is terrifying, that someone could lie like her, and so confidently. Now I think the UK trial gave her a false confidence, because everyone told her US laws had higher standards for defamation. In fact her trial testimony itself WAS the defamation, missing from the op-ed, but implied.

    I contrast to Christine Blasey Ford's accusations, and they seemed more credible to me because they were minimal - two drunk boys trap a girl in a room in a 2 minute encounter that scared her, and apparently easy for them to forget the incident, while Brett Kavanaugh was the one with the "maximal" performance of denial, although there it didn't matter because Republicans had the votes. If Kavanaugh had simply said "I have no memory about this, but we were stupid boys and it's consistent to what is possible happened. I can't defend anything, but say I'm sorry for what happened, and I did not act badly as an adult." Of course no one wants to say that when a career is on the line, so he has to deny everything, which is sad.

    I disagree with the panel as far as Depp's career, btw I've never been a Depp fan but took his side in this. In my opinion, Depp signed up for this whole venture for his future career. It wasn't about anything other then clearing his reputation to whatever degree it could be. Depp knew he won the court of public opinion (hence his absence for the verdict). His celebrity status and his box office appeal will not change in any way and this will be but a mere blip on his future status. Contrast this to OJ Simpson, he won his trial but lost the court of public opinion, and relatively lost everything he had forever.

    Ok last comment. I think you should have watched a legal analysis of the trial before making this. Your mental health analysis is goo, but the legal analysis is important. Emily D Baker’s analysis is probably one of the best. Natalie Lawyer Chick and Nate the Lawyer did great breakdowns too. Amber actually said during the trial that it cost her 6 million for the trial. She wasn’t supposed to say that on the stand. One of many things she was not supposed to say.

    I wish I could be the ghost of Christmas future and I would float in there to tell you what you know by now about the motion by Heard's team for a mistrial due to the mystery of juror #15 who nobody noticed was 52 instead of 77 years old 🤣 Of course the judge threw it out but I'd love to have heard what the three of you would have said about that debacle. Clutching at straws doesn't even come near to covering this lame attempt by her team who ultimately got lambasted for not doing their own job and vetting this juror properly in the ample time they had to do so. Elaine dug her own grave yet again. What a car crash!!!

    She came across as a textbook narcissist in her denial, deflection, and fake emotion. The fake crying is cringey and disingenuous. I’m not a crier either, but if I were on the stand, I either would or wouldn’t cry. If I did, there would mascara streaks, red nose, tears, and red eyes. But with her, the makeup stayed perfect and no tears. She would have been better off just to be matter of fact and tell the truth, but a narcissist can’t do that. The whole thing just seemed like a bad performance rather than an authentic person telling her truth. I don’t think Johnny is any saint either, but the op Ed piece allegations cost him big time, and the jury decided that wasn’t fair. It wasn’t a criminal trial, but civil liability.

    Don’t you think that if a person claims to be a victim of abuse in the Washington Post that it also amounts to a claim that they were abused and were not an abuser ? I think the jury had a hard time believing many of the abuse claims, and then also were convinced that she abused Johnny

    Don’t forget that if one is married to a substance use addict, no matter how high functioning the addict is… the addict has a relationship with the substances and nothing else. They also have the Pistol and Boo fiasco in Australia; which was totally reprehensible. He was an addict prior, and he was socially making errors. Depp is an addict. And he is married to his substances.

    If you weren't convinced there was malice, after hearing those recordings, and you don't see a defamation issue with the OP-ed after seeing zero proof that he was violent to her, I can't help but question your credentials. That blows my mind. She was beyond cruel. She was beyond hateful. Boy, I'm outta here.

    I have valued Dr Grande’s opinion until this case. How can you not see that by the simple fact of Amber telling lie after lie that it is legally malicious? She testified to all these things in the trial against the Sun newspaper, that is why she had to go all in in this trial, she knew they had the uk transcripts, or she WOULD have down played her story, and most likely would have won! Thank God she could not adjust her “ truth” ! Johnny was the one who was reacting to her aggression. Dr. Grande, have you really watched or researched this case? Do you have a clue about her? Do you think that she is a “ victim”?

    During the trial, there was a kind of gender inequality on display that might have been overlooked. Johnny was able to be social and display jockulaity. He was able to snicker, and react in an authentic way. Amber was not free to do this. Any reaction, even attempts at stoicism, were used against her. REALITY is, two beautiful celebrities found attraction, and then, disappointed each other, when each turned out to be imperfect human beings.

    Well said. She was so scrutinized, nothing was right. I thought she held her own as Camille to me was antagonistic, childish, I had a hard time watching her. Johnny has had a substances issue and that played into how he treated her bad too. They both were at fault.

    I saw it differently. I saw his demeanor as more consistent (even when he was joking). Her demeanor seemed to me to be more of a switch being flipped from one minute to the next.
