You are not right here, I am facing tremendous pressure on this law's misused by my client of cheque Rs 64 lacs was given against Performance Bond against Particular Order which client itself failed to get the work done from us through out the contract and when we asked to return the cheque, he take advantage of cheque bounce laws which is itself fraud But we can proceed to bring facts only in front of Court and he's still saved from this fraudster acts by filing the case for which there's no transaction, no question arises of performance

Because normally no one file the case in court for harrassment of other, bur realisation of his hard earned money, which he can not realise by gundagardi. Court me case file karne se complainant ka bhi koi kam harrasment aur kharcha nahi hota, vo kyo galat case file karega.

@@good_life8888 Not always. I'm handling 138 matters. Where 30% of my client's are accused and they have been falsely implicated. That's the reason I took tbeir brief. One of the Client is senior citizen aged about 78 and 80 years both Husband Wife was threatened by Land Mafia to sign on blank cheques of heavy amount...Very genuine case of an accused in which I will definitely obtain favourable order... 70% percent of my client's are Complainant. So it's not always Accused are wrong by giving cheques to Complainant ...Circumstantial evidences matter a lot.

Respected Sir, I am an accused in a case of 138. I had taken Rs.150000/ from that person which he transferred to my account online. But he bounced the check given by me by filling 600000/ and then notice Sent and filed a court case. In that notice he has written that I have transferred 206000/ cash to you and 144000/ to your son. It is true that he has transferred the said amount to my son. But my son's transaction goes on separately because my son does his own business with his wife and children, staying away from me. Please guide me whether in this situation I can be booked under section 138?

138 or any case depends on the ingredients of the charges. If you have all the Evidences to meet the ingredients your lawyer should be smart enough to finish the case uptill now. First check out the delay is from which end.

First of all, the borrower does not appear in the court, without a warrant, it is better to take someone's money and do a scam, was the borrower distributing the anchor of the check without taking money

Sir me complainant hu...mera case cross examination stage me he...mene rtgs ke through paise transfer kiye thhe apne friend ko....aur usne cheque diya thha... bounce ho gaya thha....tabhi case kiya he mene.......but mene paise dete time ek friendly loan ka notry aggreement bhi banaya thha...but mere advocate ne abhi tak usse court me present nahi kiya he......mera question ye he ki ...kiya me vo aggreement present kar sakta hu court me ....usse mere case koi wrong impact to nahi padega....

Hi, Shyam, as per supreme court bank can not use your chq given as security. If bank does it, that's wrong. It's better to talk to your lawyer & clearly explain the facts to him in case of case of 138
