David Lee Roth Accidentally Exposes Streaming's Greatest Flaw / A Different Kind of Truth

UPDATE: Apparently, I have gotten through to Dave and he has signed off on A Different Kind of Truth going back up on the streaming services. Yay to me! Thanks, Dave.
Welcome back, friends; and hello to those who are new to the channel. Last night, I was doing my usual Saturday night activity...watching KZread. I saw a video from J.C. • Video about the current conflict between David Lee Roth and Wolfgang Van Halen. I had been reading about it on a few music sites, but after watching this video, I started thinking about the issue more seriously.
Essentially, the dispute is about the final Van Halen studio album, A Different Kind of Truth. The 2012 record marked the return of David Lee Roth as lead singer, and the debut of Wolfgang as bassist. For my money, the album is incredible. I love it. A Different Kind of Truth received mixed reviews from fans and critics.
At some point in 2022, the album quietly disappeared. It was pulled from streaming services like Apple Music and Spotify, and stores could no longer order additional copies. In an interview, Wolf hinted that the reason was that someone in the band -- cough cough -- wouldn't cooperate on getting it re-issued.
The "conflict" came to light after a series of videos that Diamond Dave posted on his KZread Channel: ‪@TheRothShow‬. Roth states that the album was both a commercial failure and a drag to create. Apparently, he felt the need to publicly state this to the world. Supposedly, Roth (and maybe Alex Van Halen) don't see the point in paying lawyers to re-negotiate a new deal for an album that sucks. Usually, Roth's videos are funny and entertaining. These were not.
First off, the album doesn't suck. And as I was preparing to defend the album and urge Diamond Dave to reverse course, I realized that this particular dispute makes a fantastic (though maybe inadvertent) argument in favor of physical media and against streaming.
I own the Van Halen album, A Different Kind of Truth. I can play it right now. I didn't even notice that it had been removed from the streaming services. If I didn't have a physical copy, I couldn't hear this fantastic record. For a serious music fan, this creates a huge dilemma. How can I ensure that my personal music library contains all of my favorite albums? The only way is to have a physical copy.
The digital era has created a new definition of ownership, as well. When you "buy" that digital copy of the Barbie movie, do you get to keep it forever? Check the fine print. You don't. Music, movie, and TV fans need to re-think the idea of ownership in this age. It's a frightening thought.

    I import my CDs into my digital library. I can play them in my car via bluetooth. Apple lets you mix your personal library with your streaming “library”. At home, I still play CDs and records all the time.

    I have this album on Apple Music, it’s still there because I bought it.. before I learned you can just pay 10.99 a month and have millions of albums in your file.. when I had to shut the subscription down, all my playlists and albums I added were gone , but this album and the other 30 plus albums I actually bought are still there …

    You bought it on iTunes and it remains in your library. But the album is definitely not on Apple Music to stream. Still, I would rather have a physical copy because I don’t really trust Apple

    @@Thedarkstuff yeah I’m late to all the streaming gig. 54-Gen x… have about 300 dvd and about same of cds.. don’t really pull out any of them anymore… I definitely still buy dvds as some you can’t rent anywhere and if I rent it more than once I’m gonna purchase it for my library… I remember buying music and movies about twice a month back in the 90’s and 2000’s … I bought over 45 albums on Apple Music before some told me about just pay the monthly fee and you can load all you want…lol… your right on not trusting the digital aspect , cause if a album isn’t laying royalties right Apple will take off that song - perfect example hearts best of from 98’ every song is on there but track 4 - dreamboat Annie… or goo goo dolls dizzy up the girl every track is there but #1- dizzy… pisses me off as I paid for full album.. think I need to complain to them again about I paid for every song put the shit back…. They once eliminated armored saints album - raising fear.. I emailed Apple screaming that I bought this and you can’t take it away - I don’t care if royalties changed and you don’t wanna pay - they put it back up… they did the same to the pixies - greatest hits album and I also got that reloaded… I get the fuk this .. I’ll go old school and physically buy the album…

    The album actually did pretty well, selling over 423,000 in the USA and close to a million worldwide. Also went gold in Canada an close to gold in Japan where Tattoo was a big hit. I find it very disrespectful to Eddie Van Halen to try to erase this album from the history books.

    Good video and breakdown. I too am a DLR hardcore fan. I was disappointed that ADKOT was removed from Spotify. But like you, I have physical copy and jamb to it whenever I want!

    Excellent points. Clearly a flaw in the system. It’s like the law of unintended consequences. Someone who buys a song on a streaming platform should obviously have access to the song permanently or should get their money back when it’s taken off line. I’m am also team Dave btw his podcast is pretty entertaining. It’s like he finally learned the value of editing

    From what I have been told since the video was published, if you bought a digital track through itunes, you will always have it. But, if you purchased episodes of a TV show or a movie from itunes, it contains DRM elements and can be made unplayable.

    So yeah the whole vibe of the album was this hearkening back to the club days etc... those interviews they did with Ed, Al and Dave reminiscing about the old days was the schtick , as if they were all getting reacquainted with each other...mostly fan service stuff I get it... I thought it was a solid record personally... and they sounded pretty good on that tour if ya got Dave on a good night...

    Another aspect that I've personally run in to is even if I "own" a digital streaming property, even if it's not taken Away, it can be modified from what I originally purchased due to current political or social trends...

    I have the cd, deluxe cd w/acoustic dvd and vinyl. I am happy I got them although I remember feeling like the vinyl was expensive. I've also had some movies that I bought have my access be removed. That super pisses me off so for great music, I create space in my room. Got the DLR Band, too! :)

    I made the mistake of getting rid of a lot of vinyl in the early 90s because I thought I wouldn't need it. I have avoided that mistake with CDs. It's worth it to know I won't wake up one morning and realize some of my favorite albums have just disappeared.

    While I am a big digital content owner, I do have it on my own drives - I won't purchase digital items unless I can have them in my possession - I won't do cloud ownership.

    You can record anything that plays through your computer and create a near perfect digital copy . You're allowed to record a copy of anything for personal use . When we were kids we'd record tapes off the radio when we loved a track and that was much worse because the quality sucked , the DJ talked and the song ended prematurely . People just can't be bothered to own their own music anymore . OMG If I want to keep this forever I have to click record?? It's like that bit in back to the future 2 when the kids say 'OMG you have to use your hands!!!" after McFly plays the Wild Gunmen arcade game in the 80's store . All those people complaining about their Itunes library that even the most ardent listener would have a hard time filling a $80 4TB HDD yet they're happy to play $50 for a Vinyl record stamped from a digital master ?? People are just lazy and they don't care as much as they like to complain .

    I love A DIFFERENT KIND OF TRUTH. It’s not completely VH without Mike, so it’s slightly different, but it’s still a really great solid album.

    I remember when that VH album came out. I borrowed it at the library and ripped the mp3. Glad I did because it's a good album. Back in the 2010s I bought some digital music from iTunes and they're still available. But it's Apple. If I had bought them somewhere else, probably not. I thought about this recently. There's a couple of great smashing pumpkins albums that are not on streaming. Not sure why not, but I'm glad I got them on cd. I listen to Louis Rossman a lot too. He has some great opinions about that. Physical media is definitely the way to go for serious music and movie fans. They can't take it from you and they can't censor or edit them.

    I bought a CD player boombox yesterday for my painting studio so I can listen to my CDs while painting instead of doing nothing but recycling KZread over and over. (And no, I don't have a "streaming" service like Spotify or whatever. AND I'M NOT GOING TO.) I look on the back of the box and it says stuff about "nostalgia" and "when you're in the mood for the oldies" and that kind of thing. We are living in an age where people who actually want physical copies of music/media are considered elderly geezers. Do you know how many great CDs I've found at Goodwill over the years for $2? What's wrong with people?

    A-ha! Thought so. No trolling intended. I agree, Van Hagar and streaming purchases suck. (Hagar did a cover of 'Heroes', the singing was fine, but he left out the epic third verse, the real meat of the song - concrete evidence that he just doesn't get it).@@Thedarkstuff

    Dude! Yes!! The point about the demos! That argument always infuriates me. They are their unreleased songs that they wrote. Do you think any band is writing an album completely from scratch? These people have no nuance as to how art works.

    Roth made clear, he thinks it sucks. For a creative person to withhold work that sucks is OK. I’m not doubting positive reviews here. Everyone interprets things in their own way. I’m always surprised by how people interpret my music.

    Personally, I don't think his holding out is purely for artistic reasons. I think he and (maybe) Alex will use this as a negotiating tool with Warner Bros. It's their only non-WB album. It will be re-issued, it's just a matter of what DLR can extract before he signs off on it.

    I had no idea you could “buy” a digital movie and have it taken away from you. I guess it’s the same as software. You don’t own it like you used to, you rent it essentially. And the rules can change any time. I fell into the trap of thinking streaming music would be around for good and it was a huge reason for getting rid of my CDs. Whoops. Weird that Roth doesn’t like that album to the point where he takes it away from his fans. No shortage of drama in the VH camp. Even now. WTF.

    You've never owned any media, only the physical copies. All the content, including that which came out on CDs, DVDs, or vinyl, has always been copyrighted and owned by the artists and production companies.

    People are missing the real point. Dave and Alex aren't prepared to pay for lawyers to negotiate a deal when the lawyers will cost more than the returns from the streamers. It sounds like they have explained this to Wolf and Wolf doesn't care. It isn't about how Dave doesn't like the record. He's not going to throw good money after bad. Who would. Dave and Alex know how this game is played. You can keep your ball we aren't playing. Dave especially and Alex were the business savy 2 in the band. Dave and Alex suing a Catholic girls school for non payment and winning. David Lee Roth the man who single handed caused the "Diva requests" by artists who didn't understand the brown M & M clause had a purpose and wasn't Dave being up himself.

    These guys are worth hundreds of millions of dollars. Whining about legal fees is just an excuse. It's a leverage ploy with Warner Bros. ADKOT is the only VH album in existence that is not part of Warner Brothers. Eventually, this record will go to Warner, the price of it will be a higher royalty rate on the entire catalog or some other such concession. There is something bigger at play here.

    Yeah VHIII could be lost. According to DLR ALs on Daves side n agrees to not renegotiating….Al hasn’t said a thing about a thing in ages though. Talking shit about the guys newphew could change that sentiment Not Saying DLR can’t state his side but he comes of as a petty 70 year old child

    Roth has been frying Wolfgang on his podcast. I guess we know how he feels about the reunion now. ADKOT and Tokyo Dome were compromises because they could not longer work together to make a proper album with everyone in the studio together. This band continues to be seriously dysfunctional even after the band is done. Pretty sad.

    To my ears DKOT was mostly cutting room floor stuff circa 1978-9. Other songs sounded like leftover Eddie tapes patched together without much regard to how they would fit together. There was one beautiful composition that was previously titled “Ripley” that Dave butchered with his vocal melodies and absolutely out of touch lyrics. Turning the mysterious Ripley into the haggardly Blood and Fire was unforgivable. Dave’s egotistically disregardful treatment of Ripley made me realize why there were creative difference between Eddie and Dave. As Sammy admitted recently, that band cannot create magic anymore with or without him on board. It was pretty much over around 1995 when that gloomy Don’t Tell Me dropped.

    @@Thedarkstuff I wanted to l fall in love with it. For me Dave’s last great performance with Van Halen was Me Wise Magic; Sammy’s last great song with them was the Twister Song. Last great VH song : Fire In the Hole 1998.

    @@gokhanersan8561 I thought the two Dave songs on the Best of were okay, but it seemed like they were completed instrumentals and Dave just sang over them. Maybe it's just because some of it originated in the 70s and 80s, but I thought the "Truth" stuff sounded more like a band.🤔

    Dave is pretty clearly bi-polar and I imagine his criticisms came during a depressive phase. He knows damn well that Fair Warning stiffed and is considered by many fans and musicians to be their BEST album. - To all the whiners that ADKOT I say: Obviously you're not a artist or musician. I used riffs and lyrics that were created years before the album they appeared on. No one knew or cared (pre-internet and the rise of Bitch-Piss-n-Moan became a hobby for millions). - Van Hagar was okay at the time cuz I loved the band but I almost never load up those albums now. - I have to laugh at all the lemmings who rushed to streaming platforms as well as all the entitled douchenozzles who came up post-Napster and felt that the people that make art, that these knobs can't _imagine_ living without, didn't deserve to get paid. (I used to ask students in the late 90s/early 2000s if this made sense: "I come to the restaurant you work at. The food is great! The service was amazing. I love it! I tell you and the entire staff how great you all are. Then I tell you I'm going to take your pay-cheques because I'm such a fan." That always got a lot of "Whoas") - I bought 1 album and two singles 12 years ago on iTunes. Last month, I got an old computer out of storage after 8 years and they made me go thru a shitton of hoops to re-authorize my account and after 1/2 an hour: Nope. I'm not allowed to play the songs sitting on my computer. @!%*

    I'm not buying Dave's rationale at all. I'm sure it's some sort of leverage play with Warner Bros since it's the only VH title they don't have. He's crazy like a fox. But, I don't think any of those "entitled douchenozzles" have ever thought about the consequences to the entertainment world of everything being "free"; or that having a bunch of ones and zeroes on your computer (connected to the internet) means you actually own anything these days.

    I'd bet anything that the real reason the album isn't streaming is because of a dispute over royalties. Dave wants more than they want to pay him.

    There's definitely money involved. ADKOT is the only VH album not on Warner Bros. It could be a ploy to extract something - i.e. higher royalty rate - to license the record to WB.
