It's to bring to your kind notice that Sabhajit Tiwari judgement was overruled by SC in CSIR scientific workers association and ors v. UOI and Ors.(2005) .In this case CSIR has been held to be State under Article 12.

Sir the whether the judiciary state or not ,,, it also Clear that in the case of A.R Antulay vs R.S Nayak AIR 1988 , art, 12 of the constitution includes judiciary also

It means that when someone is acting as judge, fundamental rights cannot be enforced against him? Then it is violation of law. What does it means that when acting judicially, judiciary is not state? Means indra gandhi could not curtail fundamental rights to enforce dpsp, but if judiciary wants it can..? Is that what it means?
